A-76 REQUIREMENT
Note paragraph entitled FAR 52.207-3, Right of First Refusal of Employment in Section I.
GSAR 552.219-72 PREPARATION, SUBMISSION, AND NEGOTIATION OF SUBCONTRACTING
PLANS (OCTOBER 2016)
(a) When submitting a subcontracting plan in accordance with FAR 52.219-9, the offeror shall submit a subcontracting plan with its initial offer. The subcontracting plan will be negotiated concurrently with price and any required technical and management proposals, unless the offeror submits a previously-approved commercial plan.
(b) Maximum practicable utilization of small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns as subcontractors is a matter of national interest with both social and economic benefits. The General Services Administration (GSA) expects that an offeror’s subcontracting plan will reflect a commitment to assuring that small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns are provided the maximum practicable opportunity, consistent with efficient contract performance, to participate as subcontractors in the performance of the resulting contract. An offeror submitting a commercial plan can reflect this commitment through subcontracting opportunities it provides that relate to the offeror’s production generally; i.e., for both its commercial and Government business.
(c) GSA believes that this potential contract provides significant opportunities for the use of small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns as subcontractors. Consequently, in addressing the eleven elements described at FAR 52.219-9(d) of the clause in this contract entitled Small Business Subcontracting Plan, the offeror shall:
(1) Demonstrate that its subcontracting plan represents a creative and innovative program for involving small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns in performing the contract.
(2) Include a description of the offeror’s subcontracting strategies used in any previous contracts, significant achievements, and how this plan will build upon those earlier achievements.
(3) Demonstrate through its plan that it understands the small business subcontracting program’s objectives and GSA’s expectations, and it is committed to taking those actions necessary to meet these goals or objectives.
(d) In determining the acceptability of any subcontracting plan, the Contracting Officer will take each of the following actions:
(1) Review the plan to verify that the offeror demonstrates an understanding of the small business subcontracting program’s objectives and GSA’s expectations with respect to the program and has included all the information, goals, and assurances required by FAR 52.219-9.
(2) Consider previous goals and achievements of contractors in the same industry.
(3) Consider information and potential sources obtained from agencies administering national and local preference programs and other advocacy groups in evaluating whether the goals stated in the plan adequately reflect the anticipated potential for subcontracting to small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns.
(4) Review the offeror’s description of its strategies, historical performance and significant achievements in placing subcontracts for the same or similar products or services with small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns. The offeror’s description can apply to commercial as well as previous Government contracts.
(e) Failure to submit an acceptable subcontracting plan and/or correct deficiencies in a plan within the time specified by the Contracting Officer shall make the offeror ineligible for award.
(End of provision)

All the contractor’s labor hour prices must include expenses for overhead, General and Administrative (G&A) and profit. Thus, no separate allowance for travel time, parking, overhead, G&A or profit will be applied when hourly services are ordered.
Offeror must submit offers for all locations in order to be considered for award. Offerors must submit prices for all four of the option periods, in addition to the initial period, to be considered for award.
Renewal / Options shall be priced using the wage determination contained in this solicitation. Upon exercising a renewal option, the Contract price will be adjusted in accordance with FAR 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards—Price Adjustment (Multiple Year and Option Contracts) (Aug 2018).
Offerors should visit the building and become familiar with existing conditions; examine all Contract documents relating to this work, and carefully review the requirements contained in this specification.
Offerors shall determine any conditions which affect the work and make a thorough site investigation before submitting an offer. No allowances will be made for failure of an offeror to avail themselves of such information.
Note 1. These quantities are for evaluation purposes only and are based on an estimate of the Government’s anticipated need for such service.
Note 2. Offerors are cautioned not to confuse overtime services with additional services. Additional services are defined as any work requested by the Government that is within the scope of this contract but in addition to the Contract requirements. Overtime services are defined as work within the scope of the Contract originally intended to be performed during normal working hours, where the Government requests the work be performed outside of normal working hours to expedite the return of a piece of equipment to operating condition or to minimize disruption to tenants.
Note 3. Quote a price per hour for providing Above Standard Services when ordered that are in addition to the services specified herein for the standard services. Orders for above standard service may be placed orally when the amount of the order totals $2,500.00 or less or in the event of an emergency. All orders which exceed $2,500.00 must be placed or confirmed by issuance of a GSA Form 300, Order for Supplies or Services and will be paid by GSA Finance. The GSA Form 300 will describe the service to be provided and will establish, excluding emergencies as determined by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR), the maximum number of hours for which the contractor will be compensated. Orders of $2,500.00 or less may be processed using the Government wide commercial purchase card, which is the preferred method to purchase and to pay for micro purchases. Individual orders for above standard services involving more than forty (40) hours will only be issued with the assent of the contractor. This above standard services provision is intended to be used to satisfy the Government's short term non-recurring needs for service. Should a continuing need for additional service arise, a Contract modification will be negotiated pursuant to the "Changes Fixed Price" clause. Above standard services cannot be accomplished by diverting resources from work that is supposed to be accomplished.
SECTION C - DESCRIPTION/SPECIFICATION/STATEMENT OF WORK
Introduction This is a Performance Based Contract which focuses on outcomes as opposed to prescriptive requirements. This specification represents GSA's performance objectives and minimum levels of service to be provided by the contractor. A high level of effective communication between the Government and contractor is essential. This performance-based requirement demands a greater emphasis by the contractor on self-evaluation, robust quality control processes and strict oversight of building operations to ensure the highest level of efficiency. The Contractor will be required to maintain a quality control program to ensure that the requirements of this Contract are met. The contractor must closely monitor all aspects of the work, identify deficiencies and implement corrective action, without reliance on Government oversight.
GSA is dedicated to ensuring its facilities are operated with a high degree of efficiency, minimizing energy use and may be actively pursuing or participating in programs such as ENERGY STAR rating, LEED-EB or comparable programs. The contractor will play an integral role in supporting this effort and should be aware of the requirements of these programs. The Contractor is not required to bring the building into conformance with LEED-EB, but within the scope of this Contract, shall operate and maintain the building in such a manner as to maintain applicable LEED-EBOM standards.
C.1. SCOPE OF WORK
C.1.1. GENERAL SCOPE OF WORK
The contractor shall provide the management, supervision, manpower, equipment and supplies necessary to provide landscaping services as described herein. The Contractor shall be responsible for performing all work under this contract in accordance with all Federal, State, County, City laws and codes, and follow the more stringent of them. In addition, the Contractor shall follow all applicable standard industry practices including, but not limited to: Occupational Safety and Health Act (OSHA).

C.1.1.5.
In compliance with EPA and USDA requirements, compost and fertilizers made from recovered organic materials and biobased herbicides and pesticides will be used unless an alternative product is approved by the COR. If weed, pest or disease control is needed the COR will approve in advance their application.
C.1.1.6.
The Contractor shall remove all debris generated in the performance of this contract each day service is performed. Upon completion of the repair or installation work, the Contractor shall remove and dispose of all unused materials, containers, wrappings, cuttings, trimmings, and any other debris accumulated as a result of this contract. Organic materials shall be composted, and other materials shall be recycled to the extent possible.
C.1.2. SCOPE OF WORK MOUNDS AND PLAZA LANDSCAPING SERVICES at D.E. MURPHY FEDERAL BUILDING and U.S. COURTHOUSE
C.1.2.1. Mounds and Plaza Landscaping Services Basic Landscaping Maintenance includes trimming mounds, edging, mulching, pruning, watering, weeding, pest and disease control, plant maintenance and trash removal. Policing landscape areas to remove trash and other cleaning issues will be done by the Janitorial staff between scheduled landscaping visits as directed by the COR.
C.1.2.2. Site Visit Contractor shall perform a site visit/consultation with the COR at the beginning of the growing season in May and submit a report identifying any additional services required to bring the landscape back to the original condition (excluding damage or failure of plants caused by negligence of the contractor). A plan and pricing for replacement plants and other services not included in the basic landscaping services will be submitted to the COR 21 days prior to scheduled planting. All plants installed will be guaranteed for 1 year. Guarantee will include plants, installation, and any soil amendments necessary to return the site to the original condition.
C.1.2.3. Plaza Landscaping Services Walkways, landings, and steps will be free of trash and weeds. Shrubbery, trees, and other landscaping areas will be pruned to maintain a well-groomed appearance and be free of deadwood, suckers, litter, and weeds. Fence areas, turf areas, sidewalks, gutters, roadways, and other surfaces included in the maintenance area shall be free of leaves, litter, and other debris. Damage caused by rodents shall be repaired and rodent control measures instituted.
C.1.2.4. Mounds Landscaping Services C.1.2.4.1. Mounds Background This contract effort consists of maintaining the one-of-a kind landscaping (architectural) “art” that was designed by landscape architect Martha Schwartz expressly for the Minneapolis Courthouse. The design consists of 22 earth-sculptured mounds that harbor specialized and unique plant life, including trees, logs and various grasses. All of the mounds were completely reconstructed in 2003 and covered with new custom grown grass, with a planting method using the product “Netlon”, and the jack-pine trees that were salvaged from the old mounds. The earth mounds on this plaza harbor unique conditions that will require a high degree of expertise and experience to maintain. Each mound has common construction ingredients, including a built-up foam core, 6-8 inches of topsoil, the Netlon fibers to help the grass roots adhere to the mound, and Turf Guard plastic netting above the ground to support the grass. Each mound is afforded the benefit of landscape sprinklers. Due to the varying degrees of sun and shade each mound receives, they must be considered as separate entities. The unique microclimates that exist on these mounds will require frequent monitoring and close observance. When there is too much rain, or too little;
when there are clear skies or cloudy; when there are rodents or pests moving in and about; all of these conditions will require varied actions across the spectrum of microclimates. Frequent monitoring may be required during periods of high stress. The contractor shall provide the management, supervision, manpower, equipment and supplies necessary to provide landscaping services as described herein.
Pictures showing the acceptable appearance of the mounds, grasses and trees are included in this scope.
C.1.2.4.2.
Mounds will be well maintained and free of weeds or bare areas. Contractor will overseed, dethatch as necessary to prevent bare areas and promote even growth of turf areas. Mounds will be maintained at a height of 5-8 inches. Growth of moss between the granite pavers at the Rockman statue shall remain as it is intended to be part of the artwork display. Damage caused by rodents shall be repaired and rodent control measures instituted.
C.1.2.4.3. Special Mounds Requirements Requirements: This section includes the following: Turf Care, Tree Care, Irrigation, and Sprinkler System Operations. General: The following are guidelines and recommendations for care and landscaping maintenance of the mounds on the Courthouse Plaza. Due to the atypical nature of this landscape, the contractor should be a professional maintenance provider capable of evaluating and implementing the following guidelines when appropriate. The intended vision of the mounds is to have “shaggy” grass that still has a cared for and full appearance, as shown in the following pictures:
C.1.2.4.3.1. Turf Care C.1.2.4.3.1.1. Watering:
Infrequent, deep waterings are recommended to promote deep root growth in the turf. A deep root system supports a healthy turf cover that will keep out weeds, resist pests and survive in the extreme conditions of this site. The settings on the automatic sprinkler clock should be changed frequently and monitored according to weather conditions and actual soil moisture conditions. Since both woody plants and sod are watered by the same irrigation system, it is possible to kill the trees and shrubs by over watering due to the fact that bluegrass sod can tolerate severe over watering without showing negative effects. Irrigation clock settings should be seasonally adjusted to avoid over watering and under watering. See the section on irrigation for a recommended starting point for seasonal watering amounts. A rain gauge/sensor is available for use in conjunction with scheduling of the sprinkler system. After heavy rains, manually turn off the irrigation system for several days. In addition, the contractor will always consider sustainable practices when scheduling sprinkler system use and discuss and coordinate frequency of watering with the COR.
C.1.2.4.3.1.2 Turf Mowing (Trimming):
In keeping with the original design intent, the turf should be maintained to a height of no less than five inches and no more than 8. The desired look is a natural, “shaggy” appearance. A weed-whip type mower is recommended with some thoughtful and careful use by the operator. The bases of the trees and sculptures (The Rockman) must be avoided as a weed whip can damage the bark and sculptures. Do not mow off more than 1/3rd of the grass blade height at one time. If the mound grass gets away from you it will require several trimmings spaced a few days apart. When the mound grass reaches over 8” or starts to show seed heads, it should be trimmed. It is desirable to leave grass clippings on the mound. This is a source of fertilizer. The clippings should be collected if growth has been excessive and creates an unsightly appearance after trimming.
C.1.2.4.3.1.3 Turf Fertilization:
Fertilizers shall be made from alfalfa meal, blood meal, cottonseed meal, feather meal, fish meal, meat and bone meal, poultry manure/litter, soybean meal, wood ash and other recovered organic materials. It shall contain the highest percentage of recovered materials practicable, while maintaining a satisfactory level of competition. Apply a quality, high nitrogen lawn food (25-35% nitrogen) at the rate of 1.0 pounds actual nitrogen per 1,000 square feet. An organic based fertilizer is recommended such as “Synchronicity” or “Ringer”. When working with these elements, it is important to evaluate nitrogen separately from the other nutrients. All are necessary, but nitrogen is the most important and is the element that is most often limiting and can-do damage to turf if applied excessively.
C.1.2.4.3.1.4. Turf Weed and Disease Control:
Apply pre-emergent herbicide in the spring to prevent crabgrass and other annual weeds. Good seasonal weed control can be achieved by using sound cultural practices along with the judicious use of herbicides.
Periodical spot spraying with a biobased herbicide or hand pulling is an ecologically sound answer to limiting weed problems. Control turf diseases by applying biobased fungicides as needed. The turf should be kept free of weeds, diseases, and insects at all times. All herbicides, fungicides and insecticides will be biobased to comply with USDA guidelines unless approved by the COR.
C.1.2.4.3.1.5. Pest Control:
The meadow vole or field mouse constructs well-defined, visible surface runways through turf areas measuring about 1-1/2 to 2 inches wide. Vole runways in turf are formed by a combination of the vole eating the grass blades and its constant traveling over the runway. These creatures also spread excavated dirt from the burrow system in the runway, causing a dirt-bare path in some areas. Zinc Phosphide is the most used toxicant for vole control. It is a single dose toxicant available in pelleted and grain bait formulations. The anticoagulant bait used against house mice and rats are also effective in controlling voles, but multiple feedings are needed for most anticoagulants to be effective. Thiram-based repellents such as “Shotgun” and “Rabbit Repellent” can be effective against voles, but they need to be re-applied frequently so the voles don’t become accustomed to the smell. Keep in mind as well that thiram should not be used on garden plants. Because of this, predator urines are recommended instead as the vole repellent of choice. Predator odors are most displeasing to voles. Fox and coyote urines can often be purchased at trapper supply houses.
C.1.2.4.3.1.6. Spring Start Up:
Each year, some of the mounds experience winter grass kill due to freezing or the sliding of topsoil from the top to the bottom of the mounds. It is important to get an early start on reseeding and caring for these areas. Multiple reseeding efforts may be necessary over the course of the growing season.
C.1.2.4.3.2. Tree Care C.1.2.4.3.2.1. Watering of Trees:
Correct watering is critical for the survival of the trees. Under watering or over watering will cause the failure of these plants. For a minimum of the first two years after installation, trees will require careful monitoring of the soil moisture to a depth of 20 inches. This is best accomplished using a 24-inch electronic soil moisture probe or a sampling tube. The soil should be moist, but not saturated with water.
C.1.2.4.3.2.2. Pruning of Trees:
After one year of growth, the new Jack Pine should be pruned and “topped off” to match the existing trees in the plaza. The bottom low growing branches should be pruned up to a minimum of one foot above the soil line to prevent problems with the turf. Remove any broken or crossing branches and provide adequate clearance for pedestrians, vehicles, and signage.
C.1.2.4.3.2.3. Fertilization of Trees:
Liquid deep-root feeding is the preferred method of tree fertilization. Deep root fertilization involves injecting a liquid or granular fertilizer into the root zone of the tree and provides both fertilization and valuable aeration. It is an excellent way to provide nutrients and micronutrients to the tree. While no immediate response is generally seen, the long-term effect of proper fertilization to the plantings is valuable. If trees are showing signs of stress from nutrient deficiency, they will gradually improve.
Properly fertilized trees and shrubs can fight off pests and disease. All trees should be fertilized once annually. Fertilize either in the spring (April-May) or perform late fall deep root fertilization. Do not use “Tree food spikes”.
C.1.2.4.3.3. Irrigation:
C.1.2.4.3.3.1. General Information:
Improper irrigation management and control during any growing season can result in rapid decline in plant and turf health. During the first couple weeks following the laying of sod and the planting of trees, zone-by-zone monitoring of irrigation is a must. Deep, infrequent waterings are recommended, more often in the summer and less frequent in the spring and fall with consistent adjustments, as current weather conditions require. There is a fine line between dry and adequately moist, and between adequately moist and wet.
C.1.2.4.3.3.2. Site Differences:
