Minnesota’s Commitment to Diversity and Inclusion

The State of Minnesota is committed to diversity and inclusion in its public procurement process. The goal is to ensure that those providing goods and services to the State are representative of our Minnesota communities and include businesses owned by minorities, women, veterans, and those with substantial physical disabilities. Creating broader opportunities for historically under-represented groups provides for additional options and greater competition in the marketplace, creates stronger relationships and engagement within our communities, and fosters economic development and equality.

To further this commitment, the Department of Administration operates a program for Minnesota-based small businesses owned by minorities, women, veterans, and those with substantial physical disabilities. For additional information on this program, or to determine eligibility, please call 651-296- 2600 or go to www.mn.gov/admin/oep.

SPECIAL NOTICE: This is a request for proposal. It does not obligate the State of Minnesota to award a contract or complete the proposed program, and the State reserves the right to cancel this solicitation if it is considered in its best interest.

This Solicitation requires proposals to be submitted through the SWIFT Supplier Portal.

Please note the security changes below that may impact responders from submitting a timely response.

SWIFT SUPPLIER PORTAL SECURITY CHANGES

There are new security measures that the Minnesota Management and Budget implemented on October 16, 2022. It is a new multi-factor authentication (MFA) to enhance the security of the State of Minnesota Supplier Portal. MFA is an authentication method that requires bidders and suppliers provide two verification factors to log into the SWIFT Supplier Portal. The goal of MFA is to create a layered defense that makes it more difficult for unauthorized system access to occur.

For information about these changes, please refer to the SWIFT Supplier Portal Multi-Factor Authentication FAQ document.

If you have not done so already, please make sure to log into the SWIFT Supplier Portal as soon as possible to get this authentication set up early so there are no issues when submitting a response to an RFP.

You are strongly encouraged to set your MFA during business hours of 8:00 A.M. to 4:00 P.M., Central Time, Monday through Friday. You may experience delay setting your MFA after hours.

SECTION 2 – SUMMARY OF SCOPE

Project Overview

The Project is located in Benton and Morrison Counties, Minnesota, near the city of Rice. The Project limits extend to an area within approximately five miles of Little Rock Creek. The Department of Natural Resources (MNDNR) requests proposals from interested consulting engineering firms for professional services to perform all work necessary to analyze options and provide engineering designs to resolve the water-use conflict in the Little Rock Creek area and to protect the stream from negative impacts due to groundwater use. The Commissioner of Natural Resources is seeking proposals that include for each option an engineering plan; an estimate of implementation costs; a potential structure of local governance to fund and operate a water supply system; a proposed development schedule;

and an economic evaluation of lost agricultural revenue if no action is taken.

Phase 1 of this contract will consist of design and production of construction contract documents. The project may also consist of a second phase of Construction Management.

Similarly, and dependent on funding availability, the State may choose to request a proposal from the awarded Responder and negotiate Phase 2 with them. Phase 2 of this contract will consist of bidding and construction administration. Responders must not assume that the State will move forward with Phase 2 of this project and will only be scored on their Phase 1 proposal and cost.

Goals and Sample Deliverables

The following goals have been established for the Project:

1. Provide a safe work environment for workers and the public.

2. Completely prevent the spread of all invasive species.

3. Little Rock Creek will remain at least as clean and clear as before project construction and operation.

4. Water quality parameters such as phosphorus, nitrate, dissolved oxygen, temperature, suspended sediment, and streambed sediment will not worsen as a result of a proposed project.

5. Protect the Little Rock Creek stream ecosystem as defined by the Commissioner, and consistent with the sustainable diversion limit established by Commissioner’s order.

6. Minimize annual operation and maintenance efforts and costs.

7. Protect existing water systems and property owners’ ability to develop lands.

13. Allow and encourage innovative ideas in design and construction to achieve the above.

Phase I:

The awarded vendor will prepare and submit the engineering designs to provide a complete system to pump, filter if needed and convey groundwater from nearby aquifers for agricultural irrigation purposes and/or for augmenting streamflow’s that resolve the water use conflict (see Attachment E Commissioner’s order), provide for possible expansion of sustainable irrigation water supply into the future, and protect the Little Rock Creek stream ecosystem as defined by the Commissioner. The awarded vendor is encouraged to recommend design(s) for additional or alternative projects that will improve baseflow in Little Rock Creek sufficient to offset negative impacts to baseflow’s from groundwater use. All proposed options must comply with the sustainable diversion limits as established by the commissioner.

Additional major responsibilities to the successful teams will be quality, safety, and demonstrating that a proposed project design can meet water quality, ecosystem, and other environmental requirements.

Phase I Deliverables to Include:

1. Meet with DNR Project staff for a design kick off meeting. Meeting may be via videoconference.

2. Meet with irrigation water users to identify water supply requirements.

3. Confirm existing condition of current infrastructure in the field. Gather any additional data from testing or inspection that may be required for design.

4. Collect topographic field survey, geology, aquifer or existing infrastructure information as required to scope and design projects. DNR will assist with this deliverable by providing electronic files described reports as requested.

5. Schematic designs (30%) must include locations of new wells, pump stations, proposed water supply lines and electric supply routes and associated costs estimates. Identify conflicts with existing utilities and proposed relocation options if necessary. Include a narrative on how the Project Goals listed earlier in this RFP will be met.
