About this file

This Request for Proposals (RFP) is issued by the State of Maine Department of Agriculture, Conservation, and Forestry on behalf of the Maine Milk Commission to solicit research services for a comprehensive dairy cost of production study. The study will determine the current costs associated with producing fluid white milk on Maine commercial dairy farms using 2025 financial data. The scope of work includes conducting a USPS mail survey to Maine dairy producers, analyzing farm demographics, conducting on-site financial data collection visits to at least 32 selected dairy farms, and calculating the short-run break-even cost of milk production across four production levels as defined by statute. The survey methodology will include both organic and conventional producers in the initial demographic assessment, though organic farms will be excluded from the final cost analysis. The proposal submission deadline is Thursday, July 30, 2026, at 4:00 p.m. local time, with written questions due by Monday, July 20, 2026. The initial contract period runs from September 1, 2026, through August 31, 2027, with an optional renewal period from May 1, 2029, through June 30, 2030. The awarded bidder must provide written reports, oral testimony, and expert witness services at Maine Milk Commission rulemaking hearings and legislative hearings, with findings due by March 15, 2027, and up to seven days of formal testimony expected.

The RFP anticipates a single award and evaluates proposals on a 100-point scale: Organization Qualifications and Experience (25 points), Proposed Services (30 points), and Cost Proposal (45 points). The cost proposal will be scored using a mathematical formula in which the lowest submitted bid receives 45 points with other bids receiving proportionally fewer points based on comparison to the lowest bid; no best and final offer process will be conducted. Bidders must demonstrate eligibility through education and work experience in agricultural and dairy economics with knowledge of dairy farming operations and management. Bidders must submit proposals in four separate PDF files containing preliminary information, organizational qualifications and experience, proposed services, and cost proposals. The cost proposal must be submitted as a fixed amount covering the initial period of performance. All proposals must be submitted through the Vendor Self Service System (VSS), and proposals are valid and binding for 180 days from the bid opening date. The Department reserves the right to negotiate with the awarded bidder, reject any or all proposals, or cancel the RFP at its sole discretion. Contract execution is contingent upon State Procurement Review Committee approval and requires a minimum of fourteen calendar days between award notification and contract effectiveness.

PART II SCOPE OF SERVICES TO BE PROVIDED

A. Objectives

The awarded bidder will conduct a study to determine the cost of producing fluid white milk for dairy producers in Maine using 2025 financial data.

B. Procedures Approach

1. In order to determine the demographics of Maine dairy farms a USPS mail survey will be distributed based on a list provided by the Maine Milk Commission.

2. Organic milk producers will be included in the survey in order to assess demographic profiles of Maine’s commercial dairy sector. However, organic dairy farms will not be included in the second stage analysis of cost of production, due to the significant difference in cost factors related to organic dairy production.

3. The objective of the survey is to collect information that can be used to describe dairy farm types that represent the maximum number of Maine dairy farms.

4. Information from the survey will be summarized to describe the current population of dairy farmers.

5. Data such as herd size, number of employees, pounds of milk produced, barn style, crops and animal raised by the farm, management practices, and business operations will be summarized.

6. Farms having similar operational structures and scale will be grouped for the purpose of farm visits to gather financial information.

7. The awarded bidder will calculate the cost of milk production for the four levels of production as defined in statute using one method, “Short run Break Even” for the Commission. “Short-run Break even” is defined as the point at which total costs and total revenues are equal (meaning there is no profit or loss) when looking at essential costs and revenues that are required to maintain the business on a month-to-month basis, determined from analysis of the data gathered through surveys, and supported by closer examination of financial and business records during on-site interviews of current Maine dairy farm operations.

The awarded bidder will coordinate with the Commission to develop the proposed survey and will receive approval from the Commission prior to distributing to farmers.

Data verification:

Financial information will be verified during the collection phase on farm visits.

Additionally, the awarded bidder will continue to verify reported cost averages against the “Commodity Cost and Returns” data available from the USDA for the Northern Crescent. This data is collected nationally through the Agricultural and Resource Management Survey (ARMS). ARMS cost of production estimates will be used as a benchmark for information gathered during this study. Other published reports of US cost of production with similar demographic profiles to Maine may also be used for comparison but will require pre-approval from the Commission.

B. Scoring Weights and Process

1. Scoring Weights: Proposal scores will be based on a 100-point scale and will measure the degree to which each proposal meets the following criteria. The proposal materials that will be evaluated under each section below are identified in Part IV of the RFP.

Section I.
Preliminary Information
(No Points - Eligibility Requirements)
Section II.
Organization Qualifications and Experience
25
Section III.
Proposed Services
30
Section IV.
Cost Proposal
45
Total
100

2. Scoring Process: For proposals that demonstrate meeting the eligibility requirements in Section I, if applicable, the evaluation team will use a consensus approach to evaluate and score Sections II & III above. Members of the evaluation team will not score those sections individually but, instead, will arrive at a consensus as to assignment of points for each of those sections. Section IV, the Cost Proposal, will be scored as described below.

3. Scoring the Cost Proposal: The total cost proposed for conducting all the functions specified in the RFP will be assigned a score according to a mathematical formula. The lowest bid will be awarded 45 points. Proposals with higher bid values will be awarded proportionately fewer points calculated in comparison with the lowest bid.

The scoring formula is:

(Lowest submitted cost proposal / Cost of proposal being scored) x 45 = pro-rated score

No Best and Final Offers: The State of Maine will not seek or accept a best and final offer (BAFO) from any Bidder in this procurement process. All Bidders are expected to provide their best value pricing with the submission of their proposal.

C. Negotiations

1. The Department reserves the right to negotiate with the awarded Bidder(s) to finalize a contract. Such negotiations may not significantly vary the content, nature, or requirements of the proposal or the Department’s Request for Proposal to an extent that may affect the price of goods or services requested.

2. The Department reserves the right to terminate contract negotiations with an awarded Bidder who submits a proposed contract significantly different from the proposal they submitted in response to the advertised RFP.

3. In the event that an acceptable contract cannot be negotiated with the highest ranked Bidder, the Department may withdraw its award and negotiate with the next-highest ranked Bidder, and so on, until an acceptable contract has been finalized. Alternatively, the Department may cancel the RFP, at its sole discretion.

D. Selection and Award

1. The final decision regarding the award of the contract will be made by representatives of the Department subject to approval by the State Procurement Review Committee.

2. Notification of conditional award selection or non-selection will be made in writing by the Department.

3. Issuance of the RFP in no way constitutes a commitment by the State of Maine to award a contract, to pay costs incurred in the preparation of a response to the RFP, or to pay costs incurred in procuring or contracting for services, supplies, physical space, personnel or any other costs incurred by the Bidder.

4. The Department reserves the right to reject any and all proposals or to make multiple awards.

E. Appeal of Contract Awards

Any person aggrieved by the award decision that results from the RFP may appeal the decision to the Director of the Bureau of General Services in the manner prescribed in 5 M.R.S.A. § 1825-E and 18-554 Code of Maine Rules Chapter 120. The appeal must be in writing and filed with the Director of the Bureau of General Services, 9 State House Station, Augusta, Maine, 04333-0009 within fifteen (15) calendar days of receipt of notification of conditional contract award.

PART VI CONTRACT ADMINISTRATION AND CONDITIONS

The complete set of standard State of Maine Service Contract documents, along with other forms and contract documents commonly used by the State, may be found on the Office of State Procurement Services’ website at the following link: Office of State Procurement Services Forms Page

2. Allocation of funds is final upon successful negotiation and execution of the contract, subject to the review and approval of the State Procurement Review Committee. Contracts are not considered fully executed and valid until approved by the State Procurement Review Committee and funds are encumbered. No contract will be approved based on an RFP which has an effective date less than fourteen (14) calendar days after award notification to Bidders. (Referenced in the regulations of the Department of Administrative and Financial Services, Chapter 110, § 3(B)(i).)

This provision means that a contract cannot be effective until at least fourteen (14) calendar days after award notification.

3. The State recognizes that the actual contract effective date depends upon completion of the RFP process, date of formal award notification, length of contract negotiation, and preparation and approval by the State Procurement Review Committee. Any appeals to the Department’s award decision(s) may further postpone the actual contract effective date, depending upon the outcome. The contract effective date listed in the RFP may need to be adjusted, if necessary, to comply with mandated requirements.

4. In providing services and performing under the contract, the awarded Bidder must act as an independent contractor and not as an agent of the State of Maine.

B. Standard State Contract Provisions

1. Contract Administration Following the award, a Contract Administrator from the Department will be appointed to assist with the development and administration of the contract and to act as administrator during the entire contract period. Department staff will be available after the award to consult with the awarded Bidder in the finalization of the contract.

2. Payments and Other Provisions The State anticipates paying the awarded Bidder on the basis of net 30 payment terms, upon the receipt of an accurate and acceptable invoice. An invoice will be considered accurate and acceptable if it contains a reference to the State of Maine contract number, contains correct pricing information relative to the contract, and provides any required supporting documents, as applicable, and any other specific and agreed-upon requirements listed within the contract that results from the RFP.
