PROJECT OVERVIEW

The State of Nevada Purchasing Division is seeking proposals from qualified vendors on behalf of Department of Conservation and Natural Resources, Division of State Parks for motorized watercraft rental concession at Sand Harbor.

The Division of State Parks (NDSP) will administer a contract/lease resulting from this RFP for the exclusive operation and maintenance of -Motorized Water Sports Concession at the Sand Harbor, Lake Tahoe Nevada State Park. The resulting revenue generating concession lease shall be for a term of four (4) years anticipated to begin June 8, 2021, subject to Board of Examiners approval.

The Sand Harbor motorized watercraft rental concession will be located at Sand Harbor Management Area of Lake Tahoe Nevada State Park (LTNSP). Sand Harbor is the most heavily developed area within LTNSP and receives the highest visitation. Long sandy beaches, rocky coves, and panoramic lake views offer visitor’s unparalleled prospects to enjoy Lake Tahoe. It is a very popular area located within proximity to several significant population centers. The five-year average annual visitation average (2016 – 2020) for the Sand Harbor is 906,505 visitors. Most of this visitation is concentrated between the months of May through October. Popular activities range from sunbathing, swimming, boating, picnicking, scuba diving, fishing, weddings, and other beach and group events. For many years now, motorized activities have been a significant use at Sand Harbor. The park is a day use facility and is open year-round. The primary developed area is approximately 55 acres and is comprised of the main beach, Sand Point, Divers Cove, a group use Ramada, boat launch area and boat beach, a large picnic area, visitor center/food concession, and administrative/maintenance complex. Parking at the facility includes a 75-space boat parking lot, 533 space main parking lot (which includes the main, middle, and south lots), and a 30-space group lot. The park also offers nine comfort station restrooms. In addition, two separate entrance areas exist on Hwy 28 with contact stations for both the main beach part of the park and the boat launch area. Sand Harbor is home to the Lake Tahoe Shakespeare Festival located at the park’s stage facility in the bowl area of Sand Point. Other portions of this management area are the Memorial Point Overlook, Hidden Beach, and approximately 4 miles of rocky shoreline areas, north and south of Sand Harbor. Sand Harbor is a park that operates as an “entry for fee” area and has strict patterns of use within the confines of well-defined seasons. The peak season of the park is June, July, and August and represents a period in which heavy visitation occurs, with the park routinely operating at or near maximum capacity. Many days during this period, especially weekends and holidays, the park closes due to the acute levels of visitation. When Sand Harbor is closed due to these conditions, most vehicles will not be permitted to enter the park. The “shoulder season” periods of May, September, and October are moderately busy with most of the visitation occurring on the weekends. During the remainder of the year, visitation drops dramatically. All periods of use in the park are somewhat weather dependent.

The business plan of proposed operations must be able to successfully function within this environment and under the variable conditions of the park. Proposers to this RFP should carefully evaluate these market and park conditions and plan or respond accordingly.

SCOPE OF WORK

The Nevada Division of State Parks (NDSP) intends to award a new four (4) year concession contract through this Request for Proposal (RFP) for the exclusive operation and maintenance of a Motorized Boat Rental Concession at the Sand Harbor Management Area of Lake Tahoe Nevada State Park. The objective of this RFP is to allow visitors to rent motorized boats (no personal watercraft) equipment at Sand Harbor during regular park hours. LTNSP is seeking a highly qualified operator with the knowledge, enthusiasm, creativity, and resources to successfully provide high-quality services through this concession operation. The concessioner during their launch window will be allowed to transport one boat into the ramp, complete the seal inspection, launch the watercraft, loads renters, and depart. Personal watercraft and jet skis are not allowed under this contract/lease. No onsite rentals will be permitted, all rentals will occur in advance as either an online or phone reservation. Concessionaire launch windows are a half hour long starting at 8 a.m. daily and the last launch window ends at 2 p.m. Recovery of rental watercraft will be permitted until a half hour prior to the daily evening boat ramp closure. A total of 12 launch windows will be made available to the awarded vendor, any remaining launch windows not selected by the awarded vendor will be offered to the second-place vendor. All rentals will need to be 4 to 8 hours long. The anticipated period of operation for this rental concession is expected to be May 1 through October 15 of each year. In low water years it is possible for the Sand Harbor Boat Ramp to close early, in the event of this occurring the concessionaire will need to cease operations until ramp conditions improve.

Issues/needs to be considered by the successful concessionaire:

Promotion of a safe, enjoyable and high-quality experience for a variety of visitors at the park.

Services and pricing able to respond to the market demands of a public park with a visitor population of predominately moderate incomes.

Knowledge of the beach area and visitor patterns

Safe working environment for employees with a knowledgeable and friendly staff.

High quality, reliable, and safe equipment.

Thorough and efficient plans for the collection of rental fees and the tracking of equipment.

Customer service levels that exceed expectations and generate repeat business.

Awareness and respect of the natural resources and environment.

A desire to work as a partner with Nevada State Parks in providing this service for the visitors of Sand Harbor, while adhering to the rules, policies and overall objectives of the park.

Operational liability issues that are properly understood and addressed.

A Safety Plan that includes procedures for the safety of rental patrons, lake conditions, and equipment retrieval.

Selection of the launch windows they intend to use and demonstrate logistic ability to successfully move equipment and guests to abide by time limits and successfully rent in each launch window.

Once the selection process is completed by NDSP the prospective concessionaire will enter into an exclusive contract/lease agreement with the State of Nevada, and must be ready to staff, operate and maintain the approved Sand Harbor motorized boat rental concession beginning in June of 2021. Concessionaire must be able to prove they have ownership of operating motorized watercraft or ability to procure such watercraft either through lease or purchase by the start of the contract in order to fulfill all selected launch windows.

PROJECT SPECIFIC TERMS AND CONDITIONS

The general area of operation will be the Sand Harbor boat ramp. Parking and trailered boat storage will not be allowed in the park, concessioner can utilize up to two parking spaces if available during their launch or recovery windows.

Equipment will need to be removed from the park after the launch window ends. Parking priority is given to park visitors and concessioner will need to vacate the parking spaces if parking lot reaches capacity. Other legal storage arrangements outside of the park will need to be made. Shuttle services for rental or tour patrons is required.

A captain’s license will be required if the concessioner plans to shuttle any passengers on a watercraft.

Concessionaire will be required to rent watercraft to general public and watercraft cannot be part of any clubs or restricted use agreements.

Concessionaire agrees to abide by all Tahoe Regional Planning Association (TRPA) regulations and procedures, including those related to Aquatic Invasive Species (AIS) and the Lake Tahoe Watercraft Inspection Program.

All rental watercraft will be required to complete an annual safety inspection by the US Coast Guard or US Coast Guard Auxiliary.

All rental watercraft shall be registered with the Nevada Department of Wildlife with current registration in the State of Nevada.

All rental watercraft will be required to purchase an aquatic invasive species sticker for each watercraft from Nevada Department of Wildlife.

Concessioner will require all renters who intend to operate the watercraft to complete boater education through Nevada Department of Wildlife. Concessioner will verify this requirement is met or cancel the rental and be able to provide proof of boater education to any law enforcement officer while the boat is under contract.

Concessioner will cancel all rentals when a lake wind advisory is issued by the national weather service including rentals currently on the water.

Effective July 1, 2017, a five percent (5%) preference will be awarded to businesses based in Nevada. A Nevada business is defined as a business which certifies either that its ‘principal place of business’ is in Nevada, as identified in Section 3.1, Vendor Information, or that a ‘majority of goods provided for the contract are produced’ in Nevada. The preference will be applied to the total score.

Financial stability shall be scored on a pass/fail basis.

Proposals shall be kept confidential until a contract is awarded.

The evaluation committee is an independent committee comprised of a majority of State officers or employees established to evaluate and score proposals submitted in response to the RFP pursuant to NRS 333.335.

The evaluation committee may solicit information from any available source concerning any aspect of a proposal and seek and review any other information deemed pertinent to the evaluation process.

Each vendor shall include in its proposal a complete disclosure of any alleged significant prior or ongoing contract failures, contract breaches, any civil or criminal litigation or investigations pending which involves the vendor or in which the vendor has been judged guilty or liable. Failure to comply with the terms of this provision may disqualify any proposal. The State reserves the right to reject any proposal based upon the vendor’s prior history with the State or with any other party, which documents, without limitation, unsatisfactory performance, adversarial or contentious demeanor, significant failure(s) to meet contract milestones or other contractual failures. Refer generally to NRS 333.335.

Clarification discussions may, at the State’s sole option, be conducted with vendors who submit proposals determined to be acceptable and competitive per NAC 333.165. Vendors shall be accorded fair and equal treatment with respect to any opportunity for discussion and/or written revisions of proposals. Such revisions may be permitted after submissions and prior to award for the purpose of obtaining best and final offers. In conducting discussions, there shall be no disclosure of any information derived from proposals submitted by competing vendors. Any modifications made to the original proposal during the best and final negotiations shall be included as part of the contract.

A Letter of Intent (LOI) shall be issued in accordance with NAC 333.170 notifying vendors of the State’s intent to award a contract to a vendor, pending successful negotiations. Negotiations shall be confidential and not subject to disclosure to competing vendors unless and until an agreement is reached. All information remains confidential until the issuance of the formal Notice of Award (NOA). If contract negotiations cannot be concluded successfully, the State upon written notice to all vendors may negotiate a contract with the next highest scoring vendor or withdraw the RFP.

A Notification of Award (NOA) shall be issued in accordance with NAC 333.170. Vendors shall be notified that a contract has been successfully negotiated, executed and is awaiting approval of the Board of Examiners (BOE). Any award is contingent upon the successful negotiation of final contract terms and upon approval of the BOE, when required. Any non-confidential information becomes available upon written request.

Pursuant to NRS 333.700, any contract resulting from this RFP shall not be effective unless and until approved by the Nevada State Board of Examiners.
