COMPLIANCE SERVICES -Northern WASCO PUD Page 3 of 16
1.0 PROJECT BACKGROUND
The Northern Wasco County People's Utility District ("District") operates within the Western
Interconnection and is subject to mandatory NERC Reliability Standards enforced by WECC.
The District is registered as a Distribution Provider, Transmission Owner, and Transmission
Planner, and holds a Coordinated Functional Registration and related service agreements with the Bonneville Power Administration (BPA) covering certain Transmission Operator and
Transmission Planner obligations.
The District's system includes approximately eight substations, two transmission switchyards, small hydro generation below the 20 MVA NERC Category 2 threshold, and interconnected large computational loads. These figures are approximate and will be confirmed at project initiation.
The District has limited internal staff dedicated to NERC compliance. It is seeking a qualified firm to assess its current compliance position, correct what the assessment finds, and provide ongoing compliance support.
2.0 OBJECTIVES
• Confirm which NERC functional registrations the District should hold given its system and its agreements with BPA.
• Determine which Reliability Standards and requirements apply to each registered function.
• Establish a documented allocation of compliance responsibility between the District and
BPA.
• Give the District the working tools to sustain compliance: a reporting calendar, a program manual, and an evidence retention framework.
• Identify compliance gaps and areas of exposure, prioritized by risk, with a scope and price for correcting them.
• Provide ongoing compliance support from the start of the engagement and continuing after the program is established.
3.0 PHASES STRUCTURE AND PRICING APPROACH
The work is organized in three phases:
• Phase 1 - Assessment and Program Development. The base scope, described in Section
4.0.
• Phase 2 - Remediation. Correction of the gaps Phase 1 identifies. The work cannot be known until Phase 1 is complete, so Phase 2 is scoped and priced as a Phase 1 deliverable and authorized by contract amendment.
COMPLIANCE SERVICES -Northern WASCO PUD Page 4 of 16
• Phase 3 - Ongoing Support. Annual compliance services beginning at contract execution and running concurrently with Phases 1 and 2, for an initial term of twenty-four (24) months.
Proposers shall price Phase 1 as a not-to-exceed amount and Phase 3 as an annual fixed price.
Phase 2 shall not be priced; proposers shall instead submit the labor rates that would apply, which shall be binding for the contract term and shall be the sole basis for pricing the Phase 2 proposal. Proposals must cover all three phases.
The District intends to award all three phases to one firm under a single contract and does not intend to solicit Phase 2 separately. The District may decline or reduce Phase 2 if the findings do not warrant the work or if funding is unavailable, and may terminate or decline to renew Phase 3 in accordance with the contract terms.
The District's preferred Phase 1 duration is six (6) months or less from notice to proceed.
4.0 SCOPE OF SERVICES – PHASE 1
The Contractor may propose its own methods, formats, and templates for the deliverables below.
The District has stated the outcome it needs rather than prescribing how to produce it, and welcomes proposals that improve on the approach described here.
4.1 Project Initiation and Data Gathering
Conduct a kickoff meeting and submit a written data request. Review the District's current registrations, single-line diagrams and facility data bearing on BES classification, asset threshold data, the BPA agreements, compliance submittals for the previous three years, and existing internal compliance documentation, evidence, and controls.
4.2 Registration and Standards Applicability
Confirm whether the District's current registrations are complete and accurate. Determine which
Reliability Standards apply to each registered function, documenting at the standard level the basis for standards determined not to apply. For applicable standards, provide a requirement-level determination and a plain-language statement of the District's obligation, noting any applicability contingent on system characteristics or operating conditions. Address CIP applicability and impact classification. Identify pending or proposed standards likely to affect the
District's obligations in the near term.
The District has interconnected large load customers and is specifically concerned with the new and revised Reliability Standards addressing large loads that are anticipated to take effect in the near term. For these standards the Contractor shall describe the anticipated requirements and their expected effective dates, assess how they would apply to the District given its registrations and its existing and prospective large load interconnections, identify the data, procedures, agreements, or system changes the District would need to put in place to comply, and reflect those obligations in the reporting calendar, program manual, and gap assessment as applicable. If
COMPLIANCE SERVICES -Northern WASCO PUD Page 5 of 16 the standards remain unsettled at the time of the analysis, the Contractor shall state what is known, what remains open, and what the District can reasonably do now.
4.3 BPA Shared Responsibility Analysis
Review the Coordinated Functional Registration and related BPA agreements and document, at the requirement level, whether responsibility rests with the District, with BPA, or is shared. Give particular attention to requirements where responsibility is ambiguous or disputed, where coordinated action or data exchange between the parties is necessary, and where obligations may fall to the District by default through gaps in the agreements. Provide a recommended interpretation and rationale for each ambiguous item. The District will provide BPA contacts and facilitate introductions; the Contractor shall coordinate with BPA as needed.
4.3 Annual Compliance Reporting Calendar
Produce a calendar of all periodic filings, data submittals, self-certifications, Section 1600 requests, and other time-sensitive actions. Each entry shall identify the driving requirement, what must be submitted, the deadline, the recipient and submittal method, the responsible party consistent with Section 4.3, and any required internal review. The calendar shall be in a format
District staff can maintain and update.
4.4 NERC Compliance Program Manual
Produce a manual sized for a utility with limited dedicated compliance staff. At a minimum it shall address program governance and roles, monitoring of standards changes and effective dates, internal review and self-assessment, evidence generation and retention, self-reporting and mitigation under the Compliance Monitoring and Enforcement Program (CMEP), coordination with BPA, response to WECC audits and spot checks, and periodic update of the manual itself.
4.5 Evidence Retention Index
Produce an index organized by applicable standard and requirement identifying the records the
District should retain, retention periods consistent with NERC rules, and storage and naming conventions compatible with a District-hosted repository.
4.6 Findings and Phase 2 Proposal
Produce a written gap assessment covering all findings from the tasks above, prioritized by risk, with recommended corrective actions and an indication of which gaps may warrant a self-report to WECC. Submit with it a Phase 2 scope of work and not-to-exceed fee proposal, priced at the contract labor rates and itemized by gap or work package so the District may elect all, part, or none of the work, and identifying any District staff effort, field work, or equipment changes required. Present the findings and the proposed Phase 2 scope to District management and staff.
COMPLIANCE SERVICES -Northern WASCO PUD Page 6 of 16
5.0 SCOPE OF SERVICES – PHASE 2
Correct the deficiencies identified in Phase 1 by creating or updating compliance procedures, policies, manuals, internal controls, and evidence, in accordance with the scope accepted by the
District under Section 4.7. Nothing in this Scope of Work obligates the District to proceed with
Phase 2.
6.0 SCOPE OF SERVICES – PHASE 3
Beginning at contract execution and running concurrently with Phases 1 and 2, the Contractor shall serve as the District's ongoing NERC compliance advisor. The District's compliance obligations continue during the assessment, and the Contractor is expected to cover them from the outset. At a minimum this includes maintaining the compliance calendar and program documentation; preparing responses to NERC and WECC data requests, Section 1600 requests, and self-certifications for District review and authorization; monitoring regulatory developments and advising on the impact of new or revised standards; conducting an annual internal compliance review and evaluation of internal controls; maintaining the evidence repository;
serving as a designated compliance contact of record with WECC and NERC, ensuring that correspondence, notifications, and alerts are received, tracked, and answered promptly;
supporting audits and spot checks; and providing subject matter expertise as the District's facilities, controls, and staff change.
Proposers shall state which of the above are included in the annual fixed price and which would be billed hourly. Work priced under Phase 1 or Phase 2 shall not also be billed under Phase 3.
Because the Phase 1 gap assessment serves as the first internal compliance review, that review shall not be repeated in the first year of Phase 3, and regulatory monitoring performed under
Section 4.2 shall not be separately charged. Proposers shall price the first year of Phase 3 accordingly and may propose a reduced first-year fee. Proposers may propose additional services, including staff training, priced separately.
Self-reports, mitigation plan development and submittal, enforcement proceedings, and technical engineering studies (PRC, MOD, FAC and similar) are excluded and shall be scoped separately if requested.
The District will designate the Contractor as a compliance contact of record with WECC and
NERC and expects the Contractor to manage day-to-day compliance correspondence on the
District's behalf. The District nonetheless remains the registered entity and retains responsibility for its compliance. Submittals, certifications, and formal responses require District authorization before filing.

All deliverables shall be provided in editable Microsoft Word or Excel and in PDF, and are subject to one round of District review and comment prior to finalization.
1. Registration Analysis Memo (Section 4.1-4.2)
