About this file
This document is Amendment 0002 to the Request for Proposals (RFP) for Contract No. 15DDHQ24R00000016, issued by the Drug Enforcement Administration (DEA) for toxicology testing services. The amendment provides the government's responses to questions received regarding the RFP. Key details include:
The RFP is for a contract to provide analytical testing services for biological samples related to drug overdoses. The contract will have an estimated 1,000 samples per year. The RFP requires the contractor to have an active DEA registration, be SAM certified, and provide a risk mitigation plan that may be evaluated under the Management Plan subfactor. The government confirmed that prorated machine time use and maintenance can be included in the cost of analysis, as the required equipment has already been procured by the offeror. Pricing is to be provided as a single loaded rate per Contract Line Item Number, with discount levels based on sample quantities ordered per call order.

Q&A RESPONSE
No. Page, Section, Paragraph number, and/or Attachment Comment Question DEA Response/Answer 1 page 8, section 2.1 (7) Our lab has applied for registration almost a year ago and still have not heard back.
Is pending registration with the DEA at the time of bid submital acceptable?
No. Offeror must be SAM certified.
2 pricing sheet template This work can be very difficult to price as unit cost. Certain samples may involve more prep or instrument time to best report the analyte.
Does the DEA have an existing lab/price they are working with for a similar project? Is a possible range of cost accepltable?
The contractor shall propose a single loaded rate per Contract Line Item Number (CLIN) that includes direct labor, overhead, fringe, general and administrative expenses (G&A), and profit. The contractor shall enter and verify the calculated totals by ordering period, and the grand totals for all ordering periods.
3 On Page 8 under Section 2.1, Item number 5 after the first Paragraph and On Page 21 under SubFactor 2, Item number 3
The risk mitigation plan is mentioned in Section 2.1 as one of the items required of the offerors to respond to the RFP. As written, it seems like this item should be included in Factor I (Technical Capability) on the proposal. In the description of what should be included in the “Management Plan” on page 21, however, the following are mentioned- “…how the Offeror shall overcome the challenges, mitigate the risks and deliver the performance outcomes…”
Can the “Risk Mitigation Plan” be placed in Factor 2 under the “Management Plan” sub-factor?
With the large volume of information already required for Factor 1 (Technical Capability) that needs to be fitted in 15 pages, doesn’t it make sense to put the risk mitigation plan under Factor 2, Sub-Factor 2 (Management Plan)? Under Factor 1 - The Government confirms it will evaluate the Offeror’s technical approach to accomplishing the objectives and/or tasks to be performed including its ability to organize, manage its project personnel, manage task, deliverables and resources, anticipate risks to ensure quality of services provided based on the RFP and reference tasks services required in accordance with the SOW. Under Subfactor 2 - The Government confirms that it will evaluate the contractors "proposed approach for managing unforeseen personnel shortages;
quality control process and how the staffing plan supports managing the quality of services provided; overcoming challenges, mitigating risks and deliver the performance outcomes". Also, be advised per the RFP that in the event of potential conflict of interest the contractor will provide mitigation plan, See Factor 4, FAR Part
9.5 of the RFP.
4 BPA Call Order Attachment Should each ordering period have the pricing proposal for all the pricing categories (six different categories) based on the discounting scheme required by the contract? Or is it only the pricing for 1000 samples that need to be presented in the BPA Call Order?
The pricing is based upon the number of samples ordered at one time by DEA. If DEA orders 600 samples on a call order, the pricing scheme with the appropirate discount would be applied specifically for 600 samples. Similarly, if DEA orders 800 or 1000 samples on a single call order, the corresponding price with the government discount should be clearly stated within their proposal.
5 BPA Call Order Attachment As written, the BPA Call Order only provides one pricing scheme to be applied for each ordering period. However, the pricing varies according to the total number of samples because of the required discounting scheme. This will also impact the total cost at each ordering period because the total cost will depend on the total number of samples that will be applied in the calculation.
Should the offeror present all the pricing scheme for each ordering? period (400, 500, 600, 700, 800, 1000)? This would mean that each ordering period will have at least six different pricing schemes presented. Or is it only the pricing for 1000 samples that needs to be presented?
The contractor should understand that this a Sample BPA Call Order Template. Your actual proposed pricing for the BPA will come from the your proposed cost shown on the Pricing Sheet Template. The offerer should present a pricing scheme for each ordering possibility. NOTE:
Contract is for up to 1000 samples per year, which is expected to be reached for each year. It would be expected that the discount for 1000 samples would be applied.
7 Attachment 1: Pricing Template Spreadsheet Should the pricing for 1000 samples be presented in the template for each ordering period or should we present the pricing for all the six categories of pricing in the template and present them in six different tabs?
NOTE: Contract is for up to 1000 samples per year, which is expected to be reached for each year. It would be expected that the discount for 1000 samples would be applied
8 Attachment 1: Pricing Template Spreadsheet Similar to the comment above, there are six pricing categories each year based on the required discounting scheme.
Which of the pricing categories should be presented in the template? Only for 1000 samples?
Or for six different pricing categories to be presented in six different tabs? See answers above
9 On Page 4 of the RFP, Section 1 (Schedule of Services), first paragraph first paragraph, the following was written, "These funds will not be used for analytical equipment needed to analyze the biological sample..."
Our organization has already completed the purchase of the machine we will be using to accomplish the task required by the RFP. However, our organization requires payment for machine time use to run the samples and maintenance of the machine. This fee is charged to all users of the machine and prorated according to the amount of usage time by each user. The fee ensures that the laboratory has funds to keep instrumental capabilities that can support developments in drug testing and analysis as well as maintain minimal interruptions in instrument performance.
Again, the machine that will be used for the analysis has already been procured.
Will the RFP allow inclusion of prorated machine time use and maintenance in the cost of analysis?
Yes, this is approporiate to include machine time use and maintenence in the cost of analysis. The machine was noted to already be purchased.
