Certification of Alteration or Erasure A proposal may be rejected if it contains any material alteration or erasures unless, before the proposal is submitted, each such alteration and erasure is initialed by the person signing the proposal. Nothing in this paragraph shall be construed as allowing the proposer to alter or otherwise change the form of the proposal, the conditions of the proposal and/or the solicitation documents.

Addenda to Request for Proposals Any addenda to this Request for Proposals shall be issued by the DISTRICT. All addenda issued shall be made an integral part of the Request for Proposals and shall be made part of the contract agreement.

Written addenda, issued by the DISTRICT prior to the closing of this Request for Proposals, are the only recognized means of changing the Request for Proposal. Addenda will not be mailed, but will be posted to the Oregon Buys system at S-R33119-00010822. Proposers should frequently check the website until closing, i.e. at least weekly until the week of closing and daily during the final week.

Proposals may be withdrawn in writing, on the Proposer’s letterhead, signed by an authorized representative of the Proposer. The written proposal withdrawal shall be made a permanent part of the public proposal file.

Proposals Are Offers The proposal is the Proposer’s offer to enter into a contract which, if the proposal is accepted for award, binds the Proposer to a contract and the terms and conditions contained in the Request for Proposals. A Proposer shall not make the proposal contingent upon the DISTRICT’s acceptance of specifications or contract terms that conflict with or are in addition to those advertised in the Request for Proposals (except as noted in Time for Proposal Acceptance below).

Time for Proposal Acceptance A Proposer may submit a proposal conditioning the time for proposal acceptance contained in the Request for Proposals. The DISTRICT reserves the right to consider a proposal response containing a condition that limits the DISTRICT’S time for proposal acceptance. The DISTRICT may, solely at its option, accept a shorter time for proposal acceptance, even though the Request for Proposals may state a longer period. The DISTRICT reserves the right to either accept or reject the proposal response containing the time condition if the proposal response is otherwise the preferred proposer.

Protest of RFP A Proposer may submit a written protest of anything contained in this RFP and may request change to any provision, specification or contract term contained in this RFP, no later than seven (7) calendar days prior to the date Proposals are due. Each protest and request for change must include the reasons for the protest or request, and any proposed changes to the RFP provisions, specifications or contract terms. The DISTRICT will not consider any protest or request for change that is submitted after the submission deadline. If the protest results in a change to the RFP, the DISTRICT shall issue an addendum following the procedure described under “Addenda to Request for Proposals.”

Protest of Award The DISTRICT will issue a written Notice of Intent (NOI) to Award to all Proposers at least seven (7) days before the award of a contract. A Proposer who claims to have been adversely affected or aggrieved by the selection of the highest ranked Proposer may submit a written protest of the selection to the DISTRICT no later than seven (7) calendar days after the date of the selection notice. A Proposer submitting a protest must claim that the protesting Proposer is the highest ranked Proposer because the Proposals of all higher ranked Proposers failed to meet the requirements of the RFP or because the higher ranked Proposers otherwise are not qualified to perform the services described in the RFP. The DISTRICT will not consider any protest that is submitted after the submission deadline. If the DISTRICT upholds the protest, the DISTRICT may in its sole discretion either award the contract to the successful protestor or cancel the solicitation.

Resident Proposer Proposer shall indicate on the proposal form whether it is a resident proposer. "Resident proposer” is one who has paid both income and unemployment taxes in Oregon for the twelve (12) months preceding the proposal submittal and has a business address in Oregon. Non-resident proposers are subject to the same percentage preference when they bid in Oregon as an "Oregon proposer" would be subject to if it competed for a contract in that proposer’s home state. The DISTRICT will rely on the list maintained by Oregon Department of Administrative Services to determine whether the non-resident proposer’s state gives a preference and the amount of the preference.

Tax Compliance Certification Pursuant to ORS 305.385 (6), successful Proposer shall certify that it is in compliance with Oregon's tax laws. A certification form will be provided to the successful Proposer by the DISTRICT.

Performance Bond The successful Offeror shall be required to furnish a Performance Bond in the total amount (100%) of the awarded Contract, executed in favor of the Wasco County Soil and Water Conservation District, to ensure faithful performance of the Contract and payment for services and goods.

NOTE: WASCO COUNTY SOIL AND WATER CONSERVATION DISTRICT HAS PROVIDED A PERFORMANCE

BOND FORM APPROVED AND REQUIRED TO BE USED FOR THIS RFP.

The Wasco County Soil and Water Conservation District Performance Bond form is ATTACHMENT E.

The apparent successful Offeror shall provide all required bonding to Wasco County Soil and Water Conservation District within seven (7) calendar days of notification of award. Failure to present the required documents within seven (7) calendar days may be grounds for award disqualification.

Project Description Please refer to Attachment C. Fifteenmile Large Wood Restoration Project Description & Design – 2024 for project description & design summary, location information, project implementation details, monitoring, project site information, and objectives.

Special Considerations

Fire Precautions- US Forest Service IFPL will be followed for the duration of the project. Fire restrictions may result in limited hours of equipment operation at the work site, including the use of gasoline powered vehicles and power tools. Fire watches after operational hours may be required as part of the IFPL. Smoking or flaming materials are not allowed on project site or nearby areas with significant fuel loads during fire season. Refer to Attachment D. for more information.

Hazardous Material Containment/Cleanup-The Contractor is required to have a Spill Containment Plan, which will include at a minimum Spill Containment Kit (SCK) on-site during any operation and provide training to employees on how components of the SCK are used. The SCK must be designed for use with petroleum products and must contain, at a minimum, the following items:

1) One bale (8 booms/bale, of 8 inch x 10 foot absorbent booms)

2) One bale (100 pads/bale, of absorbent pads, minimum of 17 inch x 19 inch x ¼ inch pads)

3) One absorbent sweep (minimum of 18 inches x 100 feet x 3/8 inches)

4) Two 30-50 gallon garbage cans

It is suggested that portable equipment be placed in a container to prevent any spill or leakage from contaminating surround soil or surface water.

Protection of Cultural Resources- Comply with all laws governing the preservation of cultural resources. Cultural resources may include, but are not limited to, dwellings, trails, fossils, and artifacts. If cultural resources are encountered during project implementation, immediately halt operations and notify the Wasco SWCD Project Manager.

Site Safety- The contractor is responsible for their employees’ and subcontractors’ safety, as well as compliance with federal, state, and local safety laws. The contractor shall develop their own site safety plan and use daily meetings to help implement their site safety plan. USFS and SWCD staff will be on site to assist in project implementation and keeping the public out of the project area. The project will not require any road closures as the helicopter will not be flying over any open roads. Coordination with a USFS aviation planner is required and will guide communications between the helicopter operator and ground crew.

Compliance with ARBO – The proposed aquatic restoration activities follow specific design criteria using a consistent methodology to design, implement, monitor, and provide documentation as outlined in the Aquatic Restoration Biological Opinion (ARBO). Proper log placement following USFS guidance is critical. USFS staff will be present in the field to coordinate and communicate with the helicopter operator and ground crew.

Acceptance of Work- Acceptance of project work shall be performed by USFS and Wasco County SWCD. Wasco County SWCD will notify the contractor verbally or in writing if deficiencies are found along with corrective actions required in order to accept the work.

PROFESSIONAL SERVICES CONTRACT

Note: The following Exhibits are provided as samples of our standards and are for your reference only.

Actual Exhibit content and wording will reflect the requirements of the project as it is ultimately defined.

EXHIBIT A: SCOPE OF WORK

The purpose of this contract is to secure a complete set of services to accomplish a log delivery and stream/floodplain restoration project. Due to the nature of this project, it will be accomplished by a heavy-lift helicopter capable of lifting 9,000 pounds. The Contractor will provide services to transport and place logs, some with root wads attached, from log deck sites to flagged destinations in and along Fifteenmile Creek which is on National Forest System Lands (Mt. Hood National Forest).

The project requires transport of logs from logs decked in a quarry adjacent to Forest Road 2750 to sites in and along Fifteenmile Creek. Estinations range from 1.5 to 1.8 air miles from the log decks. The log decks are at elevation 2,500 feet above sea level, and the log destination sites are at elevations ranging from 1,850 – 1,900 feet above sea level. Log weights for the majority of logs are 7,000 pounds and less;

the remaining logs, many with rootwads, may need to be bucked to length to meet weight restrictions of less than 9,000 pounds. The approximately300 logs, comprised primarily of grand fir, Douglas fir, and hemlock, have a maximum length of 45 feet and range from 16”–40” dbh. About 100 of the 300 logs have root wads. All of the logs are well cured, having been cut and decked for over three years.

The quarry where the logs are decked is large enough to accommodate a helicopter refueling and maintenance area. Alternatively, there is an additional quarry that is less than ¼ mile from the log deck site that can be used as a refueling area. Access roads to log deck sites and refueling areas are paved or graveled and are accessible by truck. The log placement sites in Fifiteenmile are not accessible by vehicle and require hiking along an existing trail the runs parallel to the stream for the length of the project. It takes approximately 15 minutes to hike to the first log placement site and approximately 45 minutes to hike to the last log placement site. US Forest Service and the SWCD staff will be on site to assist in project implementation and keeping the public out of the project reach. The project will not require any road closures as the helicopter will not be flying over any open roads

Emergency medical services are available in the City of the Dalles which is located about 50 minutes from the quarry/staging area.

The Contractor shall develop a plan of operation to accomplish the project and to adhere to the specifications described in Attachment C, and shall organize and direct all the equipment and personnel needed to fully accomplish the work. The Contractor shall furnish all technical expertise, labor, equipment, supervision, transportation, operating supplies, and incidentals necessary to complete the work required. SWCD employees will not assist in ground support activities, but will be on site to direct and support proper log placement. The Contractor will abide by all local laws and regulations, including Federal Aviation Regulations (FARs).

Complete project details are outlined in Attachment C.

Bid Items

1.1 Placement of large wood

Work Schedule All work will be performed between the issuance of the notice to proceed (anticipated August 12th, 2024) and October 30, 2024

Specifications

Item 1. The Contractor shall deliver and place about 300 logs to the Fifteenmile Creek and floodplain with the use of a heavy-lift helicopter with a lifting capacity of about 10,000 lbs.

General Specifications

Contractor Obligations

The Contractor shall provide all services, equipment, materials, and personnel unless noted otherwise.

The Contractor is responsible to ensure equipment can transport logs.

The ground supervisor shall be trained to take proper action in an emergency or incident. Government employees will not assist in ground support activities, but the COR and/or inspectors will be on site to direct proper log placement.

The Contractor is responsible for equipment move-in, move-out, and movement of ground equipment and ferry flights as well as transportation for all Contractor-furnished materials between the refueling area, log deck sites, and log destination sites.

The Contractor shall submit to the Contracting Officer an accidental spill response plan and a project safety and incident response plan, including search and rescue plans.

TECHNICAL SPECIFICATIONS

Equipment

Contractor aircraft shall be fully operational and capable of placing material at 1850-2500 feet pressure altitude at temperature ranges between 55-95 degrees Fahrenheit.

Placement and Transport Operations

In-stream and floodplain destinations for log loads will be flagged.

Some logs with root wads attached will be utilized. The calculation of weight for each log or logs will be the responsibility of the Contractor to ensure that load calculations are within external payload limitations. The Contractor may have to reduce the log length or multiple log loads to be within limits.

There will be approximately 85-100 logs that will likely need to be transported as a single log due to their weight or due to the project design requiring exact placement of key heavy logs. Conversely, depending on log placement needs there will be some trips where loads will be less than external payload limits.

There are no anticipated special flight routes designated due to sensitive areas, water sources, and other identified hazards. A refueling area will be selected by the Contractor with Contracting Officer approval. A potential service landing is identified on attached maps. The Contractor shall be responsible for safety precautions, dust abatement measures, and fuel hazardous waste spill response.

Prior to moving onto National Forest land, the Contractor shall ensure that all equipment is free of soil, seeds, vegetative matter, or other debris that could contain or hold invasive plants. The Contractor will contact the Contracting Officer’s Representative or designated inspector prior to moving on to National Forest land for equipment inspection.

QUALITY ASSURANCE SURVEILLANCE PLAN

The SWCD and USFS onsite staff will conduct inspections to determine work quality. Initial inspections will consist of a 100 percent visual inspection and will be based on adherence to contract technical specifications. The SWCD and USFS will inspect placement of large wood during aerial placement.

The following will be collected to determine satisfactory placement:

• Placement of large wood as it corresponds to flagged destinations and/or as directed by USFS or SWCD personnel.

The following will be considered satisfactory placed large wood for determining performance quality:

• Helicopter placed large wood is within 50 feet of flag location and aligned with flag direction (if flagging is present), unless otherwise directed by USFS or CTWS personnel.

Re-inspection upon Contractor Request The SWCD and USFS staff will describe unsatisfactory placed large wood, identified for repositioning or reorientation, following inspection. The Contractor will be expected to reposition or reorient unsatisfactory placed large wood following inspection by SWCD or USFS staff.

Definitions DBH (diameter breast height) - Diameter of the trunk measured at a point 4-1/2 feet above the ground level on the uphill side of tree.

Attachment C. Fifteenmile Large Wood Restoration Project Description & Design – 2024 Project Description and Design Summary The purpose is to restore aquatic habitat as an aid to the recovery of mid-Columbia steelhead, resident trout, and Pacific lamprey. This project has been developed in partnership with the US Forest Service Barlow River Ranger District and the Wasco County Soil and Water Conservation District. Recovery of the aquatic species present in the project area is listed as a priority action within numerous local planning and assessment documents. These documents identify the lack of LWD as a primary factor limiting in the headwaters of Fifteenmile Creek where the project is being implemented.

Ten project areas (sites) have been identified in a 1.9 mile reach of Fifteenmile Creek that extends upstream from the Forest Boundary. There are no roads that can be used to access the project so wood will be flown in by helicopter to each of the 10 locations. 300 trees will be added to the stream channel, side channels, and associated floodplain in the project area resulting in treatment of approximately 0.9 miles of habitat. In general, large wood structures (LWM) will be placed in the main river channel in close proximity to low elevation floodplain areas or remnant side channel entrances to raise streambed elevations and restore or improve stream / floodplain interaction. Smaller large wood structures will also be placed within side, remnant channels, and along the floodplain to increase habitat complexity, further dissipate flood waters and energies, and limit channel avulsion. LWM will be placed into existing wood structures within the stream channel, keyed into existing vegetation in the banks and floodplain and woven together to further increase structure stability and longevity.

The stream habitat above the project reach is comprised of much older, less disturbed riparian forest and exhibits most of the natural process that are missing in the project reach and therefore does not need treatment. The habitat below the reach is on private land owned by the City of Dufur. LWM project have been completed in that section in 1995, and 2011. Logs and logs with root-wads have already been acquired for this project and will be staged upstream of the project at a location suitable for take-off and landing of a heavy-lift helicopter. Logs will be airlifted into the restoration area from that log deck via Vertol or similar aircraft. Implementation will take place during the ODFW in-water work window; July 15 – October 31st.

Location Information Fifteenmile Creek is a perennial Wild and Scenic River that originates near Lookout Mountain in the Mt. Hood National Forest approximately 13 miles to the town of Dufur, OR and eventually empties into the Columbia River just below The Dalles Dam. The project area is located within the Fifteenmile Creek Headwaters HUC-12 sub-watershed (170701050301) in Wasco County on the National Forest.

Project Implementation Details There are no roads that can be used to access the project so wood will be flown in by a heavy-lift helicopter (Vertol or similar aircraft). Logs and logs with rootwads (average of 24 inch dbh with many larger than 30 inch dph) have already been acquired for this project and will be brought from off-site sources and decked in a location where a large helicopter can take off and land.

Multiple log structures and individual logs will be placed within each of the 10 sites with an average of about 30 logs per site (details below). 300 trees will be added to the stream channel, side channels, and associated floodplain in the project area resulting in treatment of approximately 0.9 stream miles. Implementation will take place during the ODFW in-water work window; July 15 - October 31.

Monitoring Habitat surveys were conducted by USFS in 2017 and in 2023 to quantify the physical characteristics of the area. The project restoration reach was found to be deficient in suitable substrate size, pool frequency, and LWD.
