About this file

This is a Question, Inquiry and Response Document for RFP 3379, a Request for Proposal issued by a Wisconsin school district's Food & Nutrition department to procure produce for the 2017 summer feeding program. The solicitation seeks qualified vendors to supply produce during the summer session, though specific quantities, response deadlines, due dates, site visits, bidders' meetings, and contract terms are not detailed in this particular document excerpt.

The document addresses vendor inquiries regarding price adjustment mechanisms post-award. The district's response indicates that vendors may request reasonable price increases if unforeseeable adverse circumstances create extreme changes in production costs, provided supporting documentation is submitted. However, the district retains discretionary authority to accept, reject, or renegotiate any proposed price changes. This provision establishes a framework for addressing force majeure or market volatility while preserving the district's flexibility in contract administration.

RFP 3379 – Farm to School Produce

Vendor Questions/Inquiries and Responses 1: Is there an opportunity for a vendor to increase prices after the contract award as a direct result of adverse market conditions (i.e. act of god clause) by providing supporting documentation as such? Or an opportunity to include this clause in the RFP for all?

RESPONSE:

In the event that unforeseeable adverse circumstances create an extreme change in vendor's cost to provide the produce, a vendor may request a reasonable change in price. District will consider any documentation in support of such a request, but shall retain reasonable discretion on whether to accept, reject or re-negotiate any price changes.
