About this file
This document is a Service Level Agreement (SLA) amendment from the Michigan Department of Corrections (MDOC) for RFP 260000001299 regarding the supply of fabrics, clear vinyl, bed and bath linens for Michigan State Industries (MSI). The amendment establishes revised performance metrics for contractor delivery obligations, specifying that all deliveries must be completed within 30 calendar days from the receipt of order or as pre-approved in writing by the MDOC Program Manager. Contractors are required to submit their proposed delivery date via email within two business days of receiving an order. The acceptable standard for compliance is 100%, and performance will be monitored using monthly order and delivery reports, internal MDOC data from SIGMA accounting systems and Global Shop Solutions Enterprise Resource Planning application, correspondence with MSI staff, and delivery correspondence from the contractor.
Failure to meet the 30-calendar-day delivery deadline results in service credits assessed at 1% of the delivery order total beginning on day 31 and continuing daily until completion, with a maximum cap of 95% of the order value. Service credits do not apply when the MDOC Program Manager provides written pre-approval for late delivery. If the State must purchase materials from an alternate vendor due to contractor non-performance, any costs exceeding the contracted rates will be deducted from SLA credits, with the combined overage and SLA credits not exceeding the delivery order value. The MDOC Contract Manager may review extenuating circumstances before assessing service credits. At the State's discretion, credits may be applied to future payments due to the contractor or paid directly to the State within 10 days of demand.

Definition and Purpose:
1. The State requires that deliveries be made within 30 calendar days the agreed upon timeframe(s) in Schedule A, 2.1, A from receipt of order, or as pre-approved in writing by the MDOC Program Manager(s). The receipt of order date is pursuant to Section 2, Service Levels, of the Statement of Work.
2. The Contractor must submit its Delivery Date, via email, within two business days of receipt of the order to the Program Manager(s) and Contract Monitor.
Data Sources:
1. Monthly Order and Delivery Reports provided by the Contractor.
2. Internal MDOC data from SIGMA (The State of Michigan’s accounting application).
3. Internal MDOC data from Global Shop Solutions (Michigan State Industries’
4. Enterprise Resource Planning application).
5. Correspondence with Michigan State Industries staff.
6. Delivery correspondence from Contractor.
7. Written pre-approval correspondence of a late delivery from MDOC Program Manager(s).
Methodology:
The MDOC will review Data Sources 1-7 as needed.
Acceptable Standard:
The Acceptable Standard is 100% compliance.
Amount for Failing to Meet Service Level Agreement:
Deliveries are due within 30 calendar days from receipt. Deliveries after 30 calendar days are considered late. 1% of the Delivery Order total will be assessed on day 31 and every calendar day thereafter until the delivery is completed up to 95%. If the MDOC Program Manager(s) provides a written pre-approval of a late delivery, the Service Credit does not apply.
SLA credits will not exceed the value of the delivery order (DO) at issue. Additionally, if the State must purchase materials from an alternate because the contracted vendor cannot deliver within the bid timeframe, any costs above the contracted rates to acquire the new material will be set off from SLA credits. The combination of overage and SLA credits will not exceed the value of the delivery order at issue.
Extenuating circumstances will be reviewed by the MDOC Contract Manager before any Service Credits are assessed. At the discretion of the State, these credits may be applied toward any payable due to the Contractor or be payable directly to the State. Payments made directly to the State will be completed within 10 days upon demand.
