2.1 AUTHORITY AND METHOD

DAS Procurement Services Page 4 of 21

DAS PS is issuing this RFP pursuant to its authority under ORS 279A.050 and OAR 125-246- 0170(2).

DAS PS is using the Competitive Sealed Proposal method, pursuant to ORS 279B.060 and OAR 125-247-0260. DAS PS may use a combination of the methods for Competitive Sealed Proposals, including optional procedures: a) Competitive Range; b) Discussions and Revised Proposals; c) Revised Rounds of Negotiations; d) Negotiations; e) Best and Final Offers; and f) Multistep Sealed Proposals.

2.2 DEFINITION OF TERMS

For the purposes of this RFP, capitalized words are defined in OAR 125-246-0110 or as defined below.

Terminology specific to the OregonBuys system may be found at:

https://www.oregon.gov/das/ORBuys/Documents/RolesAndTermCrosswalk.pdf

“Surplus Property” means personal property, vehicles and titled equipment that is no longer in use by the federal government, state agencies, local governments, or special government bodies.

2.3 OVERVIEW AND PURPOSE

2.3.1 Agency Overview and Background

The Program is established pursuant to ORS 279A.250 through ORS 279A.290, and is an Oregon state government program managed by DAS. Administrative rules governing the Program are set forth in OAR Chapter 125, Divisions 035 (Federal Surplus Property) and 050 (State Surplus Property). The Program locates, acquires, and distributes state and federal surplus property to state and local government agencies and qualified nonprofit organizations.

The Program promotes the efficient use of existing resources. The Program:

• ensures the fair and equitable redistribution of surplus property;

• provides low-cost items for agencies to meet their procurement needs;

• sells agency surplus in an effort to be a good steward of public funds; and

• ensures transparency in the disposal of surplus property.

The property, turned over to or acquired by the Program, is first made available for sale or transfer to all eligible entities within the state. If not acquired by an eligible entity, the surplus property is then made available through a public sales method, including internet auctions or the program’s retail center.

In addition to meeting its procurement needs through acquisition of surplus property, a state agency must also dispose of all surplus property though the Surplus Property program.

2.3.2 Project Overview and Background

Earlier this year, the state of Oregon, Department of Administrative Services (DAS) engaged a consultant to analyze and make recommendations regarding all of DAS operations. This firm has https://www.oregon.gov/das/ORBuys/Documents/RolesAndTermCrosswalk.pdf

DAS Procurement Services Page 5 of 21 recommended that the DAS Surplus Property program, being a DAS program, conduct a cost-benefit analysis to determine whether DAS (as well as the taxpayers of the state of Oregon) would be better served by keeping the current business model of government operation of the Program, or if it would be better served if the Program were operated by an entity of the private sector under contract with the State.

2.3.3 Purpose

The Program seeks a Proposer to perform a cost-benefit evaluation to determine whether operation of the Program should be contracted out to a vendor, and if so, what aspects of the Program should be contracted out in what manner.

Ultimately, the goal of this exercise is to assist DAS to determine if Services provided by the Program should be performed by a service provider or continue to function in its current state.

It is not immediately clear as to whether or not the program could be operated as a private entity, but if it can be, the Agency seeks to identify the advantages and disadvantages of each scenario. Since this program is very nuanced, with many different roles and responsibilities performed by staff, it will be critical to capture these roles to make a fair and balanced comparison. The completion of this exercise will serve to satisfy the request made by DAS management, by recommendation of its hired consultant.

2.4 SCOPE OF WORK

The successful Proposer will perform a cost-benefit evaluation of whether the Program should be contracted out to an outside entity (vendor). The evaluation will consider factors such as:

• cost of DAS maintaining and operating the current Program,

• expected benefits and drawbacks of outsourcing the Program, in part or in whole, to a vendor, and

• the extent to which the evaluation is based on current statutes and administrative rules (See

Section 2.3.1), or assumes revisions to those statutes or administrative rules.

Additionally, the evaluation must include analyzing the appropriate size of the staffing for the Program by determining the amount of time (hours and minutes) taken by staff members and wage cost of such staff members’ time to perform each phase of the surplus process for both federal and state property disposal. The time evaluation will include analysis of the time and cost required to:

• Hire, train, and manage employees’ performance.

• Provide customer service.

• Schedule meetings and manage communication,

• Order supplies and processing invoices

• Clean and screen properties for sale or auction

• Intake property (receiving and cataloguing).

• Verify item received, inspect condition, and assign value.

• List items for online auction or local sale.

• Auction items (as needed).

• Receive payment/complete necessary paperwork/arrange pickup or shipping.

DAS Procurement Services Page 6 of 21

• Provide any other pertinent services.

The selected Proposer will also work closely with Agency to accomplish the following:

• Kickoff meeting & meeting summary for the project.

• Project management and meetings’ including reports.

• Evaluation of Agency surplus property data and reporting.

• Evaluation of Agency spending, revenues, surplus property pricing, and staffing assessment and reporting.

The selected Proposer will prepare a final report including all findings.

Points are the total possible for each section as listed in the table below.

Price points are calculated as stated in the Price Evaluation section.

EXAMPLE:

For evaluation criteria worth 50 Points, Proposer A receives the following scores:

100% from evaluator #1 (50 x 100% = 50 Points)

90% from evaluator #2 (50 x 90% = 45 Points)

95% from evaluator #3 (50 x 95% = 47.5 Points)

The SPC will average the scores for each evaluation criteria (calculated by totaling the Points awarded by each Evaluation Committee member and dividing by the number of members).

EXAMPLE:

50 + 45 + 47.5 = 142.5 Points / 3 = 47.5 out of 50 Points.

Proposer A received 47.5 out 50 Points for this evaluation criterion.

4.11 RANKING OF PROPOSERS

The SPC will determine the total points earned by each Proposal by adding the points for each criterion determined as set forth in Section 4.10 and add the Proposer’s price score as determined in accordance with Section 4.9.3.

After any applicable preference has been applied, the SPC will determine the rank of each Proposal, with the highest score receiving the highest rank, and successive rank order determined by the next highest score.

DAS PS may, in DAS PS’ sole discretion, determine an apparent successful Proposer with no additional rounds of competition. If additional rounds are conducted, DAS PS will rank advancing Proposers at the conclusion of each subsequent round and may determine an apparent successful Proposer at any time during the solicitation process.

NEXT STEP DETERMINATION

At the conclusion of a round of competition, DAS PS may choose to conduct additional round(s) of competition if in the best interest of the State. Additional rounds of competition may consist of, but will not be limited to:

• Interviews

• Presentations/Demonstrations/Additional Submittal Items

• Discussions and submittal of revised Proposals

• Serial or simultaneous negotiations

• Best and Final Offers

4.11.1 Competitive Range Determination

If DAS PS, in its sole discretion, determines that one or more additional rounds of competition is necessary, it may select a Competitive Range to indicate the Proposers that will be invited to participate in a subsequent round. If DAS does decide to establish a Competitive Range, the Competitive Range may include all, or at DAS PS’ sole discretion, some (based primarily on a natural break in the distribution of scores), of the Proposers from a previous round. DAS PS will post a notice in OregonBuys of its Competitive Range Determination and provide details about the process and schedule for the subsequent round.

4.11.2 Competitive Range Protest

Proposers excluded from a round may submit a Written protest of Competitive Range.

Protests must:

• Be emailed to the SPC;

• Reference the OregonBuys bid number ;

• Identify Proposer’s name and contact information;

• Be sent by an authorized representative;

• State the reason for the protest; and

• Be received within 7 calendar days after issuance of the Notice of the Competitive Range

DAS Procurement Services Page 17 of 21 unless a different due date and time is specified in such notice.

DAS PS will address all protests within a reasonable time and will issue a Written decision to the respective Proposer. Protests that do not include the required information may not be considered by DAS PS.

4.12 SCORING AND RANKING OF PROPOSERS FOR SUBSEQUENT ROUNDS

If DAS PS conducts two or more rounds of competition, the SPC will determine the cumulative score for Proposers advancing through all rounds of competition by adding the scores from each completed round. The Proposer with the highest cumulative score will receive the highest final ranking.

SECTION 5: AWARD AND NEGOTIATION

5.1 AWARD NOTIFICATION PROCESS

5.1.1 Award Consideration

DAS PS, if it awards a Contract, will award a Contract to the highest ranking Responsive and Responsible Proposer based upon the scoring methodology and process described in Section 4. DAS PS may enter into a contract for less than the full Scope of Work described in this RFP.

5.1.2 Intent to Award Notice

DAS PS will notify all Proposers in Writing that DAS PS intends to award a Contract to the selected Proposer(s) subject to successful negotiation of any negotiable provisions.

5.2 INTENT TO AWARD PROTEST

5.2.1 Protest Submission

An Affected Proposer shall have 7 calendar days from the date of the Intent to Award notice to file a Written protest.

A Proposer is an Affected Proposer only if the Proposer would be eligible for Contract award in the event the protest was successful and is protesting for one or more of the following reasons as specified in ORS 279B.410:

• All higher ranked Proposals are non-Responsive.

• Agency has failed to conduct an evaluation of Proposals in accordance with the criteria or process described in the RFP.

• Agency abused its discretion in rejecting the protestor’s Proposal as non-Responsive.

• Agency’s evaluation of Proposal or determination of award otherwise violates ORS

Chapter 279B or ORS Chapter 279A.

If DAS PS receives only one Proposal, DAS PS may dispense with the evaluation process and Intent to Award protest period and proceed with Contract Negotiations and award.

5.4 CONTRACT NEGOTIATION

5.4.1 Negotiation

After selection of a successful Proposer, DAS PS may enter into Contract negotiations with the successful Proposer. Proposer shall review the attached Sample Contract and note exceptions.

Proposer must submit those exceptions to DAS PS during the Questions / Requests for Clarification period set forth in Section 1.2. If DAS PS agrees to make any requested changes to the Sample Contract, DAS PS will issue an Amendment to notify Proposers of such changes. Unless DAS PS issues an Amendment modifying any of the terms and conditions, DAS PS intends to enter into a Contract with the successful Proposer substantially in the form set forth in Sample Contract (Attachment A).

Following the selection of the apparent successful Proposer, DAS PS may agree to negotiate changes to the negotiable provisions of the Sample Contract listed below. However, DAS PS is not required to make any changes and many provisions cannot be changed. Proposer is cautioned that the State of Oregon believes modifications to the standard provisions constitute increased risk and increased cost to the State.

Any subsequent negotiated changes are subject to prior approval of the Oregon Department of Justice.

DAS PS is willing to negotiate ONLY the Statement of Work and the following terms and conditions:

• Methods of Payment.

• Term of Contract.

• Pricing.

In the event that the parties have not reached mutually agreeable terms within 30 calendar days, DAS PS, at its discretion, may terminate Negotiations and commence Negotiations with the next highest ranking Proposer.
