About this file

This document is a Request for Proposal (RFP) issued by the City of Fairburn, Georgia for an Impact Fee Study. The city is seeking the services of a qualified firm, partnership, joint venture, or team to produce an impact fee study and set fees for an impact fee program in 2023. The RFP provides details on the scope of work, including delivering an impact fee study, analysis of services to be covered, detailed calculations of impact costs, development of an impact fee ordinance, guidance on program administration and creating a Capital Improvements Element, and a written assessment of how the impact fee program could assist the city's affordable housing goals. Proposals are due by 2:30 PM on November 30, 2023, and the city anticipates making a single award within 60 days. The RFP outlines the evaluation criteria, including staffing capacity, availability, understanding of the project, experience working with government and stakeholders, and financial stability of the firm.

The RFP specifies that the fee proposal will be evaluated for completeness and reasonableness, and the city intends to select the proposal that provides the best value, not necessarily the lowest price. The successful firm will be required to comply with all applicable legal and insurance requirements, and the city reserves the right to reject any or all proposals and negotiate changes to the scope of work or services.

EVALUATION FACTORS

The city will evaluate the proposals based on technical merit. It is the intent of the city to choose the firm whose proposal provides the best value to the city. Consultant firms or teams are expected to represent the diversity of the community. Such diversity should be reflected in aspects such as ownership, professional personnel, consultants, and staff.

Evidence of such diversity should be part of the submittal.

Oral Presentations and Interviews. Following the evaluation of the proposals, the Evaluation Team may request a limited number of firms to make oral presentations and/or be interviewed. If a determination is made that presentations are necessary, the presentations will take place in the City of Fairburn at a mutually acceptable date and time. At present, it is expected that presentations will take place during the month of January 2024, or earlier.

Negotiations. Following any presentations, the finalists shall be re-evaluated. The city may negotiate with the firm whose proposal is determined to be most advantageous to the city. If negotiations with the selected firm fail, negotiations shall be initiated with additional firms until an agreement is reached. The City reserves the right to reject all offers and end the process without executing a contract.

Agreement. If the negotiation produces mutual agreement, the draft agreement included with the

RFP shall be completed and forwarded to the firm for execution. The draft agreement format will be the only acceptable document for execution.

As described in the draft agreement, the successful firm and its subcontractors must comply with the agreement’s prohibitions against conflicts of interest and contingent fees. The successful firm shall require each of its subcontractors to comply with all applicable terms of the agreement.

The City reserves the right to accept a proposal, as submitted, and enter directly into a contractual agreement with that selected firm. Accordingly, it is imperative that all submittals contain both the best technical and fee proposals in their initial submission.

Reservations. Submittal of a proposal indicates acceptance of the conditions contained in this request.

The City of Fairburn reserves the right to retain all proposals submitted. All proposals are public record to the extent required by the Georgia Open Records Act.
