This Request for Proposal (RFP) is issued by the State of Colorado Department of Personnel & Administration, Division of Finance and Procurement, State Purchasing Office, on behalf of the Office of State Planning and Budgeting (OSPB), to procure Third Party Analyst services for economic and financial evaluation of Regional Tourism Act (RTA) applications. The State seeks a qualified contractor with expertise in economic and financial analysis to evaluate proposed regional tourism projects, perform comprehensive fiscal impact analyses, and deliver written reports with executive summaries and recommendations. The anticipated scope includes analysis of approximately 6 to 10 initial regional tourism project applications, with each evaluation requiring two face-to-face meetings with applicants, competitive market analysis, economic impact modeling, and state fiscal impact assessment. Contractors must submit proposals by October 3, 2014, at 1:00 PM Mountain Time, with public opening scheduled for 2:00 PM the same day. The contract will be effective upon execution and terminate on June 30, 2015, with no renewal options. The State reserves the right to award to a single contractor or multiple contractors based on the best interests of the State. Oral presentations may be held at the State's discretion. Contractors must be registered with Colorado Vendor Self-Service (VSS) by the closing deadline to be eligible for award.

Pricing for services shall be submitted as a fixed price per Economic and Financial Analysis Report for a single regional tourism project evaluation, with an additional fixed price for re-analysis of revised applications if required. The price must remain constant regardless of the number of applications reviewed. Proposals are valid and pricing is held for the first 12 months of any resulting award, with all delivery costs included in the quoted price. No budget ceiling is established for this project. Contractors must demonstrate minimum two years of experience within the past six years in general economic or financial analysis, with preferred experience in general public economic analysis, general public fiscal analysis, and state and local tax policies. The evaluation will prioritize technical proposal quality, contractor qualifications and experience, cost effectiveness, and compliance with contract terms. The State expects payment within net 30 days of satisfactory completion of deliverables. All materials and reports developed by the contractor become property of the State and cannot be released without written approval from OSPB management.

Section 2 – Background and Overview

2.1 Background.

The Regional Tourism Act was enacted in 2009 by the passing of Senate Bill 09-173. It was amended in 2014 by the passing of House Bill 14-1350. The following program information summarizes the purpose and process of the Regional Tourism Act.

Purpose The Regional Tourism Act creates a mechanism for a local government to undertake a regional tourism project to attract out-of-state visitors, to create a regional tourism zone in which the project will be built, and to create a regional tourism authority (or to designate other financing entities) with the power to receive and utilize the increment of revenues derived from the state sales tax collected in the zone, that is above a designated base amount, to be used to finance eligible improvements to the project.

The State’s Role The Colorado Office of Economic Development and International Trade (OEDIT) provides administrative support for the Colorado Economic Development Commission (EDC). The EDC has oversight authority for this program. A local community should work with OEDIT to determine application requirements and deadlines to submit completed applications for review by OEDIT. The Business Funding and Incentives Staff will facilitate the application review process, application presentation with structuring recommendations to the EDC, resolution drafting and project monitoring.

Requirements

· The EDC shall not approve any project that would likely create an annual state sales tax revenue dedication of more than $50 million to all regional tourism projects.

· The EDC cannot initially approve more than two projects. Once the EDC approves two initial projects, the EDC may approve two additional projects during the next calendar year. Once the EDC approves two additional projects, the EDC may approve two additional projects during the following calendar year.

· The EDC will:

· Review applications forwarded with OEDIT recommendations and may approve or reject the project based on a demonstration that the following criteria are materially met:

· The project is of an extraordinary/unique nature and is reasonably anticipated to contribute significantly to economic development and tourism in the state and communities where the project is located.

· The project is reasonably anticipated to result in a substantial increase in out-of-state tourism.

· A significant portion of sales tax revenue generated by the project is reasonably anticipated to be attributable to transactions with nonresidents of the zone.

· The local government has provided reliable economic data demonstrating that in the absence of state sales tax increment revenue, the project is not reasonably anticipated to be developed within the foreseeable future.

· Adopt a resolution for approved applications specifying the following:

· The local government approved to undertake a regional tourism project.

· The area of the regional tourism zone.

· Requested by the local government, authorize the creation of an authority to receive and

· spend state sales tax increment revenue.

· The percentage of the state sales tax increment revenue that will be dedicated to the

· project.

· Authorize the collection and use of the state sales tax increment revenue for a designated

· number of years.

· Authorize the utilization of the state sales tax increment revenue by the financing entity pursuant to the RTA and conditions of approval determined by the EDC.

· Appoint board members to the approved authority when applicable.

· Have the ability to revoke or modify its approval of a project if substantial work on the project does not commence within five years of approval by the EDC.

· Other terms and conditions required by the EDC.

Process A local government will need to submit a regional tourism project application to OEDIT within the application cycle deadline. OEDIT will review the application for general completeness and to make an initial determination regarding whether the application has met the general criteria for a regional tourism project. An economic review and report on the application will be completed by an independent Third Party Analyst hired by the Office of State Planning and Budgeting. Applications will be forwarded to any county or counties and adjacent municipalities where the project will be implemented for an opportunity to review the application and submit comments to the EDC within 30 days prior to the scheduled EDC meeting. The EDC will make final approval or denial determinations.

2.2 Overview

The State Purchasing Office is requesting proposals from responsible Contractors to establish a contract with a qualified Contractor (Third Party Analyst) with expertise in the field of economic and financial analysis. By using the information submitted by applicants, along with additional data/resources deemed necessary (by the Contractor), the Contractor shall perform economic and financial evaluations for each proposed regional tourism project. The Contractor shall provide a report of this analysis including an executive summary for its recommendations for each proposal evaluated. The Contractor’s analysis will be used by the commission in determining the sales tax increment revenue that can be dedicated to a proposed regional tourism project.

The State may award all or part of this RFP based on the best interests of the State and reserves the right to award to multiple Contractors. To maximize chances of success in this process, Contractors are encouraged to provide an aggressive response to this RFP.

Section 3 - Statement of Work

3.1 Required Economic and Financial Evaluations

3.1.1 The Awarded Contractor shall be responsible for the following activities, including but not limited to the required services as follows.

a) Contractor will review the Regional Tourism Act application and verify/modify the basic development and economic/fiscal assumptions and estimates needed to evaluate the proposal. Contractor will summarize the development project, identifying the development project in size and average market sales and lease values by annual increment. Contractor will make any additions and modifications needed regarding market values and absorption needed, along with estimates of construction costs and land values.

b) Contractor will evaluate the overall viability (likelihood of success) of the proposed project(s). This component should be directly linked to net new economic activity associated with the project.

c) Contractor will calculate basic inputs for fiscal and economic evaluations such as direct employment, households, and population generated by the proposed development.

d) Contractor shall apply property tax assessment rates for residential and commercial property consistent with the Gallagher Amendment and should be calculated using appropriate mill levies. Contractor will review any suggested modifications in development value and timing with OEDIT staff.

e) Contractor will evaluate data provided by the applicant to verify and/or modify assumptions regarding new out-of-state visitation and spending levels. Market analysis techniques may vary depending on the type of project proposed.

f) Contractor will perform a competitive analysis of the project to determine if there are similar facilities existing in the state from which market share would be cannibalized. Based on visitation and sales levels at competitive facilities, or other estimates of demand, Contractor will estimate the range of expected net new activity. Contractor will expand the competitive analysis, as needed, to the broader Rocky Mountain region and national markets to evaluate the level of market competition and a reasonable market share for the proposed facility to determine overall project viability.

g) Contractor will construct a model to estimate the resulting annual City, County, and State sales taxes from the development forecasts and new sales tax activity. Tax revenues used will include taxes on construction as well as ongoing revenues from onsite retail and employment uses. Sales tax revenue shall be calculated on an annual fiscal year basis for the forecast period.

h) Contractor will review the applicant’s proposal to assess the probability of the proposed project moving forward without funding from tax increment financing.

i) Contractor will quantify the net new economic benefits of the project to the State in terms of new job creation, economic activity, and revenues. One-time impacts from construction should be identified separately from the ongoing net-impacts of operating the project. Benefits should include direct, indirect, and induced impacts at the State level.

j) Contractor will conduct a State fiscal impact analysis. This analysis should estimate the net impact of the project based on revenues generated, state tax revenue pledged to the project, and the costs to the state of providing other services for the project. Contractor will use the baseline growth rate estimated by OSPB and OEDIT in their assumptions for the fiscal analysis. A further State fiscal impact analysis should estimate the impact of the project on the broader state budgeting framework. This may include other state government costs and revenues, such the impact on K-12 education, and Colorado State Patrol.

k) Contractor will conduct two formal face-to-face meetings with each applicant during its review period in order to better understand issues and assumptions associated with each project. The applicant will have eleven (11) calendar days to make this determination and submit a report revision request to OSPB.

f. The OSPB will send to the Contractor the applicant’s revised application for a second review. The Contractor will have fifteen (15) calendar days to make revisions to its previously submitted analysis report to account for revisions made by the applicant.
