I. Introduction

The Contractor must monitor between 400 and 1000 Department of Toxic Substances Control (DTSC) sites throughout California that have institutional controls in place. The monitoring system must include the following services:

A. Monitoring available sources of information to identify in advance planned activities that could impact a site or the integrity of environmental restrictions in place at a site.

Example information sources include, but are not limited to, “call-before-you-dig” or “one-call” services, building permits, dredging permits, real estate listings, sensitive use permits, California Environmental Quality Act (CEQA) projects of both statewide and local significance, water well permits, and planning or zoning changes;

B. Alerting DTSC in advance of planned activities which could impact the site or the integrity of the environmental restrictions on a site. Such impacts include, but are not limited to, disturbances of remedial components, changes in land use, property transactions which could potentially affect contaminant location, containment systems, the location of underground remedy components, and exposure of the public, workers, or ecological resources to remaining contamination at a site;

C. Electronic notification to DTSC project staff of all planned events where a DTSC site may reasonably be impacted; and

D. Provide active hyperlinks to the Institutional Controls (ICs) and the EnviroStor public profile (webpage). Envirostor is DTSC's data management system that includes an online repository for documents for site cleanup projects (https://www.envirostor.dtsc.ca.gov/public/deed_restrictions).

This monitoring must be maintained year-round for all sites DTSC chooses to enroll.

DTSC may choose to begin or cease monitoring sites at its discretion, and the Contractor must be able to set up monitoring at a site within two (2) weeks of being provided the required information from DTSC. For setup of new sites, DTSC will provide the Contractor with general or specific boundaries of the area of concern, a list of institutional controls in place and the activities they restrict, and the DTSC staff assigned to the site that should be contacted if a potentially harmful activity is identified by the Contractor.

Records of sites monitored, potentially harmful activities identified, and alerts issued to DTSC staff must be kept by the Contractor and must be able to be made accessible to DTSC staff upon their request.

Questions Max Points

Question 1: Describe the team to be assigned to this project. List project managers, supervisors, key technical personnel, and subcontractors and their proposed role within the project. Include education, licenses, credentials, training, and experience of key personnel.

Question 2: DTSC is interested in continuous remote monitoring of at least several hundred sites with land use restrictions that are located across the state of California. Monitoring must be able to detect events that may violate land use restrictions before they occur, including soil-disturbing activities, and notify DTSC project managers electronically (refer to the Scope of Work). Describe how your organization has achieved monitoring of this type in the past by answering the following sub-questions:

Describe the process in which activities potentially violating land use restrictions are identified in advance of their implementation, aside from in-person site inspections.

Describe how electronic notifications, including contact information for entities performing the triggering activity, are generated and distributed to the monitoring parties.

Discuss how your organization can perform this monitoring simultaneously across all 58 counties of California.

Question 3: DTSC currently has approximately 450 sites monitored through a contractor. Lapses in monitoring of these sites can result in potentially unaware parties being exposed to and disturbing contaminated media.

Describe how your organization will be able to efficiently set up and begin monitoring of these sites in the manner described in the Scope of Work so as to ensure a smooth transition with minimal monitoring downtime, and provide an estimated timeframe for this transition.

Discuss how your organization will go about gathering the necessary information and setting up these sites for monitoring in a timely manner.

Provide an implementation timeline. 5

Question 4: Describe how active hyperlinks to sites' public EnviroStor webpages and to the relevant institutional control documents will be provided to involved third parties (e.g. contractors planning to perform restricted activities at a monitored site).

Question 5: Describe the interface that will be available to DTSC staff to check on their assigned sites in a way that achieves the Scope of Work.

Question 6: Discuss a prior successful experience in performing monitoring of the type described in the Scope of Work, including examples of specific sites monitored and a description of the level of effort required by the project team.

If deemed necessary by DTSC, at its sole discretion, the following omitted and/or additional information may be collected by mail, facsimile, or other method:

1) Copies of any form submitted without a signature. This provision does not apply to unsigned Bidder Certifying Statements (Attachment 2) and Bid/Bidder Certification Sheet (Attachment 3).

4) Subcontracting Subsequent to Contract Award

If, at any time during the term of the contract, DTSC or the Contractor require the previously unanticipated expertise of a specialist(s) to provide services contemplated in this RFP, upon agreement by both parties and under the direction of the Contractor, a subcontractor(s) relationship may be established at DTSC expense and the fee negotiated at the time the subcontracting relationship is established.

government in response to Russia’s actions in Ukraine, as well as any sanctions imposed under state law. The EO directs state agencies to terminate contracts with, and to refrain from entering any new contracts with, individuals or entities that are determined to be a target of Economic Sanctions. Accordingly, should the State determine Contractor is a target of Economic Sanctions or is conducting prohibited transactions with sanctioned individuals or entities, that shall be grounds for termination of this agreement. For avoidance of doubt, the term “materially impacts” shall have the meaning set forth in State Administrative Manual (SAM) § 4986.2 Definitions for GenAI.

Failure to report GenAI to the State may result in disqualification. The State reserves the right to seek any and all relief to which it may be entitled to as a result of such nondisclosure. Upon notification by a Bidder / Offeror of GenAI as required, the State reserves the right to incorporate GenAI Special Provisions into the final contract or reject bids/offers that present an unacceptable level of risk to the State.

Government Code 11549.64 defines “Generative Artificial Intelligence (GenAI)” as an artificial intelligence system that can generate derived synthetic content, including text, images, video, and audio that emulates the structure and characteristics of the system’s training data.
