RFP #26RFP19846: NEPA Assignment Environmental Process and Procedures Manual Development

This Request for Proposal (RFP) document from the South Dakota Department of Transportation (SDDOT) seeks consulting services to support the state's assumption of full responsibility for compliance with the National Environmental Policy Act (NEPA) and federal environmental laws pertaining to the transportation program. The SDDOT requires a consultant to prepare, facilitate, and document monthly meetings with the Federal Highway Administration (FHWA) for a minimum of 18 months, develop revised environmental processes and procedures to support NEPA Assignment responsibilities under 23 USC 327, create Quality Assurance/Quality Control processes and training programs, and conduct stakeholder coordination. The RFP follows a two-phase competitive negotiation process: interested firms must submit a Letter of Intent by June 26, 2026, after which up to three firms will be selected to submit full proposals due July 17, 2026. The anticipated award decision and contract negotiation will occur by July 24, 2026, with the contract term expected to be 18 months from execution, extendable as necessary. The contract will be governed by South Dakota law and venue in Hughes County Circuit Court.

The RFP does not specify a fixed contract amount but establishes that the total contract amount will be an amount not to exceed a maximum limiting amount to be determined during negotiations. Selected contractors must submit separate cost proposals identifying estimated hours per task, hourly rates for staff resources, and total project costs, with proposals remaining valid for at least 90 days after submission. Contractors must maintain Commercial General Liability Insurance of at least $1,000,000 per occurrence, Professional Liability Insurance of $1,000,000, Business Automobile Liability Insurance of $1,000,000 per accident, and Workers' Compensation Insurance as required by South Dakota law. Evaluation criteria include specialized expertise in NEPA Assignment, staff qualifications and FHWA experience, resource availability, past performance record, project management approach, availability of backup staff, familiarity with similar agencies or states, and ability to handle project constraints. The State reserves the right to reject any or all proposals and terminate negotiations if compensation cannot be reasonably agreed upon, proceeding to negotiate with successive ranked offerors as needed.
