IRAN DIVESTMENT ACT CERTIFICATION
As a result of the Iran Divestment Act of 2012 (Act), Chapter 1 of the 2012 Laws of New York, a new provision has been added to the State Finance Law (SFL), § 165-a, effective April 12, 2012.
Under the Act, the Commissioner of the Office of General Services (OGS) will be developing a list (prohibited entities list) of “persons” who are engaged in “investment activities in Iran” (both are defined terms in the law). Pursuant to SFL § 165-a(3)(b), the initial list is expected to be issued no later than 120 days after the Act’s effective date, at which time it will be posted on the OGS website.
By submitting a bid in response to this solicitation or by assuming the responsibility of a Contract awarded hereunder, Bidder/Contractor (or any assignee) certifies that once the prohibited entities list is posted on the OGS website, it will not utilize on such Contract any subcontractor that is identified on the prohibited entities list.
Additionally, Bidder/Contractor is advised that once the list is posted on the OGS website, any
Contractor seeking to renew or extend a Contract or assume the responsibility of a Contract awarded in response to the solicitation, must certify at the time the Contract is renewed, extended or assigned that it is not included on the prohibited entities list.
During the term of the Contract, should the City of Albany (AGENCY) receive information that a person is in violation of the above-referenced certification, AGENCY will offer the person an opportunity to respond. If the person fails to demonstrate that it has ceased its engagement in the investment which is in violation of the Act within 90 days after the determination of such violation, then AGENCY shall take such action as may be appropriate including, but not limited to, imposing sanctions, seeking compliance, recovering damages, or declaring the Contractor in default.
AGENCY reserves the right to reject any bid or request for assignment for an entity that appears on the prohibited entities list prior to the award of a contract, and to pursue a responsibility review with respect to any entity that is awarded a contract and appears on the prohibited entities list after contract award.

1 | INTRODUCTION1 | INTRODUCTION
Thaler Reilly Wilson Architecture & Preservation, LLP (TRW) is pleased to submit the following existing conditions assessment and restoration recommendations for the Swinburne Skating Rink located in Swin-burne Park in Albany, NY. The Swinburne Skating Rink, completed in 1969, is a large open-air pre-cast concrete structure, with mechanical and restroom facilities located in a secondary nearby brick building.
Site surveys were conducted on April 17, 2025 and May 13, 2025 by TRW to assess the condition of the building in order to identify any potential concerns regarding structural stability and code compliance. In this conditions assessment report, the appearance and history of the building are discussed as an intro-duction, followed by a visual analysis of the building’s condition. The skating rink building is discussed first, followed by the supporting brick outbuilding. Following this description, the report concludes with recommendations for the repair and reuse of the building. The appendices include original construction drawings, existing conditions drawings illustrating the report’s recommendations, and a portion of the restroom facilities report TRW prepared for the City in 2019.
The building consists of pre-cast concrete tees and pre-cast concrete columns, with concrete block walls and storefront assemblies enclosing the warming area. The built-up tar and gravel roof above the con-crete is long past its useful life and persistent leaking through the field of roofing has damaged isolated areas of the pre-cast components and anchorage. The overarching findings of this report are as follows:
1. The pre-cast concrete tees and columns are in relatively good condition with some spalling and crack-ing observed. The spalls and cracks are due to the corrosion of the steel reinforcing primarily as a re-sult of roof leaks. The corrosion appears to be minor, with some cross-sectional loss of the reinforcing anticipated in areas where the steel is exposed. In areas where the steel reinforcing is still encased by an intact concrete cover, no section loss is anticipated, but additional investigation through selective physical probes should be conducted to confirm this. We believe the areas of deterioration in the tees can and should be repaired.
2. The built-up roof should be replaced, with an upgraded methodology for either ballasted or mechan-ical anchorage for the solar array, and upgraded power connections. Roofing failure has caused the majority of the deterioration in the concrete, and when properly replaced should prevent further wa-ter infiltration into the concrete assembly.
3. Steps should be taken to upgrade the building for ADA compliance, possibly by introducing an acces-sible, gender-neutral restroom within the skating structure.
4. First impressions of this building might indicate that it should be able to accommodate a variety of functions requiring large, open areas; in reality, there is a relatively short list of options, given the overall clear dimensions of the building structure, and in particular the clear dimensions from the rink floor to the pre-cast concrete frame. These options are further discussed in the report.

2 | DESCRIPTION AND HISTORY2 | DESCRIPTION AND HISTORY
History Swinburne Park was designated by mayor James H. Blessing in 1901, at the same time as the creation of Bleecker Reservoir on the same city block to its southeast. The site would be open green space until 1912, when it was redesigned by Arnold W Brunner. Brunner was responsible for a great deal of urban development in Albany, most notably proposing the D & H building by the river, but in Swinburne Park, his proposal added an open-air theatre and a bandstand, soon followed by a comfort station. In 1926, a wading pool was added to the park; it has since been converted to a spray park but retains its historic location and circular footprint.
The building currently housing the bathrooms and mechanical systems for the rink was constructed in late 1938 through early 1939 as a multipurpose building housing public restrooms for Swinburne Park and storage for the recreation department. It was built on the site of the bandstand which was demolished to make room for the new building.
The construction of the restroom and mechanical facility was done through the Works Progress Administration, which was responsible for building almost the entire city block of park space. The other WPA projects on the block were the infilling of Bleecker Reservoir and construction of Bleecker Stadium (1935), its associated field house (1937), tennis courts at Swinburne Park (1939, replaced with parking in 1969), and the playground at Swinburne Park (1940, replaced at an unknown date).
The building originally appears to have only had an entrance on the northwest side where there is currently a garage door; the bathrooms were originally accessed from the center outwards. This was altered at an unknown date, but most likely during the rink’s construction in 1969, placing the restroom entrances on the northeast side facing the rink structure and the storage entrance on the southwest side.
The building is of brick construction and has windows made of Argus pattern Pittsburgh-Corning glass block, which appear to be original and match 1938 catalogues. This makes the building a notable early example incorporating this type of glass block construction, as Pittsburgh-Corning only patented and began commerical production of glass block in 1937.

The current site of the skating rink was considered for development into a swimming pool in 1945, with plans made, funds appropriated, and the project sent out to public bid, but the project was never built.
The August 25th 1945 edition of the Albany Times Union is the last to mention the pool, reporting on an interview with interim mayor Frank Salisbury Harris, who was filling in for Erastus Corning 2nd during his military service in WWII from 1944-45. During the interview, when confronted about it being too late in the year to begin a large public works project such as a pool, Harris stated construction would begin in the spring. By spring 1946, however, Corning had returned to office and the project appears to have been shelved, with no further mentions of it in contemporary newspapers.
Swinburne rink was designed in 1967 by the Allen Organization Park & Recreation Planners of Bennington, Vermont, with consulting engineers of Rist Frost Associates of Glens Falls, New York. The rink was a component of a larger campaign to redesign seven playgrounds in Albany, which the Allen Organization had been contracted to do. The scope of this playground project, however, was steadily reduced until only plans for Franklin Park and the skating rink were produced. The Franklin Park project was not constructed due to the excessive cost of the only bid received. Swinburne Rink would be the only Allen Organization design to be constructed; it was budgeted $465,000 and went to bid in July 1968. The project would be awarded to Smith & Tierney, Inc. of Albany with a winning bid of $410,427.
The original proposed drawings included a parking lot on the Clinton Avenue side of the park, but this…
