34. LOCAL REQUIREMENTS

The selected project(s) shall comply with the following requirements and regulations:

A. Repayment - Any housing assisted with AHTF funds which does not meet the affordability requirements for the specific period of time agreed upon, shall repay funds extended to the development.

B. Monitoring and Compliance - Participating entities shall be monitored for compliance with AHTF requirements. Program compliance shall be assessed through annual reports for compliance with program requirements and on-site reviews. The owner/management company shall maintain a rent roll of all tenants residing in each unit on an annual basis through the end of the compliance period.

C. Fair Housing Requirements - Participants in the AHTF program shall be required to use fair housing practices in soliciting tenants, determining eligibility and concluding all transactions.

Each participating entity shall affirmatively further fair housing according to the

Fair Housing Act and applicable Orange County requirements. An owner advertising vacant units shall include the equal opportunity logo or statement on the application and lease. Media advertising may include newspapers, radio, television, brochures, leaflets, web based marketing, direct mail, or may involve a sign on the property. The owner may wish to use community organizations, places of worship, employment centers, fair housing groups, housing counseling agencies, social service centers or medical centers as resources for this outreach.

Outreach efforts on the part of the owner shall also be evaluated by reviewing marketing efforts. This assessment shall be made during the rent-up and marketing of the units by use of compliance certification or personal monitoring visits to the project. The selected applicant shall provide an annual assessment of the affirmative marketing plan of the project.

D. Disbursement of Funds - The County and its servicer shall make periodic inspections of the project throughout the construction period. Funds shall be disbursed on a per draw basis for work in place, after an inspection by the designated servicer. The building(s) shall be inspected again at the completion of construction or rehabilitation. Should the project not be completed, all AHTF funds shall be repaid within thirty (30) days from official notification by the County.

35. MORTGAGE REQUIREMENTS

All program funds shall be secured by a mortgage and promissory note upon the real property constituting the project. Mortgage terms shall include interest only payments during the construction period. After the construction period ends, principle and interest payments shall begin and amortized over a minimum period of 25 years. Any mortgage(s) and note(s) shall be in a form acceptable to the County.

Section 1, General Terms and Conditions | Page 15

Different amortization schedules, including payment schedules based on available cash-flow of the project, may be proposed and/or negotiated with successful applicant(s)

36. PROJECT AGREEMENT

Successful applicant(s) shall have one-hundred and twenty (120) days from the date of

Board approval to execute an Agreement. If the agreement is not executed within one-hundred and twenty (120) from the date of Board approval, then, the County shall have the right to terminate negotiations with that applicant and commence negotiations with the next qualified applicant.

37. COMPREHENSIVE FINANCIAL ASSESSMENT

The County may utilize the services of an agency to conduct a comprehensive financial assessment of each project, coordinate loan closing, and if appropriate, construction management and servicing of loans under this RFP.

38. LOAN COMMITMENT FEE

Successful applicants applying for AHTF loan shall be required to provide a loan commitment fee of up to 1 percent to cover the cost associated with coordinating and conducting the loan closing. Applicants shall pay other costs incurred in procuring and making loans, such as a $2,000 application fee and an additional underwriting fee of $3,000 to Orange County or its agent. An additional underwriting fee of $1,000 will be charged each time a preliminary or final underwriting report needs to be modified. The applicant will be charged by the County or its agent.

39. FEE DISCLOSURE

The developer fee and general contractor fee must be disclosed. In the event the developer fee and/or general contractor fee are/is not disclosed on the Development Cost Pro forma, the County will assume that these fees will be the maximum allowable under this RFP and will add the maximum amount(s) to Total Development Cost. If an applicant lists a developer fee or general contractor fee that exceeds the industry standards, the County will adjust the fee to the maximum allowable.

40. DEVELOPER/CONTRACTOR FEES

Orange County prefers that its funds are used for hard construction costs. Orange County funds may be used toward other costs, which may be negotiated during the drafting of the developer’s agreement.

41. SET ASIDE REQUIREMENTS:

A. In an effort to further Orange County’s Housing for All goals, all developments assisted under this RFP should seek to meet these goals:

• Create new housing units;

• Preserve affordability; and

• Provide financial empowerment and homebuyer education opportunities.

Section 1, General Terms and Conditions | Page 16

B. Each development must construct a minimum of 75 units or more, and set aside a percentage of the total units for eligible low or very low income residents for the duration of the affordability period.

All developments seeking assistance under this RFP should indicate the number and percentage of total units for extremely low (35% AMI), very low (50% AMI) and low income (60% AMI) households. The average income of the project’s tenants must be no greater than 60% AMI. No affordable units shall exceed 80%

AMI.

C. Proposers should consider special targeting and services to reduce housing barriers for extremely low,very low, and low income families and individuals. These housing challenges may include financial hardships from job loss, death in the household, health issues, or other non-controllable events. The County also encourages project owners to take a new approach to the leasing approval process related to criminal background checks.

Orange County believes it is important for project owners to set-aside a certain percent of units for special targeting that reduces or waives requirements such as application fees and considers adjusting other barriers such as minimum income requirements, disqualification due to previous evictions, or criminal record. The amount of units to be set-aside as lower barrier units will be determined by the applicant as outlined under special targeting set-aside.

The project owner shall be required to enter into an agreement with the county for a minimum of 25 years and provide all documentation at the request of the County to confirm the special targeting requirement is being fulfilled as well as the affordable unit set-aside.

Preference will be given to proposals targeting extremely low, very low, and low income families and individuals with special needs (as described below).

Individuals with special needs are defined in 420.0004(13) FL Statutes to include one or more of the following categories:

o An adult person requiring independent living services in order to maintain housing or develop independent living skills and who has a disabling condition as defined in 420.0004(7);

o A young adult formerly in foster care who is eligible for services under s.

409.1451(5);

o A survivor of domestic violence as defined in s. 741.28; or o A person receiving benefits under the Social Security Disability Insurance

(SSDI) program or the Supplemental Security Income (SSI) program or from veterans’ disability benefits.

D. Successful applicants shall provide an appraisal within 120 (one-hundred and twenty) days of the award in a format that is acceptable to Orange County or its agent.
