SECTION B – SUPPLIES OR SERVICE AND PRICE/COSTS
B.1. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES
This is an indefinite-delivery, indefinite-quantity (IDIQ) contract for the development of animal models. It is anticipated that cost reimbursement task orders will be issued under this contract. The development of animal models is a key element in the successful development of medical countermeasures for threat agents, particularly since efficacy of products against most of these threats could never be verified using clinical studies.
Through this Request for Proposal (RFP), the Biomedical Advanced Research and Development Authority (BARDA) encourages the development of animal models to meet the threats of CBRN agents, influenza, and emerging infectious diseases in support of the preparedness mission and priorities of the Department of Health and Human Services (HHS) Public Health Emergency Medical Countermeasures Enterprise (PHEMCE), as articulated in the PHEMCE Implementation Plan for CBRN Threats (http://www.hhs.gov/aspr/barda/phemce/index.html) and the HHS Pandemic Influenza Plan (http://www.hhs.gov/pandemicflu/plan).
The requirements for the animal models to be developed under this solicitation are listed below:
- a reasonable well-understood pathophysiological mechanism of the toxicity of the substance (agent) and its prevention/reduction by the test product;
- the effect is demonstrated in one or more animal species expected to react with a response predictive of humans;
- an animal study outcome that is clearly related to the desired benefit in humans;
- data on pharmacokinetics/dynamics of the product in animals and humans that allows selection of effective doses in humans;
- allow for the testing and evaluation of candidate medical countermeasures;
- use optimized/validated assays to monitor response and bridge data to humans;
- conducted in accordance with preexisting requirements under the Good Laboratory Practices (GLP) (21 CFR 58) and adherence to Animal Welfare Act (7 U.S.C. 2131). GLP is expected for the definitive/pivotal animal studies but not necessary for the pilot studies.
B. 2. PRICE/COSTS
The final contract will contain the price/cost provisions agreed upon by the Government and the Offeror. It is anticipated that the final contract will contain a base period of one year (12 months) and four one year (12 months) option periods for a total maximum contract length of 5 years.
A. BASE CONTRACT
The offeror shall provide all labor categories and labor rates for work under the prospective contract. The hourly rates proposed for each labor category shall be fully burdened rates, including any indirect or overhead rates applicable. The fully burdened hourly rates will be incorporated into any resultant contract awards under B.3. Advance Understandings, and must be used for budgeting task orders and reimbursement of labor costs.

B.3. ADVANCE UNDERSTANDINGS
Specific elements of cost, which normally require prior written approval of the Contracting Officer before incurrence of the cost (e.g., foreign travel, consultant fees, subcontracts) will be included in this Article if the Contracting Officer has granted his/her approval prior to contract award.
In addition, the following advance understandings are applicable to this solicitation:
a. MINIMUM AND MAXIMUM ORDERING ESTIMATES
1. MINIMUM ORDERING AMOUNT: The Government currently has a Minimum, One-Time, Ordering Amount of $50,000 for all contract Task Orders awarded under this solicitation (BARDA 10-100-
SOL-00025). The Government is not obligated to order more than the stated minimum for the entire contract period including option periods.
2. MAXIMUM ORDERING ESTIMATE: The Government currently has an Estimated Maximum Ordering Estimate of $7,500,000 for all contract Task Orders awarded under this solicitation (BARDA 10- 100-SOL-00025). This contract ceiling is the Government’s most optimistic scenario with respect to monetary appropriations, future requirements. This is an estimate. Therefore, it allows for potential growth for increased requirements.
b. Pricing of Task Orders
Individual Task Orders will be issued as requirements occur. Task Orders will specify work to be performed and will reflect the labor rates of the proposed staff in effect when the task order is issued (in accordance with the Advanced Understanding to be included in the contract awards). The Contractor shall perform all services in accordance with each task order’s work statement/specifications. The terms and conditions set forth in the contracts will always apply. All Task Orders will be cost reimbursement.
c. Pricing Table
(a) Offeror shall provide prices for the total estimated support for the task order, including pricing information with labor categories consistent with proposed qualifications for personnel supporting the requirement, fully burdened labor rates, and proposed hours for the full period of performance.

Offeror(s) may propose in response to Chemical, Biological, Radiological, or Nuclear areas of the SOO as defined in Section C.1. Technical Capabilities; Offerors may choose to respond to one or more areas of their choosing and are not expected to respond to the SOO in its entirety.
HHS/BARDA recognizes that a single organization or institution may not have the expertise and facilities required to perform all of the activities set forth in the Statement of Objectives and, consequently, that the Offeror(s) may need to be supported to a certain extent by the expertise and resources of subcontractors to perform some of the activities required. However, the Offeror(s) shall be responsible for all work performed under this contract including that performed by a subcontractor(s).
C.1 Technical Capabilities
C.1.1. The United States Government (USG) seeks appropriate Good Laboratory Practices (GLP) facilities that are adequate and available to develop new or existing animal tests and/or models for the development of CBRN, pandemic, and emerging disease MCMs. In these models, the challenge dose generally should be the same as that which produces the human disease or condition and the pathophysiological mechanism of its toxicity should be reasonably well-understood and mimic the human disease/condition as closely as possible. When these models are used to test the efficacy of potential MCMs for CBRN, pandemic, and emerging disease agents, the mechanism of action of the countermeasure will need to establish the utility of the animal model as a surrogate for humans.
C.1.2. The USG seeks safe facilities that have current approved Federal, State and/or local licenses/certifications for animal work and where applicable, ensure that the select agent regulations through CDC and/or USDA are followed (42 CFR Part 73, 7 CFR Part 331, and/or 9 CFR Part 121).
The USG seeks to conduct work in accordance with all applicable Federal, state and local laws, codes, ordinances and regulations (or if foreign, equivalent regulatory oversight).
C.1.3. The USG seeks laboratories that have established protocols for routine care and health surveillance for laboratory animals, including on-call veterinary coverage 24 hours per day.
C.1.4. The USG seeks laboratories that can conduct pilot efficacy studies for candidate MCMs using new or existing animal models or tests (see C.1.1.) to establish the pathophysiology/natural history of threat agents in appropriate animal species.
C.1.5. The USG seeks laboratories that can perform efficacy evaluations in various species on candidate compounds (e.g., drugs and biologics) as specified in the Task Order Statement of Work, to permit further product development including, but not limited to, the assessment and optimization of the formulation, route of administration, effective dose level, dose schedule, therapeutic index (i.e. the ratio of the drug/biologic’s adverse event plasma concentration over the plasma concentration sufficient for efficacy), and timing of administration (pre-exposure, post-exposure, delayed administration).
C.1.6. The USG seeks laboratories that can provide microbiological support for the pathogens(s) specified in the Task Order Statement of Work, including quality-controlled master and working banks; SOPs for production and characterization of challenge material under standardized media and growth conditions, and master and working banks for cell lines where applicable. The USG seeks laboratories that can develop and/or provide acceptance criteria for the use of challenge material in animal model studies.
C.1.7. The USG seeks laboratories that can provide analytical support to monitor the progression of disease in animal models and demonstrate prospective correlates of protection (e.g., clinical laboratory capabilities and adoption of novel biomarker testing).
C.1.8. The USG seeks laboratories that have adequate statistical and pharmacokinetics support to analyze and predict experimental hypotheses for models, including pharmacokinetic modeling (both individual animal and population approaches using compartmental and non-compartmental methods).
C.1.9. The USG seeks laboratories with the capability of controlled exposure of various animal species to chemical threat agents in order to develop models to evaluate the efficacy of potential countermeasures to nerve agents, vesicants, cyanide, pulmonary agents and toxic industrial chemicals (TICs) by inhalation, ingestion and topical routes.
C.1.10. The USG seeks laboratories with the capability to perform radiation exposure studies using Cs-137, Co-60, LINAC, X-ray or other accepted instrumentation for controlled exposures of animals to lethal-ionizing radiation within the constraint of acceptable dose rates (predominant need is ionizing radiation dose rates within 50 – 400 cGy/min), with uniform field flux and field sizes for large and small animals (e.g. minipigs ~90 kg and mice ~25 gm).
C.1.11. In all cases described above, the USG seeks laboratories with the capability to perform these procedures and studies in animal models of human at-risk and special populations (e.g., pediatric, geriatric, pregnancy, etc).
C.2. Program, Personnel and Risk Management
C.2.1. The USG seeks laboratories that can provide and implement plans for the overall management, integration and coordination of all contract activities, timelines, and task-linked budgets including the management and coordination of activities carried out under subcontracts. The Offeror(s) shall develop a risk mitigation plan highlighting potential problems and/or issues that may arise during each task order, their impact on cost, performance and timelines, and appropriate remediation plans.
C.2.2. The USG seeks laboratories that can develop a quality control (QC)/quality assurance (QA) monitoring plan that shall ensure appropriate storage conditions of the select/test CBRN, pandemic, and emerging disease agent(s) to be tested as well as the appropriate storage conditions and documentation regarding the handling and security for the candidate products (drugs/biologics) being tested for efficacy. The QC/QA program and staff shall also demonstrate responsibility for care and use of animals as described in C.1.
C.2.3. The USG seeks laboratories or organizations that can provide and maintain a database management system using a software application approved by the Contracting Officer Technical Representative/Contracting Officer (COTR/CO). The database must support all data types, protocols, and experimental results generated by, or related to, the requirements of the contract. The database shall provide the capability to conduct queries and analyses, export data and in a variety of formats, disseminate data, and submit experimental data to the COTR/CO. The database should include an electronic inventory of all products (bioassay reagents, drug/biologic inventories, etc), pathogens, chemical agents, radionuclides, specimens, materials, and reagents received, produced, stored, and shipped that has compound identifiers, amounts available, storage locations, shipping data and other biological and chemical characteristics of the compound(s).
C.2.4. The Offerors shall define confidential data/information and how it will be extracted in a format compatible with programs for publication in technical journals and/or shared in government determined systems.
C.2.5. Successful Offerors must provide a laboratory that can submit evidence of an effective Regulatory and Quality Management System (QMS) (21 CFR Part 58). Offeror(s) shall ensure that the details in the submitted proposal incorporate: 1) QMS in all aspects of the proposal to fulfill the proposal objectives; 2) a copy of a Quality Plan; 3) a quality reporting structure; 4) an FDA inspection history that provides all observations listed on the FDA Form-483 and associated corrective actions; 5) a regulatory platform that can comply with the evolving regulatory environment regarding requirements for animal research and the FDA regulatory guideline for animal studies in support of approval/ or licensure, such as, 21 CFR Part 58, “Good Laboratory Practice (GLP) for Nonclinical Laboratory Studies,” and 21 CFR Parts 314 and 601 and subparts, “New Drug and Biological Drug Products: Evidence Needed to Demonstrate Effectiveness of medical countermeasures under New Drugs when Human Efficacy Studies Are Not Ethical or Feasible. (i.e., the Animal Rule).
C.2.6. The Offeror(s) shall propose an integrated management plan for the animal model development program including key subcontractors. Management of personnel should include, but is not limited to, providing a list of key individuals and their qualifications to carry out the work detailed in the
SOO.
C.3. INVENTION REPORTING REQUIREMENT
All reports and documentation required by [FAR Clause 52.227-11, Patent Rights-Ownership by the Contractor/FAR Clause 52.227-13, Patent Rights-Ownership by the Government] including, but not limited to, the invention disclosure report, the confirmatory license, and the Government support certification, shall be directed to the Division of Extramural Inventions and Technology Resources (DEITR), OPERA, OER, NIH, 6705Rockledge Drive, Suite 310, MSC 7980, Bethesda, Maryland 20892- 7980 (Telephone: 301-435-1986).
