Contract award by City Council, unless specified otherwise herein. Attempting to influence the outcome of any given Contract before a recommendation of award to the City Council is strictly prohibited. The Director of Procurement will review alleged violations of this prohibition. If the Director of Procurement determines that such a communication has compromised the competitive process, the Proposal submitted by that Proposer may be disqualified from consideration for award, and that Proposer may, among other things, be placed on the ineligible source list. Violations of this prohibition may also be subject to prosecution under federal, state, or local laws. City of South Fulton employees, officials, and their family members are prohibited from seeking, requesting, or receiving any material payment, gift, job offer, security, promise of future benefit, or any other tangible or intangible thing of value when such receipt has the potential to influence a procurement decision or to gain unfair advantage in a procurement competition, and as outlined in Sec.

12. Ownership of Proposals: Each Proposal submitted to the City will become the property of the City, without compensation to a Proposer, for the City’s use, in its discretion. The City shall not be liable for any Proposal preparation costs incurred by Proposers.

16.2 Each Proposer shall promptly notify the City in writing should the Proposer find discrepancies, errors, ambiguities, or omissions in the solicitation documents, or should their intent or meaning appear unclear or ambiguous, or should any other question arise relative to the RFP. Replies to such notices may be made in the form of an Addendum to the RFP, which will be issued simultaneously to all potential Proposers. No oral responses are binding on the City.

16.3 The City may in accordance with applicable law, by Addendum, modify any provision or part of the RFP at any time prior to the Proposal due date and time.

16.4 Each Proposer must confirm that all Addenda have been received and acknowledge receipt by executing the Acknowledgment of Addenda form provided with each Addendum.

16.5 The City may waive any technicalities and formalities in this solicitation. Additionally, the City reserves the right to cancel the RFP in its entirety.

16.7 The City of South Fulton may disqualify Proposals as a result of, but not necessarily limited to, the following reasons:

16.7.14 A Proposal may be rejected where the City determines, based on substantial evidence and applicable law, that the Proposer is not responsible due to material adverse performance history, fraud, misrepresentation, debarment, suspension, unresolved tax or licensing deficiencies, or other grounds bearing directly on the

Proposer’s present ability to perform the Contract.

17. Award and Execution of Contract: If a Contract is awarded as a result of this solicitation, the City will issue a written agreement incorporating the terms of this RFP and successful

Proposer’s response. The Proposer shall execute the agreement within the time specified by the City. The City reserves the right to modify the Contract to incorporate the Proposer’s

The competitive range will consist of Proposals that the Evaluation Committee determines have a reasonable chance of being selected for award. The City also reserves the right to request presentations or interviews from one or more Proposers for the purpose of clarifying Proposals or demonstrating service capabilities. The City may make an award based solely on written

Proposals without conducting presentations or interviews.

Interviews will not be separately scored unless an interview criterion and weight are issued in the

RFP or by Addendum before the Proposal Submission Deadline. Interview responses may clarify, but may not materially revise, a Proposal except through an authorized BAFO process.

If the City elects to request BAFO:

4.1.1 Proposers will be provided written notice identifying any revisions requested, including but not limited to pricing, service levels, or clarifications.

4.1.2 BAFO submissions shall be submitted by the date and time specified in the City’s request.

4.1.3 After receipt of BAFOs the City may seek written clarification but will not permit material revisions to Proposals.

4.1.4 BAFOs shall be evaluated based on the criteria set forth in this RFP.

Award, if made, shall be made to the responsive and responsible Proposer whose Proposal, as modified by its BAFO (if requested), is determined to be most advantageous to the City. The

City reserves the right to make an award without requesting BAFOs.

The EC may provide a list of subject matter for discussion. The individuals/firms will have equal time to present but the question-and-answer time may vary. Proposers/Providers may be requested to demonstrate the nature of their offered solution to the EC. After receipt of submittals, all firms will receive a description of and arrangements for the desired demonstration.

Any presentation or demonstration materials shall be submitted electronically in the format and by the deadline stated in the City’s interview notice.

PROPOSAL EVALUATION – SELECTION CRITERIA

The City shall evaluate responsive Proposals submitted by responsible Proposers in accordance with the evaluation criteria, relative weights, and scoring methodology expressly established in this RFP. The Evaluation Committee shall evaluate each Proposal independently and shall base its evaluation solely upon the contents of the Proposal, the requirements of this RFP, and any clarification, interview, presentation, Best and Final

Offer, or other information properly obtained and considered in accordance with this RFP.

No Proposer shall receive consideration, credit, preference, or scoring based upon any criterion, factor, information, or methodology not expressly authorized by this RFP. The

City reserves the right to seek clarification of Proposal content; provided, however, that clarification shall not be used to permit a Proposer to cure a material deficiency, materially alter its Proposal, or obtain an unfair competitive advantage.

Each Evaluation Committee member shall independently evaluate and score each qualitative criterion using the five-point rating scale established below. Evaluators shall exercise independent professional judgment and shall document the basis for each assigned rating in sufficient detail to support the procurement record and the resulting award recommendation.

TECHNICAL EVALUATION RATING SCALE

Each Evaluation Committee member shall assign a whole number rating from one (1) through five (5) to each qualitative evaluation criterion. Fractional ratings, including half-point ratings, shall not be permitted.

Rating 5, Exceptional. The Proposal substantially exceeds the requirements of the RFP for the criterion being evaluated. The Proposal demonstrates exceptional qualifications, experience, technical capability, understanding, methodology, resources, or other relevant strengths, as applicable. The

Proposal presents minimal performance risk and contains significant documented strengths that provide material benefit to the City.

Rating 4, Very Good. The Proposal exceeds the requirements of the RFP in meaningful respects for the criterion being evaluated. The Proposal demonstrates strong qualifications, capability, understanding, experience, or methodology and contains identifiable strengths that are reasonably expected to benefit successful contract performance. Performance risk is low.

Rating 3, Acceptable. The Proposal meets the material requirements of the RFP for the criterion being evaluated. The Proposal demonstrates adequate qualifications, capability, understanding, experience, and resources necessary to perform the Work. Any identified weaknesses are minor and do not materially impair the Proposer’s ability to successfully perform the Contract. Performance risk is acceptable.

Rating 2, Marginal. The Proposal partially meets the requirements of the RFP for the criterion being evaluated but contains one or more weaknesses, omissions, insufficiently supported representations, or areas of concern that increase performance risk. The Proposal does not demonstrate the same level of confidence as an Acceptable Proposal.

Rating 1, Unacceptable. The Proposal fails to adequately satisfy the requirements of the RFP for the criterion being evaluated, contains significant weaknesses or deficiencies, or fails to demonstrate the qualifications, capability, experience, understanding, resources, or methodology necessary for successful performance. Performance risk is unacceptable.

CONVERSION OF RATINGS TO WEIGHTED POINTS

The numerical rating assigned to each qualitative evaluation criterion shall be converted to weighted points using the following formula:

Weighted Points = (Evaluator Rating ÷ 5) × Maximum Points Available for the Criterion

The resulting weighted score may be calculated to two decimal places. The maximum weighted points awarded for a criterion shall not exceed the maximum points established for that criterion.

The City shall evaluate Proposals solely in accordance with the criteria and relative weights stated in this RFP. No unstated criteria shall be used. Any local preference or small business preference shall be applied only to the extent authorized by law and expressly stated in this solicitation.

Local Proposer Preference. For purposes of this solicitation, a “Local Proposer” means a Proposer that, as of the Proposal Submission Deadline, maintains a bona fide physical business location within the corporate limits of the City of South Fulton and is in good standing to conduct business in the

State of Georgia. To receive Local Proposer Preference points, the Proposer shall submit documentary evidence with its Proposal establishing such location, which may include a current business license, lease, deed, utility statement, occupational tax certificate, or other evidence acceptable to the City. Post deadline establishment of a local office shall not qualify for preference points. Preference points shall be applied only to the extent authorized by applicable law and city policy.

The City reserves the right to negotiate pricing and other contract terms with the highest-ranked Proposer, or as otherwise permitted by this RFP and applicable law, when determined to be in the best interest of the City.

COST PROPOSAL EVALUATION, MAXIMUM 25 POINTS

Price Score = (Lowest Evaluated Proposal Price ÷ Proposer’s Evaluated Proposal Price) × 25

The Proposer with the lowest Evaluated Proposal Price shall receive the maximum twenty-five (25)

Cost Proposal points. All other eligible Proposers shall receive proportionately fewer points calculated using the formula above.

For purposes of price evaluation, “Evaluated Proposal Price” means the price or combination of Base

Rating Qualifications 30 Approach 20 Past Performance 20

Proposal and Alternate pricing expressly identified by the City for evaluation under this RFP. The

City shall apply the same price evaluation methodology to all Proposers.

MINIMUM TECHNICAL QUALIFICATION THRESHOLD

To remain eligible for Cost Proposal evaluation and award consideration, a Proposer must receive an aggregate technical score of at least forty two (42) points out of the seventy (70) technical points available. This threshold represents the minimum technical qualification standard established by the

City.

A Proposer failing to achieve the minimum technical qualification threshold shall not advance to Cost

Proposal evaluation and shall not be eligible for award, regardless of proposed price.

Meeting the minimum technical qualification threshold does not entitle a Proposer to award and does not constitute a determination that the Proposal is the most advantageous to the City.

EVALUATOR SCORING AND DOCUMENTATION

Each evaluator shall independently review and score each Proposal before any Evaluation Committee consensus discussion, if such discussion is conducted. Evaluators shall not coordinate individual scores for the purpose of producing a predetermined ranking or outcome.

Each evaluator shall provide written comments sufficient to identify the material strengths, weaknesses, deficiencies, risks, or other Proposal characteristics supporting the rating assigned to each qualitative criterion. A numerical score without supporting evaluation comments may be returned by Procurement to the evaluator for completion of the evaluation record.

Evaluation comments shall relate directly to the requirements and evaluation criteria stated in this

RFP. Evaluators shall not consider personal familiarity with a Proposer, information outside the authorized evaluation record, or criteria not stated in this RFP.

Procurement may review evaluation forms for completeness, mathematical accuracy, consistency with the stated evaluation methodology, and compliance with the solicitation. Procurement shall not direct an evaluator to increase or decrease a substantive evaluation rating. Any correction or revision made by an evaluator shall be documented in the procurement record.

For evaluation purposes, the Evaluated Price shall equal the Total Base Proposal plus Alternate Nos.

_1__ , _2__ and _3__. The City may award the Base Proposal and any combination of alternates in accordance with available funding and the award methodology stated in this RFP.

APPENDIX A

SCOPE OF

SERVICES

APPENDIX A SCOPE OF SERVICES

1. SCOPE OF WORK

GENERAL: Tennis Court Rehabilitation and Reconstruction Project

The Proposer shall provide all labor, materials, equipment, supervision, permits, and incidentals necessary to rehabilitate and reconstruct four (4) existing clay tennis courts (Har-Tru or equivalent) located within the South Fulton Tennis Center. The successful Proposer shall be responsible for restoring the existing tennis courts to like-new condition by correcting existing drainage and grading deficiencies, improving court playability and safety, and completing all Work in accordance with the requirements of this RFP. All services shall be performed in compliance with applicable United States Tennis Association (USTA) standards, American Sports Builders Association (ASBA) standards, municipal construction requirements, and all other applicable federal, state, and local codes and regulations.

Contract Time and Scheduling Requirements

The Contractor shall achieve Substantial Completion within sixty 60___ consecutive calendar days after the effective date of the Notice to Proceed and Final Completion within forty-five _45__ consecutive calendar days after Substantial Completion.

The City anticipates issuance of the Notice to Proceed on or about 10 calendar days after contract execution, subject to receipt and approval of required bonds and insurance, permitting, submittals and satisfaction of all other conditions precedent to commencement of the Work. No onsite work may begin before the written Notice to Proceed.

The Contractor shall plan and prosecute the Work in accordance with the following project-specific scheduling requirements:

1. Court Closures: The four clay courts included in the conversion may remain closed throughout construction. The contractor shall maintain secure temporary fencing and prevent public access to the construction area. Adjacent hard courts, sidewalks, parking areas, and park facilities shall remain open unless a temporary closure is approved in advance by the City. Any approved closure must be coordinated with the City at least five (5) business days in advance. The contractor shall always preserve safe public access and emergency access.

2. Seasonal Coating Restrictions: Acrylic surfacing and coating Work shall be performed only within the temperature, moisture, weather, and application conditions required by the Contract Documents and applicable manufacturer's requirements. Court paving, surfacing, and coating work shall comply with the coating-system manufacturer’s written requirements. Unless the manufacturer requires more restrictive conditions, coatings shall not be applied when the ambient or surface temperature is below 50°F, when temperatures are falling toward that threshold, when the surface is wet, or when rain, freezing conditions, or excessive moisture are forecast during the required curing period.

3. Weather Assumptions: The contractor shall include reasonably anticipated seasonal rain and normal adverse weather in its baseline schedule. Weather delays will be considered only when conditions are unusually severe for the location and season, prevent critical-path work, and are supported by daily reports, site photographs, and recognized weather data. Rain occurring during periods when the contractor was not otherwise prepared to perform the affected work will not justify an extension.

4. Cure Periods: All cure periods shall comply with the approved mix design and manufacturer’s written requirements. Unless otherwise approved:

• Structural concrete shall be allowed to achieve its required design strength, with a nominal 28-day curing period.

• Concrete shall not be subjected to construction loading until adequate strength has been documented.

• Asphalt pavement shall cure for at least fourteen (14) days, or longer when required by the coating manufacturer, before acrylic surfacing is applied.

• Each coating layer shall be fully cured before the next application, generally a minimum of 24 hours, subject to weather and manufacturer requirements.

• Tennis courts shall remain closed until the complete surfacing system has cured and the manufacturer authorizes use.

5. Allowable Work Hours: Normal construction hours shall be 7:00 a.m. to 7:00 p.m., Monday through Friday, and 8:00 a.m. to 5:00 p.m. on Saturday. Work on Sundays, City-observed holidays, or outside these hours requires prior written City approval.

Applicable noise ordinances and park operating requirements remain in effect.

6. Project Milestones: The contractor’s baseline schedule shall incorporate, at minimum, the following milestones:

• Preconstruction meeting and required submittals: within 10 calendar days after

Notice to Proceed.

• Mobilization, site controls, and demolition: within the first 15 calendar days.

• Subgrade, drainage, base, curb, and utility coordination: substantially complete by Day 35.

• Paving and required pavement curing: complete in sufficient time to support final surfacing.

• Coatings, fencing, accessories, restoration, testing, and inspections: complete by

Day 55.

• Substantial Completion: no later than Day 60.

• Final Completion and closeout: no later than 45 calendar days after Substantial

Completion.

The contractor shall submit a detailed baseline schedule for City approval and provide schedule updates throughout construction.

7. Excusable Delays: The contractor shall provide initial written notice of a potential delay within seven (7) calendar days after the event becomes known, followed by a fully documented claim within the time required by AIA Document A201–2017.
