4. STATEMENT OF WORK
4.1 Background
The Civil Rights Department (CRD) is the largest state civil rights agency in the country operating out of six offices throughout California. CRD’s mission is to protect the people of California from unlawful discrimination in employment, housing, business establishments, state-funded programs and activities, and from hate violence and human trafficking. To accomplish this mission, the CRD investigates, mediates, and prosecutes complaints of https://www.caleprocure.ca.gov/pages/Events-BS3/event-search.aspx https://www.caleprocure.ca.gov/pages/Events-BS3/event-search.aspx alleged violations of the Fair Employment and Housing Act (FEHA), Unruh Civil Rights Act, Disabled Persons Act, Ralph Civil Rights Act, Trafficking Victims Protection Act, and statutes prohibiting discrimination in state-funded activities and programs. CRD also engages in significant public outreach and education to inform Californians about their rights and obligations in order to help prevent discrimination and harassment from happening at all. To learn more about CRD, visit www.calcivilrights.ca.gov.
Currently, CRD has numerous styles of written educational resources. The Department recognizes, however, the necessity of engaging the public with content utilizing different types of media to better target people with lower levels of literacy, diverse learning styles, and/or different preferences for how they consume information. CRD would also like to leverage the department’s social media presence with new, innovative, and dynamic content.
Therefore, CRD seeks a contractor to produce educational videos. These videos will be short in duration, easily understood by diverse groups of Californians, and engaging. They will inform the public of their right to live in California free from unlawful discrimination and how CRD can protect this right.
4.2 Objectives, Tasks, Deliverables, and Other Details
The Contractor shall meet the Objectives, Tasks, Deliverables, and all other details specified in this RFP.
4.2.1 Objectives
Over a two-year timeframe with the potential to extend for a third year and with an estimated budget of $160,000, CRD seeks a contractor to produce original educational videos. The videos shall range in length depending on the subject matter and objective, including: at least twenty (20) short (90 seconds or less) “explainer” videos on discrete topics that would be appropriate for play on mobile devices such as smart phones and social media platforms and five to ten (5-10) (1.5 to 3 minutes) videos to educate the public on more dense topics for use in broader educational campaigns and initiatives. These videos must be in English and at least 10 will also be translated into Spanish. These videos should be dynamic, innovative, and most importantly, accessible to people with a wide variety of educational levels, demographics, and learning styles. The topics of the videos may include:
• The Mission and Responsibilities of CRD
• The CRD Complaint Process
• Housing Discrimination
• LGBTQ Rights
• Employment Discrimination
• Reasonable Accommodations in Housing
• Reasonable Modifications in Housing
• The Unruh Civil Rights Act
• Fair Housing and Criminal History
• The Fair Chance Act
• The Rights of Transgender Employees
• Legal Protections for Pregnant Workers and New Parents
• Source of Income Discrimination
• Immigrant Rights
In order to be considered, bidders should address how they would approach creating these videos to meet these objectives. We are particularly interested in creative approaches to translate dense materials and subjects into videos that will appeal and be accessible to people with various educational levels, learning styles and demographics.

8. OTHER IMPORTANT INFORMATION FOR BIDDERS
8.1 Confidentiality of Bids
Bids are considered public records. Marking a document “CONFIDENTIAL” or “PROPRIETARY” will not preclude the document’s release unless so ordered by a court. The content of hardcopy and electronic work papers and correspondence disclosing any part of a bid will be held in the strictest confidence until the Notice of Intent to Award is posted.
8.2 Payment
Only allowable costs stated in the submitted cost sheet will be incorporated into the final contract.
Any invoiced items that are not included in the cost sheet will be denied.
For most services rendered by the Contractor, invoices for partial payment shall be processed after completion and acceptance of key project deliverables indicated in Key Action Dates (Section 1).
If subcontractors execute components of the Agreement, the Contractor may submit invoices only after the subcontractor has invoiced the Contractor.
All invoices for services directly performed by the Contractor shall be subject to 10% withholding as required by the State Contracting Manual (Volume 1), Sections 5.35 (3) and 7.33 with the balance paid after all deliverables under the contract have been completed by the Contractor and accepted by CRD.
8.3 Change Orders/Administrative Changes
A written amendment is required for changes to the subsequent Agreement. For administrative issues not specifically identified in the Agreement and/or notification of issues (see section 7: Required Proposal Elements and Information), CRD and the Contractor shall meet to discuss if the changes require a contract amendment.
9. EVALUATION PROCESS
A responsive bid is one that meets or exceeds the RFP’s minimum requirements and includes all required documentation.
A Secondary RFP is based on “best value” to the State: the offer that best meets the Statement of Work requirements, reflects the desired professional credentials, and demonstrations the Bidder’s ability to provide high quality deliverables at the most reasonable overall cost involving no or an acceptable level of risk.
9.1 Overview
CRD will conduct an initial bid compliance check (administrative review) to determine whether a Bidder’s package conforms to the RFP submission requirements, including as follows:
A. All documents are included and properly signed in the proposed bid;
B. All forms listed on Attachment #1 – Proposal Checklist are submitted to include Preference
Program documentation for Small Business, Micro-business, Disabled Veteran Business Enterprises, Non-Small Businesses sub-contracting with Small Business, and Target Area Contract Preference Act (TACPA), if applicable.
If the proposal package does not meet the submission requirements or is incomplete, then those bids may not be forwarded to the Evaluation Panel. Any non-compliant bidder shall be notified in writing explaining why their bid did not advance to Phase I.
During the evaluation phases, CRD will evaluate bids and analyze costs to determine responsiveness to the CRD’s needs. An Evaluation Panel comprised of no less than three (3) CRD personnel will determine the Bidder who will be awarded a contract.
The Bidder’s package will be evaluated under the specified rating criteria in Phase I and II.
The Bidder who meets the minimum requirements and has the highest adjusted score, after application of preferences and incentives points shall be awarded the contract.
The evaluation sequence is summarized in the following table:

DESCRIPTION
1 All or most of the requirements in the response do not meet minimum requirements for the criterion evaluated.
2 Most, but not all of the requirements in the response meet minimum requirements for the criterion evaluated - or - the response for the criterion is incomplete or unclear and therefore, does not meet minimum standards.
3 The response meets the minimum requirements for the criterion evaluated.
4 The proposal provides one or two qualitative and/or quantitative attributes that exhibit best industry practices, superior experience, knowledge, and execution, and/or possess one or two quantitative attributes superior to other Bidders.
5 The proposal provides multiple (more than three) qualitative attributes for the criterion evaluated and exhibit best industry practices, superior experience, knowledge, and execution, and/or more than three quantitative attributes superior to other Bidders.
Average Score by each Criterion
The average score for each criterion shall be calculated by summing the total of each evaluator’s score and dividing by the number of evaluators.
Weighted Score by each Criterion
The total points awarded for evaluation criteria in Section 9.1.2. are weighted in multiples of 5 (Example: 5, 10, 15, 20).
The evaluation criteria with higher weighting will receive a proportionately higher score.
9.3 Phase II: Cost Evaluation and Final Scoring
CRD shall (1) verify any claims for socio-economic preferences and incentives and (2) compute the total points for each bid proposal. The Bidder with the highest overall score will be awarded the contract.
9.3.1 Cost Evaluation
Each Bidder’s total cost for all services will be ranked from low-to-high. The proposal with the lowest total cost will be awarded the total (100%) points listed for the cost evaluation specified in Section 9.1.
The remaining proposals will award a proportional number of points. The cost points shall be calculated using the methodology under SCM (Volume 1) Section 5.25 and as described in the example below:
Total Cost Points Allocated = 30 Points
Proposal 1 = $75,000 (Lowest Cost) Proposal 2 = $100,000 Proposal 3 = $120,000
Proposal 1 = $75,000/$75,000 = 1.00 Cost Points awarded: 1.00 X 30 = 30 points Proposal 2 = $75,000 /$100,000 = .75 Cost Points awarded: .75 X 30 = 22.5 points Proposal 3 = $75,000 /$120,000 = .625 Cost Points awarded: .625 X 30 = 18.75 points
9.3.2 Socio-economic Adjustment for Small Business Preference Program
The calculation and adjustment for Small Business preference points is subject to the provisions of the Small Business Preference Program.
If the highest point score prior to socio-economic adjustments is a certified small business, and no small business is claiming a DVBE incentive, the award is made to the small business with the highest point score and no adjustment for the small business preference program is made.
Small business preference points will be calculated by multiplying 5% with the highest unadjusted non- small business total score; the points calculated shall be added to those bids who qualify under the Small Business Preference program.
Note: If the highest point score is a certified small business, then the award is made to the small business and no adjustment for the small business preference program is made.
9.3.3 Socio-economic Adjustment for Disabled Veteran Business Enterprise (DVBE) Incentive
Program
The calculation and adjustment for DVBE points is subject to the provisions of the DVBE Incentive Program. An intended award to a DGS certified small business cannot be displaced as a result of the award of DVBE incentive points.
If the highest point score prior to socio-economic adjustments is a certified small business, and no certified small business is claiming a DVBE incentive, then the award is made to the small business and no adjustment for the DVBE incentive program is made.
If the highest point score is a certified small business after the small business preference calculation and certified small businesses are claiming a DVBE incentive, then the DVBE incentive points will be only be calculated for the certified small businesses.
If the highest point score after the small business preference calculation is NOT a certified small business, then the DVBE incentive points will be calculated for all Bidders.
Certified DVBE Bidders will be awarded the maximum incentive of 5%. Non-DVBE Bidders who sub-contract to a certified DVBE may receive up to 5%, based upon the percentage value of the bid that the Bidder commits to sub-contract to a specified and certified DVBE sub-contractor. The DVBE incentive points are added to the total technical score.
Note: The application of DVBE incentive points may not displace an award to a DGS certified Small Business; however, a non-small business Bidder that receives a 5% small business incentive using sub-contractors may be displaced by the application of the DVBE incentive.
Disabled Veteran Business Enterprise Program (DVBE) Participation Requirement For the purpose of this solicitation, the DVBE participation requirement has been waived.
DVBE Incentive For the purpose of this solicitation, the DVBE participation requirement has been waived, however;
the DVBE Incentive for the prime bidder will be applied. There is an incentive for DVBE participation up to 5% of the Technical and Cost points. DVBE Incentive Points are awarded after the Small Business Preference is considered. The award of DVBE incentive points cannot be used to achieve any applicable minimum point requirements. Example: The example below is based upon total Technical & Cost score of 200 points.
Note: If there is a minimum requirement of 3%, then the DVBE Incentive Points box should state “Non-Compliant” in the three rows with percentages below 3%.
