4.2 Protest of Contractor Selection or Contract Award
Any Proposer who believes they may be adversely affected or aggrieved by the College's award of the contract to another Proposer shall have seven (7) calendar days after issuance of the Notice of Intent to Award documents to submit to the College a written protest of the award. The written protest shall specify the grounds upon which the protest is based. In order to be an adversely affected or aggrieved Proposer with a right to submit a written protest, a Proposer must itself claim to be eligible for award of the contract as the lowest responsive and responsible Proposer and must be next in line for award. The protester must claim that all lower Proposers are ineligible for award: (a) because their proposals were nonresponsive or (b) as a result of the College committing a material violation of a solicitation provision or of an applicable procurement statute or administrative rule, the protester was unfairly evaluated and would have, but for such material violation, been the lowest responsive and responsible Proposer. The College shall not entertain a protest submitted after the time period established above.
4.3 Consideration of Proposals
It is the intent of the College to award the contract to the most advantageous responsive and responsible Proposer as defined by OAR 137‐047‐0500. To be considered for this award, proposals must be submitted in accordance with all specifications and requirements of the solicitation documents and the Proposer must demonstrate that adequate resources are available to fully provide the services required.
In determining the highest ranked responsive and responsible Proposer, the College shall, for the purpose of awarding the contract, add a percent increase onto the proposal of a nonresident Proposer equal to the percent, if any, of the preference given to that Proposer in the state in which the Proposer resides per ORS 279.A.120.
The College reserves the right to waive any or all informalities and irregularities, to reject any proposal that does not comply with all the prescribed procedures and requirements in this Request for Proposal, and the College may, for good cause, reject any or all submissions, upon a finding of the College that it is in the public interest to do so.
The College reserves the right to cancel the procurement in accordance with ORS 279B.100.
4.4 Addenda
Changes to proposal documents shall be accomplished by addenda. Proposers shall acknowledge receipt of any addenda issued by email or other formats to the College’s sole point of contact within 48 hours of receipt of an addendum. Addenda shall be sent to all prospective Proposers known to have received the Request for Proposal documents and published on the Oregon’s Web based Purchasing Information Conduit, OREGONBUYS. Addenda shall be issued within a reasonable time to allow prospective Proposers to consider the addenda in preparing their proposals and not less than 48 hours before the sealed proposal opening time unless it is in the public interest to do so. If necessary, the College may notify prospective Proposers of addenda by email, fax or telephone. If telephone is used, the College shall confirm the oral notice with a written addendum. At its discretion, the College may extend the proposal opening date and time to allow prospective Proposers to analyze and adjust to changes made by addenda. The College shall notify prospective Proposers of the new sealed proposal opening date and time in the addendum.
4.5 References
The College reserves the right to investigate the references of any Proposer with respect to its successful performance of similar projects, compliance with specifications and contractual obligations, and its completion or delivery of a project on schedule. The College may postpone the award or execution of the contract before or after Notice of Award to complete its investigation. The College reserves the right to consider past performance, historical information, and fact, whether gained from the Proposer’s proposal, question and answer conference, references, or any other source in the evaluation process. The College reserves the right to reject any proposal or to reject all proposals at any time prior to the College’s execution of a contract in the event Proposer’s reference checks prove unsatisfactory. (See also 7.4 References)
4.6 Residency
All proposals submitted shall contain a statement as to whether the Proposer is a resident or non‐resident Proposer, as defined in ORS 279A.120.
