CEC will identify additional award-specific requirements before award or by written task authorization. A requirement listed below applies when triggered by the nature, value, or funding of the work.
Requirement Area Contractor Requirement
2 C.F.R. Part 200 Comply with applicable Uniform Guidance requirements, including procurement standards, internal controls, cost principles, contractor oversight, records, and Appendix II contract provisions.
Full and open competition Do not take actions that restrict competition. Disclose actual or potential conflicts and organizational conflicts. A contractor that develops or drafts this solicitation, its specifications, or its statement of work is ineligible to compete when applicable under 2 C.F.R. 200.319.
Contract pricing Cost-plus-percentage-of-cost and percentage-of-construction-cost methods are prohibited. Any time-and-materials or labor-hour element requires a ceiling price and the findings and oversight required by 2 C.F.R. 200.318(j). The contractor exceeds the ceiling price at its own risk, and CEC shall not be liable for costs incurred above an authorized ceiling.
Price and cost documentation Provide information needed for CEC's independent estimate, price or cost analysis, and negotiation of a fair and reasonable contract price.
Responsibility and exclusions Maintain required licenses and capacity and remain eligible for federal awards. CEC will verify exclusions in SAM.gov before award. Flow down debarment requirements to covered lower-tier transactions.
Socioeconomic affirmative steps When subcontracting, take the affirmative steps required by 2 C.F.R. 200.321 to provide opportunities to small businesses, minority businesses, women's business enterprises, veteran-owned businesses, and labor surplus area firms.

During field investigations, upon discovery of any potential archaeological or cultural resource, immediately cease work in the affected area and notify CEC. Do not locate access routes, staging, equipment, or storage in or in a manner that impacts adjacent wetlands.
Access and retention of records Provide authorized federal, state, pass-through, audit, and CEC representatives access to records and retain records, including any records of any subcontractor or consultant paid under this contract, for the period required by 2 C.F.R. 200.334, the award, applicable law, and the contract, whichever is longer.
Flow-down requirements Include every applicable federal clause and award requirement in subcontracts and lower-tier agreements and remain responsible for subcontractor compliance.
Merit-based selection
All procurement and employment actions funded in whole or in part with federal funds shall be identity-neutral and merit-based, with no demographic preference, quota, or workforce-balancing requirement. Subcontract awards shall be based solely on technical merit, cost-effectiveness, and demonstrated ability to perform. Flow down to every subcontract and purchase order. See Attachment A.23.
