FMVSS No. 213, Child Restraint Systems, Dynamic Testing Services
PART I - THE SCHEDULE
SECTION B - SUPPLIES OR SERVICES AND PRICES/COSTS
B.1 SUPPLIES/SERVICES
The Contractor shall provide the qualified personnel, facilities, materials, supplies, equipment, and services, except for those items identified in Section H.3, necessary to perform test, inspection, and reporting services to determine whether child restraint systems designed for use in motor vehicles comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) No. 213, Child Restraint Systems. This Contract encompasses the dynamic test requirements which are conducted on child restraint systems.
The Government intends for this procurement to result in multiple-award Indefinite-Delivery, Indefinite-Quantity (IDIQ), Firm-Fixed-Price (FFP) Contracts, with Cost Reimbursement elements for Contractor Purchased Test Items (CPTI). Under this Contract ̧the Government shall issue Delivery Orders in accordance with Federal Acquisition Regulation (FAR) 16.5.
B.2 MINIMUM/MAXIMUM OBLIGATIONS
B.2.1 Minimum Obligation – Upon award of the IDIQ Contract, the Government will order the supplies and services of the Known Requirements shown in Section B.3.0 in the amount of $TBD at Award. This amount represents the “Minimum obligation of the Government.”
RFP NOTE: The number of tests identified in Section B.3.0 represents the total number of known tests to be conducted during the Base Period (Contract Year 1) and not the guaranteed minimum obligation of each contract awarded as a result of this RFP. The guaranteed minimum number of tests to be ordered for each awarded contract will depend upon the number of contracts awarded and the proposed prices for the known requirements for each Offeror. Each awarded contract will include a guaranteed minimum obligation amount for at least one test specified in Section B.3.0.
B.2.2 Maximum Obligation – The Contractor shall be obligated to provide services and support up to the total not-to-exceed amounts specified in Price Schedules (Sections B.3.0 through B.3.6). Contract not-to-exceed amounts for each contract year are presented in the Price Schedules. The overall IDIQ contract ceiling amount is $TBD. The ceiling amounts may be increased upon execution of bilateral modification.
B.3 CONTRACT PRICES
This Contract includes two “Periods”: The “Base Period” which is the first 24 months of the Contract term (composed of Contract Year 1 and Contract Year 2) and the Option Period which, if exercised, begins at the end of the Base Period and continues for an additional 36 months (composed of Contract Year 3, 4, and 5).
Testing services are priced by Contract Year. The price in effect at the time a test is ordered shall apply to that test regardless of when the test is actually conducted and finished. Test prices shall apply for payment purposes and shall include all charges, including, if applicable, charges for storage.
Upon delivery and acceptance of supplies and services described in Section C, Statement of Work (SOW) and each awarded Delivery Order, the Government will pay to the Contractor the applicable fixed prices set forth in Price Schedules B.3.0 through B.3.6.
Except for the Known Requirements (i.e., guaranteed minimum order quantity), identified in Section B.3.0, the Government is not under any obligation to order any additional tests under this Contract. The Government reserves the right, at its option, to increase the quantities of testing services provided under this Contract up to the “Total Not-To-Exceed” amount specified for each contract period.
Optional quantities, if required by the Government, will be acquired by separate Delivery Orders.

C.2 BACKGROUND
The National Highway Traffic Safety Administration (NHTSA) is an agency of the U.S.
Department of Transportation (DOT). NHTSA’s mission is to save lives, prevent injuries and reduce economic costs associated with motor vehicle crashes. The Agency develops, promotes and implements effective educational, engineering and enforcement programs with the goal of ending preventable tragedies associated with vehicle use and highway travel.
On January 1, 1981, NHTSA issued Federal Motor Vehicle Safety Standard (FMVSS) No. 213, Child Restraint Systems. FMVSS No. 213 was substantially amended on July 5, 1995 to add a greater array of sizes and weights of test dummies for use in compliance tests, and on September 1, 1999, to require that child restraints be equipped with means for attaching to a new independent anchorage system. On June 24, 2003, FMVSS No. 213 was amended to incorporate improved test dummies and test procedures, and to extend the standard to apply to children who weigh up to 65 lbs. On February 27, 2012, FMVSS No. 213 was amended to incorporate a 10-year-old test dummy and to extend the standard to apply to children who weigh up to 80 lbs.
FMVSS No. 213 sets forth the performance requirements for child restraint systems. It includes the testing provisions which are necessary to determine whether a child restraint system meets those performance requirements. The test provisions include a frontal dynamic sled test which simulates a vehicle striking a fixed barrier in a frontal impact, the Federal Aviation Administration (FAA) inversion test, and inspection requirements. The test provisions also include materials tests, and an inspection of the restraint system’s features, and component testing, among other things.
This Contract encompasses the procurement of restraints as well as testing to frontal dynamic test requirements, the FAA inversion test, and inspection tests which are conducted on child restraint systems.
The purpose of this procurement is to acquire test and inspection services, to procure and test child restraint systems designed for use in motor vehicles to the requirements of FMVSS No.
213, following the requirements in the standard and the compliance test procedure specified in the Office of Vehicle Safety Compliance (OSVC) Test Procedure TP-213-10, Laboratory Test Procedure for FMVSS No. 213 Child Restraint Systems, dated February 16, 2014, (TP-213-10), as applicable, and to alert NHTSA of products that may not comply with the minimum safety standards.
C.3 DEFINITIONS
Government Furnished Test Items (GFTI) – Refers to test items (child restraint systems) owned or acquired by the Government and subsequently provided to the Contractor for use in the performance of the Contract. For the purpose of this contract, GFTI and Government Furnished Property (or “GFP”) mean the same thing. See Section H.3 for more details. The government is the owner of all GFTI.
Contractor Purchased Test Items (CPTI) – Refers to test items (child restraint systems) purchased by the Contractor for use in the performance of the contract. For the purpose of this contract, CPTI and Contractor Acquired Property (or “CAP”) mean the same thing. See Section H.14 for more details. Title to CPTI vests with the government except for CPTI acquired by the contractor following a Non-Conforming Test (See Section H.2).
Non-Conforming Test – Refers to a Contractor-performed test that does not comply with applicable Office of Vehicle Safety Compliance (OSVC) test procedure (TP) requirements and contract requirements or task order applicable to that test. See Section H.2 for instructions on how non-conforming tests are to be handled.
Test Passed – Refers to testing that the Contractor conducted correctly, and the item (child restraint systems) being tested met the FMVSS standards.
Test Failure – Refers to testing that the Contractor conducted correctly, but the item (child restraint systems) being tested failed to meet the FMVSS standards. See Section F.7 for instructions on how test failures are to be handled.
C.4 GENERAL REQUIREMENTS
The services under this contract are necessary to support NHTSA’s determination whether a child restraint system complies with the Federal Motor Vehicle Safety Standard (FMVSS) No.
213, Child Restraint Systems (see 49 C.F.R. § 571.213).
The Contractor shall furnish the necessary qualified technical personnel, facilities, materials, equipment, and services to perform the procurement, receipt, inventory, inspection, testing, reporting, storage and disposal of child restraint systems provided to the Contractor as Government Furnished Test Items (GFTI) or purchased by the Contractor as Contractor Purchased Test Items (CPTI).
When test failures are identified, the NHTSA Contracting Officer’s Representative (COR) will contact the Contractor and request information to support NHTSA’s assessment of the test results.
If a test failure is identified, NHTSA may require the Contractor to provide additional information specific to the tests conducted for NHTSA, including, but not limited to: test data, photos, video, details about the test set up, test observations, or details about the test item configuration, etc.
Subcontracting is not permitted under this Contract with the exception of calibration services as required under this Contract. Subcontracting of tests or any portion of a test is NOT permitted (see Section H.9).
C.5 KICK-OFF MEETING
Following Contract award, the Contractor shall coordinate with the Contracting Officer's Representative (COR) and begin preparatory activities for the Kick-Off meeting.
Within two (2) weeks of the effective date of the Contract, or as otherwise agreed to by the COR, the Contractor shall participate in a Kick-Off meeting with the COR, Contracting Officer (CO), and other NHTSA staff. The Kick-Off meeting shall take place via teleconference. This meeting will be approximately two hours in length. The Contractor shall make a brief presentation of their understanding of the contract requirements. After the presentation, the parties shall discuss basic contract requirements, including the schedule for testing and test procedures.
C.6 SPECIFIC CONTRACT REQUIREMENTS
C.6.1 Fully Operational Test Site
The Contractor shall possess and maintain a fully operational test site furnished with qualified technical personnel, facilities, equipment and test devices necessary to perform the inspection, compliance testing and reporting services in accordance with FMVSS No. 213 and the terms and conditions of this Contract. The Contractor’s test site shall be sufficiently staffed to perform and complete testing and support NHTSA inspections, and to generate and submit deliverables in accordance with the Delivery/Milestone Schedule (Section F.4.1).
C.6.2 Preliminary Documents
No later than thirty (30) days of the Effective Date of the Contract, the Contractor shall provide a copy of the following documents:
C.6.2.1 Test Procedure for conducting compliance tests according to TP-213-10)
• Frontal sled testing of all child restraint types, including:

Copies of the above documents shall be submitted electronically via email, unless otherwise specified by the COR. The COR will review the preliminary documents and provide comments to the Contractor and/or request for revisions within 15 days after receipt of the Preliminary Documents. The Contractor shall submit the final Preliminary Documents to the COR for acceptance no later than 30 days after receipt of the COR comments/revisions.
C.6.3 Test Items/Models
The Contractor shall, in accordance with the OVSC Test Procedure (TP-213-10), test each model of child restraint system provided as GFTI.
The Contractor shall, in accordance with the OVSC Test Procedure (TP-213-10), test each model of child restraint system purchased by the contractor (i.e., CPTI). The Contractor shall obtain the required CPTI for testing in accordance with the following procedures:
1. The Contractor shall obtain test item information from the issued delivery order which will include the test item (i.e., child restraint system model), test item model name and number, contact information for the appropriate source, cost estimate, delivery requirements, and the required quantities. Note: the COR may substitute test items identified on the Delivery Order with other test items, prior to the Contractor purchasing those items as long as the substitution does not result in an increase in CPTI expense for that Delivery Order, to the Contractor. The Delivery Order will also include two forms, a Manufacturer Verification Statement and Webbing Information Statement. The Contractor shall provide these forms to a vendor as part of purchasing child restraint systems for testing. The Contractor shall ensure that the vendor completes and returns the forms for each purchase.

This includes, but is not limited to, directly placing the purchase order for the required test items with the vendor, verifying that the purchase order is correct, taking all actions necessary to correct any purchasing errors and ensure that the correct test items and completed statements are received (per paragraph 1 above), and providing full payment to the vendor from which the test items were purchased.
4. The Contractor shall notify the COR of all purchase orders placed as well as receipt of the purchased test items and shall provide the COR with copies of the completed Manufacturer Verification Statement and Webbing Information Statement.
5. The Contractor’s invoice for CPTI shall reflect the actual cost of the test items. The Contractor shall retain all documents for each purchase order, including copies of the actual supplier invoices, until disposition instructions are provided by the COR.
Each Delivery Order will specify which child restraint models are to be tested and the Government will not be bound by any plans, lists, matrices, or other preliminary data submitted to the Contractor regarding the types or models of restraint systems planned for testing prior to issuance of the Delivery Order. The Contractor shall not substitute test items without prior written approval from the COR.
The CPTI identified is subject to change by the COR provided that (1) the cost for the test item does not exceed the funds available for procuring the CPTI and that (2) the Contractor has not begun fulfilling the order.
Title to CPTI will vest with the government except in the case of CPTI purchased as a Retest Item (refer to Section H.2 Non-Conforming Tests).
C.6.4 Ordering, Receiving, and Inspecting Test Items
Upon receipt of each Delivery Order, the Contractor shall order the specified quantities of test samples. Per the instructions of the COR, a portion of the test samples shall be delivered to the NHTSA designated component test laboratory.
Consistent with Section F, the Contractor shall verify that the CPTI and GFTI delivered were not damaged in transit or show evidence of mishandling during shipment (e.g., test items were properly secured for shipping), test items are the correct type and quantity ordered, and, if the test items were not shipped completely assembled, the shipment is complete, containing all required bolt-on components, hardware, etc. The Contractor shall document any discrepancy or damage identified (e.g., incorrect/incomplete items), and notify the Government. The Contractor and the COR will determine the appropriate steps to replace CPTI and GFTI damaged in transit.
In the event of discrepancies or damage related to the CPTI and GFTI received, the Contractor shall ensure that the manufacturer/vendor resolves any issues. The Contractor shall return items to the manufacturer/vendor, if required, and shall ensure that the manufacturer/vendor provides correct replacement items in return to the Contractor.
C.6.5 Storage and Disposing of Test Items
The Contractor shall store all CPTI and GFTI until receipt of disposition instructions from the Government. Typically, disposition instructions will be provided by the COR via e-mail after all testing, inspection and acceptance of the final test report has been completed. In all cases, the Contractor shall destroy and dispose of, at no additional cost to the Government, all CPTI and GFTI that have been tested and no test items shall be made available to the public or Contractor employees for further use.
At the request of the COR, unused test items (child restraint systems) shall be returned to the Government at no additional cost.
C.6.6 Security of Test Items and Data
