About this file
This is a Question and Answer Summary document from the State of Maine Department of Administrative & Financial Services, Office of Employee Health, Wellness & Workers' Compensation related to Request for Proposals #202604074 for workers' compensation investigative services. The RFP seeks comprehensive investigative services for the state's self-insured workers' compensation program covering approximately 12,000 employees across the Executive, Judicial, and Legislative branches. Services include surveillance investigations, social media reports, interviews, accident and injury investigations, DMV checks, database searches, electronic recordings, photographs, and testimony at Workers' Compensation Board hearings. Bidders may specify coverage for one of four geographic locations: Location 1 covering 13 southern and central Maine counties, Location 2 covering 11 northern and eastern Maine counties, Location 3 covering all Maine counties, or Location 4 for out-of-state services. The state anticipates making multiple awards based on historical claim volume of 40 claims in 2024 and 64 claims in 2023. Questions must be submitted by May 18, 2026, at 4:00 p.m., with proposals due June 1, 2026, at 4:00 p.m. via the Vendor Self Service System. The initial contract period runs from July 1, 2026, through June 30, 2029, with two optional renewal periods extending through June 30, 2032.
Proposals will be evaluated on a 100-point scale with Organization Qualifications and Experience weighted at 30 points, Proposed Services at 35 points, and Cost Proposal at 30 points for in-state services with an additional 5 points available for out-of-state capability. Bidders must provide investigator licensing, proof of bonding and insurance with ACORD certificates, organizational qualifications including relevant project experience and litigation history from the past five years, and detailed cost proposals covering investigative hours, travel, clerical support, comprehensive reports, recordings, photographs, DMV checks, social media investigations, database checks, and Workers' Compensation Board hearing testimony. All proposals must comply with State of Maine IT policies, data security standards, and NIST requirements for handling confidential personally identifiable information. The state reserves the right to negotiate with awarded bidders and will not solicit best and final offers. Contracts will require execution of an IT Service Contract with Confidentiality and Non-Disclosure Agreement and are subject to State Procurement Review Committee approval. Payment terms are anticipated at net 30 upon receipt of accurate invoices. No specific set-aside designations, disadvantaged enterprise restrictions, incumbent vendor information, or budget ranges are disclosed.

| Please clarify whether the State may reassign services if an awarded vendor dissolves, and what safeguards, approval requirements, and verification controls will prevent unauthorized entities from performing outside the original procurement process. | The State of Maine utilizes an RFP process through which bidders outline the goods and services they propose to provide. Selected bidders then work collaboratively with the State of Maine to define and finalize the specific contracted services. In the event an awarded bidder dissolves, undergoes a material organizational change, or is otherwise unable to perform the contracted services, the State of Maine reserves the right to evaluate the circumstances and determine the most appropriate course of action in accordance with applicable procurement laws, contract terms, and operational needs. |
| Due to the large number of subcontractors utilized by our organization, would the Department permit Appendix D subcontractor information to be submitted in an attached Excel spreadsheet, provided all requested information is included? | A clearly labeled Excel spreadsheet in Appendix D is permitted to disclose subcontractors. |
