The apparatus shall be delivered under their own power and must be fully operational and ready for immediate service upon delivery. The County will conduct a minimum of two inspections at the manufacturer's expense, including travel and lodging for three County representatives.

Pricing for all five apparatus shall be submitted on an itemized basis, clearly identifying base apparatus price, chassis, body, pump, booster tank, required equipment, freight/delivery, applicable taxes, optional equipment, trade-in allowances, discounts, extended warranties, service agreements, and the total purchase price. The County is exempt from Federal Excise Tax and Georgia Sales and Use Tax and will retain 10 percent of each payment until final completion and acceptance. Award will be based on best overall value considering compliance with specifications, purchase price, warranty coverage, service support, parts availability, delivery schedule, manufacturer experience, quality and workmanship, and long-term maintenance considerations; cost alone will not determine the award. All successful proposers must execute E-Verify S.A.V.E. documentation and submit IRS Form W-9 with their proposals. Subcontractors must also provide executed E-Verify affidavits. The County reserves the right to reject any or all proposals, waive informalities, request clarification, negotiate pricing, and reject proposals containing material exceptions or false statements.

SECTION 8. INTENT OF SPECIFICATIONS

It is the intent of these specifications to provide Walker County Fire Rescue with a complete, soundly engineered, purpose-built custom Class “A” pumper apparatus equipped as specified within this RFP. These specifications establish only minimum requirements concerning construction, performance, equipment, finish, and testing.

Where a specific construction detail or material is not otherwise specified, minor details of construction and materials shall be left to the discretion of the manufacturer, provided that the completed apparatus meets or exceeds all requirements of this RFP.

The manufacturer shall be solely responsible for the proper engineering, design, construction, and integration of all components.

The apparatus shall conform to the requirements of the applicable NFPA 1901

Standard for Automotive Fire Apparatus, current edition in effect at the time of purchase, insofar as the standard applies unless otherwise indicated within these specifications.

SECTION 12. DELIVERY AND ACCEPTANCE

By submitting a proposal, Contractor agrees to the following:

The Vendor and Walker County recognize that time is of the essence and that Walker

County will suffer financial loss if the new Class “A” pumpers are not delivered within

365 calendar days from the date the contract is awarded. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Walker County if the product is not delivered on time.

Accordingly, instead of requiring any such proof, Walker County and Vendor agree that as liquidated damages for delay (but not as a penalty), Vendor shall pay Walker County

$200.00 per calendar day for each day the apparatus delivery exceeds the contracted delivery requirement, unless a different delivery schedule is mutually agreed upon in writing and incorporated into the contract.

A qualified and responsible manufacturer's representative shall deliver the apparatus and equipment and shall remain with Walker County Fire Rescue for a minimum of three (3) consecutive days, or a sufficient period of time as determined by the County, to instruct personnel in:

• Operation;

• Driving;

• Pump operation;

• Equipment operation;

• Preventive maintenance;

• Daily inspections;

• Troubleshooting; and

• Care and maintenance of the apparatus.

Responsibility for the apparatus and equipment shall remain with the manufacturer until satisfactory completion of acceptance testing and formal acceptance by Walker

County.

The apparatus shall be delivered under its own power by the manufacturer to ensure proper break-in of apparatus components while under warranty. The apparatus and equipment shall be fully operational and ready for immediate service at the time of delivery.

The apparatus will be inspected upon delivery for compliance with the specifications contained in this RFP. Material deviations from the specifications will not be accepted and may be grounds for rejection unless the deviation was specifically identified in the

Vendor's original proposal and accepted by the County.

The apparatus shall be covered by comprehensive and liability insurance during delivery. The County will assume insurance responsibility upon formal acceptance.

SECTION 13. REQUIRED DELIVERY DOCUMENTATION

At the time of delivery, the manufacturer shall provide a minimum of two (2) copies of complete operation and maintenance manuals covering the completed apparatus and all equipment installed.
