Scope of Services
The process to be managed and facilitated by the Contractor is contemplated as follows:
The contractor’s proposal shall be all inclusive, i.e., it shall provide for all necessary labor, transportation, storage, tools, materials, equipment, consumables, permits and any other associated cost to provide a safe display in accordance with all applicable federal, state and local regulations and standards.
Choreographed displays should be structured with a distinct opening, middle, and grand finale. Each proposal should include a time sequenced description of all fireworks to be included and any visuals and explanation that assist in describing the show.
The display will be fired from a remote location from the viewing area. The successful contractor shall provide:
A. Music: The choreographed display will provide a blend of contemporary and patriotic music. All music must be reviewed and approved in advance by the Town. The Contractor will provide a broadcast-quality digitally edited soundtrack to the Town.
B. Length of time: The display shall be a minimum of 18 minutes and a maximum of 25 minutes.
C. Permits: The fireworks contractor shall be responsible for applying for and securing all fireworks display permits from the Bedford County Fire Marshal’s Office in accordance with the most current NFPA Code 1123 Use of Pyrotechnics before a Proximate Audience and Bedford County regulations.
D. Display Standards.: The fireworks display shall be conducted in accordance with the
Annual Fireworks Display 5
National Fire Protection Association Standard 1123 – 1990, Public Display of Fireworks and the Bedford County Fire Marshal’s Office requirements for firing a display. All unfired fireworks shall be covered or protected during firing. Any shell not properly fired shall be disposed of in accordance with Bedford County Fire Marshall Regulations.
E. Quality: The intent of the Town is to provide a high-quality fireworks display. In the development of the program, 60% of the shells shall be comprised of a variety of single and multifaceted break shells, to include palm trees, crossettes, pattern shells, and special event shells to include screamers, serpentines, and crackling shells. Base shells may include peonies, dahlias, chrysanthemums, etc., with tails, multi-break, or variegated or multi-color. The vendor shall provide a material listing of shells and a cost per unit and materials cost per shell. The contractor may propose the shell size that will best fit the topography of the Town for maximum viewing within the cost and time expectations of the scope of this proposal.
F. Location: The fireworks display will be held at the National D-Day Memorial and contractor must review and meet all requirements included in the Memorandum of Understanding (MOU) between the D-Day Memorial and the Town, including site conditions.
G. Safety: The Contractor will provide all safety equipment and ensure that all employees are trained in emergency operations, including having an on-site Emergency Operations Plan, which may be requested by the Town. Contractor shall list any and all violations issued by a Fire Marshall’s office of any jurisdiction within the last five years.
Important Note: Electrical power may not be available. Bidders are to assume no electricity will be provided to determine whether or not electrical ignition will be supplied in the submitted proposal.
Liquidated Damages
The Town may assess liquidated damages as specified herein that are proportionate and reasonable. These proportionate and reasonable amounts are established as liquidated damages and not as a forfeiture or penalty for the Contractor’s failure to comply with the specified terms and conditions. The Contractor hereby waives any defense to the validity of any liquidated damages such as that such liquidated damages are void as penalties or are not reasonable related to the actual damages. Any liquidated damages shall be subtracted from the invoice for payment.
A. Shell Storage: The Town may assess liquidated damages in the amount of three times the value for the average cost of a shell, by the diameter, for any shell that is shorted, misfired, or those that failed to perform properly.
B. Staff Change: The Town may assess Five Hundred Dollars ($500) if the assigned pyro-technician is changed after the contract show is awarded or the contract is renewed.
C. Program Delay or Change: The Town may assess liquidated damages in the amount
Annual Fireworks Display 6 of ten percent (10%) of the contract or purchase order amount for any delay that results in the display(s) being more than 15 minutes late of scheduled firing time.

B. The Town of Bedford reserves the right to reject any and all proposals, to waive informalities, to request additional information, and/or to award a contract deemed in the best interest of the Town.

3. By ordering the Contractor to proceed with the work and keep a record of all costs incurred and savings realized. A markup for overhead and profit may be allowed. The same markup shall be used for determining a decrease in price as the result of savings realized.
