The solicitation sought a contractor to provide mail order incontinence supplies and services, including nursing assessments, call center support, delivery services, and beneficiary education materials. The contract term is three, four, or five years with up to two one-year renewal options. The evaluation process consisted of three steps: technical evaluation (based on Statement of Work and staffing components weighted at 50 and 20 points respectively, plus a vendor questions worksheet weighted at 30 points), pricing evaluation for responsive proposals, and sample evaluation for alternate products at the State's discretion.
J&B Medical Supply Co. Inc. was recommended for award based on superior technical scores and best value determination. The company scored 82/100 for Michigan and 87/100 for Wisconsin, exceeding the 80-point threshold, while Binson's Hospital Supplies, Inc. scored 65/100 for Michigan and 61/100 for Wisconsin and was deemed non-responsive. J&B Medical's award is $59,744,033.65 for Michigan's five-year base contract term (reduced from the original proposal of $61,098,188.50 through price negotiations) and $21,854,930.67 for Wisconsin's three-year base contract term, pending State Administrative Board approval. The award recommendation was based on J&B Medical's superior value proposition, including emergency delivery capabilities via FedEx Custom Critical, a beneficiary Hold At Location program, multilingual support in over 200 languages and Braille, a mobile app for beneficiaries and caregivers, and an automated telephonic customer satisfaction survey system.

III. Evaluation Results
A. Binson’s Hospital Supplies, Inc.
The Evaluation Team determined that Binson’s Hospital Supplies, Inc. based on a score of 65/100 for MI and a score of 61/100 for WI did not meet the requirements of this RFP. This determination was accomplished by evaluating their responses to the Technical Evaluation Criteria.
1. Schedule A Statement of Work, Excluding Section 3. Staffing Section SCORE 19/50 for MI and a SCORE 19/50 for WI.
The Evaluation Team determined that overall, the responses were unsatisfactory, and the following deficiencies were noted:
• For the majority of the requirements where the Bidder response instructions in the RFP stated, “Bidder must acknowledge acceptance to Section ___ and describe in detail how this will be accomplished,” the Bidder’s proposal statement to acknowledge acceptance to the requirement was not evident.
Section 1. General Requirements 1.1.C.4. The RFP specifies “Upon notice from the Beneficiary or their authorized representative the Contractor must:
a. Deliver the correct product within 24 hours to the Beneficiary’s residence (as specified under Section 2.1)
b. Deliver the quantity balance of product within 24 hours to the Beneficiary’s residence (as specified under Section 2.1 Delivery and Timeframes).
c. Simultaneously issue a call tag for pick-up of incorrect product(s) by the Carrier. Service
Level Agreement credit(s) will be applied per Schedule A, Section 11. Service Level Agreement (SLA) and Service Level Credit Table.”
• The Bidder’s response to a. b. c. restates the requirements and refers to Section I, but the Bidder did not describe in detail how this would be accomplished, as required in the RFP, such as the process for expedited delivery of the correct product and quantity to the Beneficiary’s residence within 24 hours.
1.1.C.6. The RFP specifies “The Contractor must include in each shipment, at no additional cost to the State, educational information on proper skin care and product use as well as any other pertinent medical information to all new Beneficiaries and when the Beneficiary receives a product with a procedure code which has not been previously used by the Beneficiary.”
Bidder response “Binson's mails educational material and Beneficiary rights material within one (1) business day of completing the nursing evaluation.” “Ad-hoc materials sent by Binson’s include special product shipping instructions, a product on-hand/self-inventory request, manufacturer product changes, etc. Binson's agrees to produce and mail ad-hoc Beneficiary materials developed by the State when requested.”
• The Bidder’s response lacks the detail regarding the development of educational materials for new products. Furthermore, the response indicates the State will develop ad-hoc Beneficiary materials, however the RFP specifies “b. When a new product is added to the Contract, educational material regarding that product must be developed by the Contractor.”
The RFP specifies “d. The Contractor must provide translation and interpretation assistance of all product communication, both written and verbal, via an approved translation/interpretation service or on-staff translator/interpreter. Product communications include, but are not limited to: Contractor’s phone number, pamphlets, State approved educational materials, etc.”
Bidder response “For those Beneficiaries that do not speak English, Binson’s will ask for an English-speaking contact person and their phone number to represent the Beneficiary if one is available.”
• Binson’s asking a Beneficiary for an English-speaking contact to represent the Beneficiary is in conflict with United States Department of Health and Human Services standards. Utilizing a Beneficiary’s English-speaking contact as a representative is not an acceptable translation service. Refer to the Civil Rights Act of 1964-A. Title VI, U.S. Executive Order 13166 of 2013, Section 1557 of the Affordable Care Act.
1.1.D.1. Call Center The RFP specifies “e. The Contractor must have a back-up plan for servicing Beneficiaries in case of an unplanned shutdown of call center phone lines for greater than one hour.”
Bidder response “In the event of a call center facility issue, our in-person staff is able to transition to working from home within an hour.”
• The Bidder’s response is in reference to a facility issue and lacks the details of a backup plan for a call center phone line outage in the geographic region.
1.1.D.3. Documentation A. Prescription Requirements 1.-6.
(MI only): Bidder response: “Binson’s will review prescription signatures with the understanding that MDHHS requires signatures from an appropriate subspecialist for incontinent supplies for Children’s Special Health Care Services (CSHCS) and Medicaid Beneficiaries under the proposed Contract.”
• The Bidder’s response conflicts with the requirement and program policy, “2. A prescription from an appropriate subspecialist is required for Beneficiaries enrolled in Children’s Special Health Care Services (CSHCS) only.” Signature of a subspecialist is only required for CSHCS beneficiaries and is not required for Medicaid beneficiaries. (MI only)
1.1.D.5.1.d. Nursing Assessments
• The Bidder’s proposal response to 1.1.D.5.1. did not comprehensively address specific nursing assessment requirements which are key components of the Statement of Work.
o Bidder’s response to 1.1.D.5.1 lacks detail how these requirements for Michigan and Wisconsin will be accomplished, including differences in requirements, as specified in the Bidder response instructions.
Bidder response “Binson’s staff of registered and licensed practical nurses perform initial and renewal telephonic nursing assessments in accordance with the state’s required timelines and assessment needs. Binson’s has reviewed the requirements and criteria for completion of nursing assessments for Michigan and Wisconsin Beneficiaries pertaining to ages 3 through 20 and 21 and over and will complete assessments based upon this criteria.
o The Bidder’s proposal did not address or provide detail for the following requirements.
i. If voicemail is available, a message must be left with the Contractor’s phone number.
ii. Beneficiaries who are hearing impaired or who do not have access to telephone are contacted through TTY, written form, or other MDHHS-approved electronic format with a follow up within 15 days if the Contractor have not received a response.
iii. If there is no response to messages left for the Beneficiary, Contractor will send a contact letter to the Beneficiary and follow up in seven (7) days. If there is no response to the contact letter within seven (7) days, Contractor will make one more call to attempt to reach the beneficiary. If there is still no response, Contractor will leave the account active for 30 days from the last attempt to contact the Beneficiary. If there is still no response from the Beneficiary, the Contractor will send a final letter notifying the Beneficiary that their request has been closed and the ordering practitioner will be cc'd.
o Bidder response “Licensed staff (Registered Nurse or Licensed Practical
Nurse) will perform all assessments for all Beneficiaries utilizing the most recent revised nursing assessment tool and according to the State’s Beneficiary age requirements.”
Licensing requirements for Wisconsin were not specifically addressed.
Wisconsin law does not allow a Licensed Practical Nurse to perform assessments, for any age Beneficiary. The RFP Bidder Response Box for Section 1.1.D.5.1 instructed the Bidder to describe in detail how this will be accomplished, including differences in requirements for Michigan and Wisconsin. Based on the Bidder’s response, it was difficult for the JEC to determine if the Bidder was proposing to meet Wisconsin’s licensing requirements.
o The RFP specifies “v. Contractor must send customized sample packs at
Contractor’s expense to beneficiaries prior to shipping the orders, which allows the Beneficiary to participate in the process of choosing the product for their care.”
Bidder response “Upon completion of the assessment Binson’s will provide the appropriate product samples and product literature utilizing pre-made sample packets of contracted products in order to provide products that meet the Beneficiary needs and result in patient satisfaction.”
Bidder proposes to use pre-made sample packets but are not customized specific to the beneficiary’s needs. Contents of pre-made sample packets that are not pertinent to the Beneficiary may result in confusion and/or waste.
1.1.D.5.4.a. Pull-on brief renewal nursing reassessment time frames MI
• Bidder response does not provide the detail to address the criteria a. i.-v. specified for this section and does not acknowledge or provide the detail for how they will accomplish the requirements. The Bidder’s response does not comprehensively address all requirements for the continued provision of pull-on briefs for Michigan including Beneficiary status in regards to criteria a. i. through v. (MI only)
1.1.D.5.4.b. Pull-on brief renewal nursing reassessment time frames WI
• Bidder response does not provide the detail to address the criteria b. i.-v. specified for this section and does not acknowledge or provide the detail for how they will accomplish the requirements. The Bidder’s response does not comprehensively address all requirements for the continued provision of pull-on briefs for Wisconsin including Beneficiary status in regards to criteria b. i. through v. (WI only)
• The Bidder’s response is identical for both Michigan and Wisconsin and did not differentiate the detail of the process to address each specific state’s requirements for pull-on brief renewal nursing assessments.
1.1.G.4.b.ii RFP requires: “For denial of requests for CSHCS-only Beneficiaries:” 2. and 3.
• The Bidder’s response does not differentiate the Departmental Review Form for CSHCS-only beneficiaries. (MI only)
1.1.H. WI DHS Denial (Negative Action) Process The RFP specifies “2. The Contractor is required to discuss a denied PA request with the member and are encouraged to help the member understand the reason the PA request was denied.”
Bidder response “Bidder’s trained staff will be available for discussion regarding all denied prior authorizations.”
• In the Bidder’s response to this requirement, although they stated they will be available for discussion regarding all denied prior authorizations, part of the requirement of the RFP was for the Bidder to provide how they would accomplish it.
The Bidder did not provide detail on how the Bidder would accomplish a discussion with the Beneficiary. (WI only)
1.1.I. Complaint Process The RFP specifies, “4. c. The Contractor must maintain these records for seven years beyond the end of the Contract and make these records available upon request by the State.”
Bidder response “All complaint records will be maintained for six (6) years beyond the end of the Contract.”
• The time period specified in the proposal response (6 years) is non-compliant with the RFP requirement (7 years).
1.2 Quality Assurance Program
1.2.1. Beneficiary Records, the RFP specifies:
“g. This information is considered property of the State of Michigan or the State of Wisconsin and two electronic copies must be delivered to the State at the expiration or termination of this Contract unless otherwise indicated by the State. This applies to records of all beneficiaries serviced by the Contractor (current as well as beneficiaries no longer receiving services).
• The Bidder did not address this requirement in their response to Section 1.2.1.
however later notes under their response Section 2.3 Reporting where the Bidder’s response lacks confirmation that data and documentation collected to complete work for Wisconsin residents specified under the proposed Contract, is the property of the State of Wisconsin as well as acknowledgement that it is not the State’s responsibility to request, but it is the requirement the Contractor must return the documentation upon expiration or termination of the Contract.
h. All beneficiary records must be maintained and readily available for audit purposes for seven years beyond the last date of service, or in accordance with applicable State and federal requirements, whichever is longer.”
Bidder response, “Beneficiary clinical records are maintained for a minimum of six (6) years beyond the end of the contract and are readily available for audit purposes in accordance with State of Michigan requirements.”
• Based on the Bidder’s response, it is unknown to Michigan and Wisconsin if the Bidder is committing to maintaining Beneficiary records in the event the last date of service is in the last year of the Contract, in accordance with applicable State and federal requirements, whichever is longer.
1.2.6. Beneficiary Satisfaction Questionnaire/Survey
Bidder response “Binson’s understands its responsibility to participate with any follow-up activities required to address any problems identified or conduct follow-up surveys if survey feedback is not adequate…”
• However, the Bidder’s response lacks the details to address the RFP requirement that specifies “Documentation of the plan to address problems identified from the questionnaire/survey must be submitted to the Program Manager within 30 calendar days after the report is received by the Contractor.”
Section 2. Service Levels
2.1 Delivery and Time Frames
2.1.A. Deliver Products on a Monthly Basis to Beneficiary’s Residence The RFP specifies “b. i. For new Beneficiaries and those with medical changes requiring a nursing reassessment, products will be shipped within one business day, if received before 2 p.m., of the Contractor receiving the valid ordering practitioner’s prescription and completing a nursing assessment and will be received by the Beneficiary within three calendar days of shipment.”
Additionally, the RFP specifies “3. Documentation A.4. If a prescription is accepted by telephone, the Contractor is responsible for obtaining a written prescription to be maintained in the Beneficiary’s file.”
Bidder response “Binson's system is designed to allow a Beneficiary’s order to ship if a verbal, fax, electronic or written prescription has been received.”
• The Contract does not allow for the order to be shipped if the written verification of the verbal prescription is not received, i.e., a signed prescription must be on file prior to shipment.
The RFP specifies:
i. “For new Beneficiaries and those with medical changes requiring a nursing reassessment, products will be shipped within one business day, if received before 2 p.m., of the Contractor receiving the valid ordering practitioner’s prescription and completing a nursing assessment and will be received by the Beneficiary within three calendar days of shipment.
ii. For all other prescription renewals, products will be shipped within one business day, if received before 2 p.m., of the Contractor receiving the valid ordering practitioner’s prescription and will be received by the beneficiary within three calendar days of shipment.”
Bidder response “The method of shipment described will guarantee product shipment within one (1) day of prescription receipt and nursing assessment completion; delivery to the Beneficiary within three (3) business days. The cutoff time for receipt of prescription and nursing assessment is currently 2:00 P.M. When necessary, products will be sent with expedited delivery such as overnight, weekend, express priority, etc. to guarantee delivery within three (3) business days of receiving the physician's prescription. Shipping costs are included in the unit prices of products provided in Schedule B Pricing; no additional delivery charges will be charged to Beneficiaries.”
“BIMS is linked to the common carriers (UPS, USPS, etc.) to receive order delivery tracking data. Common carrier delivery information derived from BIMS via a Delivery Tracker Report and is monitored by management each day for adherence to the three (3) business day delivery guideline.”
• The Bidder’s response of three business days is non-compliant with the RFP requirement for receipt of order within three calendar days, i.e., may fall outside of the RFP timeframe requirements during weekends and holidays.
2.3. Reporting
The RFP specifies “This information is considered property of the State of Michigan or the State of Wisconsin and any and all copies (electronic and printed) must be delivered to the State at the expiration or termination of this Contract.”
Bidder response “Binson’s understands that data and documentation collected in order to complete work specified under the proposed Contract is property of the State of Michigan copies of documents and reports related to any Contract information will be supplied at the State and/or Program Manager upon request. Binson’s will provide online access of any Beneficiary/Contract information to the Program Manager that may be requested and understands that this information is considered property of the State of Michigan. Upon request Binson’s will deliver all documents to the State at the expiration or termination of this Contract.”
• The Bidder’s response lacks confirmation that data and documentation collected to complete work for Wisconsin residents specified under the proposed Contract, is the property of the State of Wisconsin as well as acknowledgement that it is not the State’s responsibility to request, but it is a requirement that the Contractor must return the documentation upon expiration or termination of the Contract.
2. Schedule A, Statement of Work, Section 3. Staffing SCORE 16/20 for MI and a SCORE 12/20 for WI.
The Evaluation Team determined that overall, the responses were mostly satisfactory for Michigan, but unsatisfactory for Wisconsin, with the following deficiencies noted:
• For Section 3.1, 3.2 and 3.4 where the Bidder response instructions in the RFP stated, “Bidder must acknowledge acceptance to Section ___ and describe in detail how this will be accomplished,” the Bidder’s proposal statement to acknowledge acceptance to the requirement was not evident.
• WI Only: Bidder response “Binson’s recognizes the variations indicated regarding
Wisconsin licensing requirements compared to those stated for Michigan. Registered nurses and licensed practical nurses will be available to perform nursing assessments.” The RFP specifies “Wisconsin practice laws (Wisconsin Administrative Code N 6.03) and the Nurse Licensure Compact, require registered nurses to perform the nursing assessments for all age groups.” The Bidder’s response is non-compliant with the RFP requirement.
3.3 Organizational Chart
• Only one subcontractor, Cheryl Lerchin, M.D. is specified on the organizational chart, however there are additional subcontractors specified in the Bidder’s proposal, (translation service, after hours call center, UPS, USPS) that are not included in the Bidder’s organizational chart.
3.4 Disclosure of Subcontractors
• The Bidder responded to Section 5. The Evaluation Team determined that J&B Medical Supply Co. Inc. based on a score of 82/100 for MI and a score of 87/100 for WI did meet the requirements of this RFP. This determination was accomplished by evaluating their responses to the Technical Evaluation Criteria.
1. Schedule A Statement of Work, Excluding Section 3. Staffing Section SCORE 35/50 for MI and a SCORE 40/50 for WI.

Section 1. General Requirements

b. Deliver the quantity balance of product within 24 hours to the Beneficiary’s residence (as specified under Section 2.1 Delivery and Timeframes).”
• The Bidder’s response “ensure that shipping concerns have been resolved within one
(1) business day” as opposed to the required 24 hours, though does state they would request overnight delivery status with FedEx.
1.1.D.3 Documentation Bidder’s response lacks reference to “2. A prescription from an appropriate subspecialist is required for Beneficiaries enrolled in Children’s Special Health Care Services (CSHCS) only.”
