2. BACKGROUND
2.1 The ADHS and BNPA administer funds provided by the USDA for the operation of the Special SNAP for the
WIC Program within the State of Arizona. Federal funds are distributed to twenty-one (21) local health agencies (governmental and community-based private non-profit) and one (1) Native American tribe. WIC services are provided in all fourteen (14) Arizona counties or parts thereof. This cost-effective nutrition intervention program is designed to improve the nutritional status of income eligible pregnant, breastfeeding, and postpartum women, infants, and children up to the age of five (5) years who are determined to be medically at risk;
2.2 WIC has four (4) major components: health services, nutrition education, breastfeeding education, and supplemental foods. Participants are screened for eligibility during the certification process by WIC staff at an LA clinic for one (1) or more nutritional risks when certain financial and State residential criteria are met.
Participants/authorized representatives receive food benefits for specific quantities and categories of WIC authorized foods on an e-WIC card. Authorized Vendors, which meet certain selection criteria (See 2.3), have signed Contracts with ADHS to accept an e-WIC card as payment for WIC food purchases. The foods provided through the WIC program are not intended to provide a complete diet, but rather supplement foods already being consumed. WIC foods are selected to meet certain USDA nutritional requirements for vitamins, minerals, and protein. Therefore, there are no substitutions for WIC authorized foods;
2.3 The following criteria must be met in order to become an Authorized Vendor:
2.3.1 Maintenance of minimum stock requirements,
2.3.2 Competitive pricing for WIC foods, OF HEALTH SERVICES
2.3.3 Location accessibility for WIC participants,
2.3.4 Type of retail establishment,
2.3.5 Sanitation compliance,
2.3.6 WIC and SNAP history,
2.3.7 Above-fifty percent (50%) Vendor,
2.3.8 Training attendance,
2.3.9 Conflict of interest,
2.3.10 Volume of WIC sales,
2.3.11 Current SNAP status,
2.3.12 Business integrity, and
2.3.13 Service Mark Compliance,
2.4 The Arizona WIC Program allows participants/authorized representatives to select their choice of Authorized Vendors from a current list;
2.5 WIC Contract execution authorizes ADHS to perform any/all monitoring (covert and overt) that ADHS deems appropriate. An example of a covert activity is a CB or LA investigation. An overt activity is the WIC VSR or ME. When WIC Program fraud or abuse is detected, sanctions may be imposed as outlined in the most current version of the Arizona WIC Program Policy and Procedure Manual and Vendor Manual (https://www.azdhs.gov/prevention/azwic/vendors/index.php#manual); and
2.6 Federal Regulations dictate that ADHS is responsible for the comprehensive monitoring of Vendors, WIC Staff, and WIC participants. WIC Authorized Vendors may be selected by ADHS for Compliance Buys or VSRs based on their volume of WIC sales, past program abuse, history of unusually high prices for WIC foods, random samples, complaints, availability and/or variety of WIC foods, submission of suspicious food instruments for payment, and from computer-generated high-risk reports. WIC Staff and/or participants may be selected for compliance investigations based on complaints and/or internal monitoring reports.
