About this file

This is an Addendum No. 1 containing questions and answers for RFP #S24DLSE004 Re-Bid issued by the California Department of Industrial Relations (DIR) for the Domestic Worker Outreach and Education Program. The proposal submission deadline is December 30, 2024 at 4:00 PM, with proposals to be emailed to procurement@dir.ca.gov with specified cc recipients. The RFP is a new and separate solicitation issued as a re-bid, with DIR clarifying that previous solicitations and addendums should not be referenced.

Key clarifications include that any changes to subcontractors must receive prior DIR approval, signatures on required attachments must correspond to the new RFP timeframe, and prime and subcontractor experience can be combined to meet minimum qualifications. DIR confirms there is no incumbent for this opportunity and cannot advise on specific budget allocations between tasks, though quantities listed on the cost sheet may not be altered. The agency notes that collaborations with California Workplace Outreach Project (CWOP) awardees are at the contractor's discretion, with deliverables evaluated independently. The RFP includes requirements for proven industry knowledge and five years of experience in providing outreach and assistance to domestic workers on wage theft matters.

Below is a compilation of the written questions and answers for the above referenced RFP.

1. Are there any changes or amendments to the answers provided to the questions in the initial

RFP S24DLSE004 Q&A Addendum, posted September 26, 2024?

ANSWER: This is a new and separate Request for Proposal issued as a re-bid. If considering submitting a proposal, please do not refer to previous solicitations or addendums. To clarify, we have issued an addendum #2 to add “re-bid” to the solicitation.

2. When requesting to substitute a subcontractor, can we substitute just a portion of their allocated budget? For example, if we include one subcontractor with a corresponding 8% of the bid price, can we continue working with them at 4% of the bid price and substitute another subcontractor only for the remaining 4% of that allocated budget?

ANSWER: Please see Section III. Proposal Requirements, Item A.10. Any changes to subcontractors identified in the final contract award must be submitted to DIR for prior approval. No substitution may be made without DIR approval.

3. Can the Subcontractor % of bid price change over the course of the contract? For example, if we decide to terminate working with a subcontractor, or if we increase or decrease the size of the subcontract? What would be the process for obtaining approval for any changes?

ANSWER: Please see Section III. Proposal Requirements, Item A.10. Any changes to subcontractors identified in the final contract award must be submitted to DIR for prior approval. No substitution may be made without DIR approval.

4. Can Exhibit E, Attachment 1 – Conflict of Interest & Confidentiality Statement for technical staff have October 2024 signature dates?

ANSWER: The previous Request for Proposal (RFP) was cancelled. The Proposer and each member of the Proposers technical staff proposed to work on this project must sign and date all attachments required for this re-bid. Signatures and dates should tie to the new RFP that was re-posted.

5. Can prime and subcontractor experience be combined to meet the minimum qualifications in terms of years, experience, and expertise? In particular, can a subcontractor on the team be used to meet the newly added minimum qualification for “Proven industry knowledge and at least five (5) years of experience directly providing outreach and assistance to domestic work employees and employers on matters relating to wage theft, such as educating workers and employers on their respective rights and obligations and assisting workers with completions of claim forms and/or representing workers on wage theft matters?”

ANSWER: Yes, the language in the RFP has been edited in Addendum #2 to clarify the experience requirements in the Minimum Qualifications section.

6. Can you publish a list of all the agencies and entities that have submitted written questions for this RFP?

ANSWER: The list of agencies and entities that have submitted written questions for this RFP is considered confidential until the bid due date has closed, and a contract has been awarded.

7. Is there an incumbent for this opportunity? If so, can you please provide the name of that organization?

ANSWER: There is no incumbent for this opportunity.

8. Does DIR have a preference for a firm already engaged in assisting domestic workers with filing wage claims?

ANSWER: No, DIR is seeking proposals.

9. What percentage of the total budget should be reserved, on average, for advertising and/or media buy for each task cost?

ANSWER: DIR is unable to advise on percentages allocated to each line item of the cost sheet. DIR has included quantities listed on the cost sheet for evaluation purposes. These quantities may not be altered.

10. When bringing in advertising and communications to support the campaign, should that budget be concentrated in Task 1, Public Outreach and Education Program and its subtasks, along with Task 2, Employee and Employer Outreach and its subtasks?

ANSWER: DIR is unable to advise on budget allocated to each line item of the cost sheet. DIR has included quantities listed on the cost sheet for evaluation purposes.

These quantities may not be altered.

11. How should the submitted budget be divided between outreach efforts and advertising and marketing support for all tasks and subtasks, and is there a preference toward allocating more dollars to outreach efforts or advertising and marketing support?
