SECTION A –
COMBINED SYNOPSIS/SOLICITATION
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
This solicitation is being issued as a Request for Proposal (RFP) under 9531CB23R0002. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2022-05.
The NAICS Code for this procurement is 519190 – All Other Information Services.
1.0 BACKGROUND.
The Bureau is responsible for publishing weekly Average Prime Offer Rates (APOR) values, a measure of what qualified borrowers would pay for a mortgage.
Three primary uses of APOR are (1) to determine if a mortgage is a Higher Priced Mortgage Loan under Regulation Z, (2) to generate the rate spread variable in Home Mortgage Disclosure Act (HMDA) data, and (3) to determine whether a mortgage is a Qualified Mortgage (QM) under the Bureau’s Ability to Repay (ATR) rules. The Research, Markets, and Regulations (RMR) Division seeks to acquire APOR data, the right to use the mortgage pricing data to replace the PMMS for a period to include the base period and up to four additional government option periods, and the right to use and maintain an archive of data acquired by the Bureau during all base and executed option periods (if exercised) to generate and publish the weekly APORs. See 2.9, below, for the full extent of the Government’s Use Rights that the Government requires under this solicitation.
2.0 SCHEDULE OF SERVICES AND PRICES
The Consumer Financial Protection Bureau (CFPB or Bureau) is seeking weekly delivery of a data source for its Average Prime Offer Rates (APOR) tool for a 12-month base period and for up to four 12-month government option periods, for a period of five years after the base period or the last exercised option year (if exercised), whichever is later.

Section B- Statement of Work
1.0 SCOPE.
The Bureau seeks to acquire APOR data, the right to use the mortgage pricing data to replace the PMMS, and the right to use and maintain an archive of data acquired by the Bureau during all base and executed option periods (if exercised) to generate and publish the weekly APORs.
2.0 MINIMUM REQUIREMENTS
2.1 Data Format
Datasets will be made available in standard formats (e.g. csv, tab-delimited text, XML) that are natively compatible for loading into statistical software, PostgreSQL, and MS SQL Server environments.
Datasets will be made available to CFPB via common secure file transfer protocols (e.g., SFTP).
2.2 Data Set/Data Coverage
The data shall meet the below requirements:
The data shall contain weekly aggregated mortgage pricing data covering the following loan products:
• 30-year fixed rate loans
• 15-year fixed rate loans
• 1-year ARMs (Adjustable-rate mortgages)
• 5/1 ARMs
• 10/1 Adjustable-rate mortgages (ARMs)
• 7/1 ARMs
• 5/1 ARMs
• 3/1 ARMs
• 1 year ARMs
The data shall contain information on loans of the following types:
• Best quality
• <=80% loan-to-value
• Conventional
• Conforming
• First lien
• Home purchase
2.3 Timeframe
Weekly aggregated data containing indices used to generate APOR values, beginning February 1, 2023
2.4 Required Data Fields
Data fields refer to the name and label of specific data contained in the vendor’s data set. In order to evaluate the proposal, the Bureau must receive a list of all data fields contained in the data set, which must, at minimum, include the following fields:
Mortgage Pricing Data:
• Date
• Average Rate
• Average total points and fees (discount points plus origination points)
• Average margin (for ARMS only)
• APR
2.5 Data Quality and Documentation
Information detailing the vendor’s data collection and data compilation methodology shall be provided by the vendor at the time of proposal to verify the requirements are met, and after each change in data collection or compilation methodology during the award period. Data dictionaries describing the contents, format, and structure of the data and relationship between its elements for the data shall be provided by the vendor at the time of proposal to verify the requirements are met and after each data dictionary change during the award period. Fields or values that have been constructed, estimated, edited, inferred, or otherwise built or modified shall be identified in a data dictionary or similar document. Information on the data collection and data compilation methodology may be sufficiently described for each field in the data dictionary; however, the vendor may also provide each document separately. Data shall be provided on a regular, weekly basis by 12pm on Thursdays. Data shall be de-identified such that the CFPB cannot identify or re- identify any individual or entity, including borrower, lender, servicer, or investor. Data shall be securely transferred.
3.0 DELIVERABLES.
The following deliverables are required and shall be submitted to the Contracting Officer’s Representative (COR). The Contractor shall ensure all deliverables are clear, concise, technically accurate, well-organized, properly referenced, and complete by the appropriate due dates.

4.0 ANALYTICAL, TECHNICAL, AND ADMINISTRATIVE SUPPORT
REQUIREMENTS
Support for users of the dataset shall be provided throughout the course of the contract. The contractor shall provide a single point of contact for technical and administrative questions (e.g. relating to the transfer of data). The contractor shall provide a single point of contact for analytical questions (e.g. relating to the representativeness of a segment of loans). This point of contact may be the same as the technical point of contact provided that that person is qualified to handle both types of issues. The contractor shall provide, at a minimum, a response time of two business days or less.
The following Government Use Rights must be provided by the vendor at a minimum:
5.1 Full right to publish the average data used to generate
APORs as well as the weekly APOR values generated based on these data
5.2 No advance notice, advance review of, or permission for
publication is required
5.3 Right to reference use of the dataset in public communications using the APOR values generated by the data during the time period of the contract and for a period of five years after the base period or last exercised option year, whichever is later;
5.4 Right to archive and continue using the data for generating past APOR values that existed at the time of the expiration of the contract. (“Existing Work Product”), for a period of five years after the base period or last exercised option year, whichever is later. The Existing Work Product includes Work Product that, by the conclusion of the base year or last exercised option year:
i. Has appeared in public, including on the Bureau’s own website
ii. Had been drafted for internal memo, data report to CFPB executives, other internal CFPB publication, or entered the Bureau’s internal review process for internal publication
5.5 “Government,” for purposes of Government Use, includes the CFPB, CFPB employees, and CFPB contractors with a business need to access the data in order to perform necessary analysis.
5.0 QUALITY ASSURANCE SURVEILLANCE PLAN.
The Contracting Officer’s Representative (COR) will measure the Contractor’s performance in the categories listed below (evaluation based on meeting the requirements of this SOW):
Quality of Service Timeliness of Data Provided
Surveillance method: Random Evaluation.
This method employs a “spot check” style of evaluation and may be adjusted based on quality trends. The Government retains the right to inspect all requirements of the contract. Unacceptable performance will be recorded and the Contractor shall be required to correct the unacceptable condition within a 24-hour time period. If the Contractor does not correct the unacceptable condition within 24-hours, the COR will notify the Contracting Officer who will take appropriate administrative action for unacceptable performance. When an observation indicates defective performance, the COR will require the Contractor to initial the observation. The initialing of the observation does not constitute concurrence with the observation, it only indicates acknowledgement that the Contractor has been made aware of a potentially defective performance.

6.0 INSPECTION AND ACCEPTANCE.
Inspection and acceptance of all products and services shall be by the COR and ACOR.
Deliverables and services shall be reviewed for accuracy, clarity, completeness, and timeliness within five working days after receipt unless specified differently elsewhere in the contract. CFPB will provide any concerns and comments to the Contractor, who shall ensure completion of each deliverable in a manner acceptable to the COR and ACOR within three working days of such CFPB notice. The Contractor shall deliver all copies of completed deliverables to the COR and ACOR.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form.
This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

5.0 CLAUSES INCORPORATED IN FULL TEXT
5.1 FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days.
5.2 FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT
(MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 365 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 15 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years and six (6) months.
5.3 52.227-14, RIGHTS IN DATA-GENERAL (MAY 2014)
(a) Definitions. As used in this clause-
Computer database or "database means" a collection of recorded information in a form capable of, and for the purpose of, being stored in, processed, and operated on by a computer. The term does not include computer software.
Computer software-
(1) Means
(i) Computer programs that comprise a series of instructions, rules, routines, or statements, regardless of the media in which recorded, that allow or cause a computer to perform a specific operation or series of operations; and
(ii) Recorded information comprising source code listings, design details, algorithms, processes, flow charts, formulas, and related material that would enable the computer program to be produced, created, or compiled.
(2) Does not include computer databases or computer software documentation.
Computer software documentation means owner’s manuals, user’s manuals, installation instructions, operating instructions, and other similar items, regardless of storage medium, that explain the capabilities of the computer software or provide instructions for using the software.
Data means recorded information, regardless of form or the media on which it may be recorded. The term includes technical data and computer software. The term does not include information incidental to contract administration, such as financial, administrative, cost or pricing, or management information.
Form, fit, and function data means data relating to items, components, or processes that are sufficient to enable physical and functional interchangeability, and data identifying source, size, configuration, mating and attachment characteristics, functional characteristics, and performance requirements. For computer software it means data identifying source, functional characteristics, and performance requirements but specifically excludes the source code, algorithms, processes, formulas, and flow charts of the software.
Limited rights means the rights of the Government in limited rights data as set forth in the Limited Rights Notice of paragraph (g)(3) if included in this clause.
