About this file
This is a Questions and Responses document for RFP #013-2026 issued by Nassau Health Care Corporation (NHCC), a New York State public benefit corporation, regarding Professional Liability Insurance and Captive Management Strategic Planning Services. NHCC is seeking an independent strategic advisor to evaluate its current medical malpractice and professional liability risk financing structure, including its existing offshore captive insurance company. The deliverables include a comprehensive diagnostic report, strategic recommendations comparing alternative risk financing structures (restructuring the existing Cayman captive, forming a new single-parent onshore captive, or utilizing a risk retention group), domicile analysis, actuarial and financial feasibility modeling, and five-year financial projections. The RFP requires proposals due August 21, 2026 at 4:00 p.m., with questions due by August 10, 2026. The scope requires strategic assessment and recommendations only; implementation planning and transition support are not required unless recommended as separate proposals. Respondents should demonstrate a minimum of 10 years of experience providing similar services to healthcare systems and government entities, with documented expertise in both onshore and offshore captive management, specifically regarding Cayman Islands regulatory frameworks.
Pricing should be submitted as respondents see fit, whether as hourly rates, flat fees, or ranges. The selected vendor must execute NIFA-mandated vendor forms and provide certificates of insurance (general liability $1,000,000 per occurrence/$3,000,000 aggregate, professional liability with identical limits, and cyber liability $5,000,000 per instance/$10,000,000 aggregate) within three business days of award. NHCC has established a 20% Minority and Women-Owned Business Enterprise (MWBE) utilization goal and a 6% Service-Disabled Veteran-Owned Business (SDVOB) goal, and respondents must submit a completed MWBE Utilization Plan. Proposals will be evaluated on a 100-point scoring grid: firm experience and qualifications (45 points), project approach and methodology (25 points), cost and fee proposal (25 points), and New York State diversity and compliance goals (5 points). Respondents must disclose any conflicts of interest related to broker commissions, third-party administrator services, or reinsurance placements. NHCC is not bound to accept the lowest cost and reserves the right to negotiate with all qualified sources, conduct interviews, and reject any or all proposals. No incumbent vendor has been identified for this procurement, and NHCC is currently under financial oversight by the Nassau Interim Finance Authority (NIFA), which must review and approve contracts above a specified threshold.

RFP #013-2026 – Professional Liability Insurance (Including Captive
Management) Strategic Planning Services
Questions and Responses Question # Question Response 1 May respondents use the NHCC/NuHealth logo and branding in proposal submissions and presentation materials?
Yes
2 Beyond professional liability and general liability, are there additional lines of coverage currently written through the captive that should be considered within the scope of this engagement?
Please see section 6.
Insurance
3 Should respondents structure their proposed approach around evaluating all coverages currently or potentially supported by the captive, or only those related to the professional liability program?
Respondent to provide professional liability insurance (including captive management) strategic planning services.
Respondent will provide an all-encompassing strategic recommendation and plan for how to proceed with our professional liability insurance (including captive management) needs. The deliverable for this statement of work is a formal assessment of the current professional liability and captive structure.
4 The RFP states that the selected consultant will "oversee or conduct" actuarial modeling. Does NHCC anticipate actuarial analyses being performed by actuarial resources approved or designated by NHCC, respondent-provided actuarial resources, or another arrangement?
This is about roles and responsibilities and who and how the actuarial services fit with the workflow. Nassau Health Care Corporation is seeking the best in class standard workflow process.
5 Should respondents include implementation planning and transition support as part of their proposed approach, or is NHCC seeking strategic assessment and recommendations only?
Strategic assessment and recommendations are required. Implementation planning and transition planning is not required, if the strategic recommendation is that the proposals should be distinct.
6 Is section D-1 (" Provide adequate information demonstrating experience on projects of similar scope and magnitude.
Project start/completion dates and owner/client reference must be included. ") meant to be instructions for 2 (all projects in the last 18 months) and 3 (5 similar projects)? Or is 1 meant to be examples in addition to the 5 similar projects?
1 is meant to be examples in addition to the 5 similar projects
7 Section G, pricing - should we respond with want hourly rates? Flat fee? Range? It's difficult to give exact numbers without being able to see the full existing scope of the project
Please respond as you see fit.
