About this file

This document is an Addendum to the MMCAP Infuse Request for Proposals (RFP) for Pharmacy Vials and Containers, issued by the Minnesota Department of Administration on behalf of MMCAP Infuse. The addendum provides answers to two questions submitted by potential respondents. The first question clarifies that respondents have the option to offer indirect, direct, or both purchasing options, and that mentions of chargebacks only apply to indirect sales. The second question confirms that respondents should provide any initial redlines to the sample agreement in their RFP response, and that negotiations would then take place upon receipt of an Intent to Award.

The related state and local contract opportunity is for the MMCAP Infuse RFP 32077 - Pharmacy Vials and Containers. Responses are due by October 28, 2022, at 2:00 PM Central Time, and should be submitted via email to MMCAP_Infuse.RFP@state.mn.us with the subject line "Pharmacy Vials and Containers RFP Response". The contract will be awarded to serve the state of Oregon, specifically the jurisdictions of Marion County and Salem City.

Title: Pharmacy Vials and Containers

Scope of Addendum

The following are answers to questions submitted to MMCAP Infuse:

1. Question: The document outlines options about working with wholesalers as well as direct sales. Is the supplier allowed to utilize one or the other as opposed to both? Will this impact any mentions of chargebacks should the supplier choose to use direct purchasing options?

Answer: Should a responder win an award, they will have the option for indirect, direct, or both.

Mentions of chargebacks apply to only indirect sales.

2. Question: Are suppliers allowed to negotiate the sample agreement after the RFP has been awarded?

Answer: Responders should provide their initial redlines, if any, in their response. Negotiations would then move forward upon receiving an Intent to Award.
