Services are to be provided across three geographic regions: Northern/Upper Northern (Sacramento/Bay Area), Central (Fresno/Bakersfield), and Southern (Los Angeles/San Diego).
The RFP will result in multiple awards per region, with an estimated 12-15 contractors for Northern/Upper Northern, 10-12 for Central, and 10-12 for Southern California. Contractors must submit a flat per-case fee for evaluations with no distinction between fees for services at outside locations versus private offices. 1. PURPOSE AND GENERAL DESCRIPTION OF SERVICES
The Department of Human Resources (CalHR) is requesting proposals for the provision of professional psychological screening services for peace officer candidates throughout California as described in Appendix B, Sample Standard Contract.
CalHR, through its Psychological Screening Program (PSP), provides pre-employment psychological screening of candidates for State positions designated as peace officer empowered. Pursuant to the requirements of Government Code section 1031(f), California Code of Regulations sections 599.971 through 599.979 and POST regulations (1950-1955), psychological screening is intended to identify those individuals, who because of mental or emotional conditions and/or maladaptive personality characteristics, are unable to perform peace officer duties in a safe and effective manner.
The PSP is composed of a core staff of CalHR Psychologists who make the dispositional screening decisions after reviewing all screening data and information for each candidate. A crucial component of the screening procedure involves a face-to-face evaluation interview with each peace officer candidate by a qualified doctor, who submits a detailed report of findings to the PSP. These interviews, located in the various main geographic regions of the state, are conducted by CalHR psychologists, or psychologists under contract.
All psychologists and psychiatrists submitting a bid in accordance with this RFP shall herein be referred to as “Contractors” and all psychologists and psychiatrists working under a contractor are herein referred to as “Subcontractors.” In situations where multiple Contractors exist representing a group of Subcontractors, both representing contractors shall herein be referred to as “Primary Contractors.” Primary Contractors shall meet all requirements explained within this RFP pertaining to contractors. All Contractors, Subcontractors, and Primary Contractors conducting evaluation interviews shall herein be referred to as “Interviewing Doctors.”
Contractors and their subcontractors may bid for contracts for CalHR PSP and California Department of Corrections and Rehabilitation (CDCR) but may not provide second opinion outside evaluations for candidates who are Disputing Disqualifications by either agency.
2. CONTRACT TERM
The term of the contract will be from July 1, 2016 through June 30, 2018.
3. KEY ACTION DATES
The following outlines the important actions, dates, and times by which the listed actions must be taken or completed. If CalHR finds it necessary to change any of these dates, it shall be accomplished by an addendum until the bids are due. All dates after the Proposal due date may be modified at the discretion of CalHR without issuing a formal addendum to this RFP. All times indicated throughout the RFP are Pacific Time (PT).

5. GEOGRAPHIC SERVICE REGIONS AND CONTRACTED NEEDS
WITHIN REGIONS
Psychological evaluation interviews shall take place in each of the following geographic regions of the State (see Appendix D, Sample Standard Contract, for the counties comprising these regions):
A. Northern and Upper Northern (from the Sacramento/Bay Area to the California/Oregon Border)
B. Central (approximately centered by Fresno, Central Coast, and Bakersfield)
C. Southern (approximately centered by Los Angeles, San Diego, Riverside, San Bernardino, and Orange Counties)
Contractors may bid for multiple regions, if desired.
Note that each region shall be separately competitive and a proposing psychologist who chooses to bid for more than one region shall be ranked separately for each region.
The number of candidates requiring psychological screening, as well as the geographic distribution, is dependent upon many factors. Factors may include the hiring departments’ position vacancies, geographic allocations, recruitment success, budgetary constraints, and the State’s budgetary circumstances. As a result, CalHR cannot predict, nor guarantee, the actual number or geographic distribution of candidate screenings.
Although CalHR cannot guarantee the number of actual screenings required in any of the regions, it still must be prepared to provide full and flexible coverage to all of its client departments. Therefore, CalHR may award a sufficient number of contracts that shall allow for the handling of psychological screenings similar to those experienced in recent years.
Although the number and distribution of contracts to be awarded shall ultimately depend upon the quantity and quality of proposals submitted in response to this RFP, CalHR may award contracts to the following number of doctors in each of the three (3) regions:
A. PROJECTED NUMBER OF CONTRACTORS UNDER CONTRACT
AND AVAILABLE FOR SERVICE WITHIN REGIONS
REGION NUMBER OF CONTRACTORS
UPPER NORTHERN AND NORTH
(SACRAMENTO)
12-15
CENTRAL (FRESNO/BAKERSFIELD) 10-12
SOUTHERN
(LOS ANGELES/ SAN DIEGO)
10-12
The actual number of contracts awarded may differ from the distribution projected above.
CalHR reserves the right to award more, fewer or no contracts in any region, depending upon the responses received to this RFP.
6. SERVICE LOCATIONS
Many interviews will be conducted at designated California Highway Patrol (CHP) facilities throughout the State as well as alternate State agency sites in Sacramento (Northern), and Rancho Cucamonga (Southern). However, interviews can be and are conducted at Interviewing Doctors’ offices within regions where candidates reside if the office meets all of the requirements set forth in Exhibit A, Subsection 2 (b).
7. PROPOSER ORGANIZATION/STRUCTURE
Proposals may be submitted by an individual Contractor, or a group of Interviewing Doctors in which a single Contractor or multiple Primary Contractors are identified as the contract holder. Contractors and Primary Contractors must meet all the minimum qualifications set forth in Section 8 below and be responsible for all communications with the PSP. All services provided by doctors within a contracted group shall be centrally billed through the Contractor or Primary Contractors, and payment for services rendered shall be issued to the Contractor or Primary Contractors. The State shall not be a party to any contracts and/or subcontracts between and among a contracted group, and shall not be responsible for any contractual payments except those billed and paid through the Contractor or Primary Contractors.
8. MINIMUM QUALIFICATIONS FOR PROPOSERS
The services solicited by this RFP constitute a professional practice. California law (Business & Professions Code section 2903) limits such practice to qualified holders of appropriate professional licensure. This, as well as additional requirements imposed by Government Code 1031(f), the POST Regulation 1955(a), and the PSP are considered minimum qualifications for submitting a proposal to this RFP. All Contractors, Primary Contractors, and Subcontractors must meet the following requirements:
A. ONE OF THE FOLLOWING:
1) A psychologist licensed by the California Board of Psychology who has at least the equivalent of five full-time years of experience in the diagnosis and treatment of emotional and mental disorders, including the equivalent of three full-time years accrued post-doctorate or

B. Proposers shall submit evidence that they have no current or pending charges or complaints and are not currently under or pending investigation before the respective Licensing Board by submitting a copy of their BREEZE printout. CalHR reserves the right to verify the information on the BREEZE reports. Further, CalHR reserves the right to disqualify any interviewing doctor having a history of past legal charges or ethical complaints filed with any licensing authority or professional society. CalHR shall have final authority in determining whether such prior charges or complaints are significant in protecting the interests of the State; and
C. The Contractor, and/or subcontractor(s) shall advise PSP of any charges or complaints leveled during or after this RFP.
D. Experience in interpreting objective psychological assessment profiles of adults (especially, but not limited to, MMPI-2, MMPI-2-RF, CPI, and 16PF); and
E. Must be in compliance with current POST education and training requirements developed for the conduct of pre-employment psychological screening of peace officers as demonstrated by appearing on the POST website as having met these requirements;
F. Must provide a certificate of completion for continuing education credit(s) for reading the POST Manual, and
G. Must have verifiable experience in the application of clinical assessment procedures and report writing with adult populations for three (3) years. Most desirable, but not limited to, is at least one (1) year of assessment experience of law enforcement/correctional job applicants.

If the Proposer has worked for CalHR in the past, the Proposer must be in good standing with CalHR. Use Attachment 5, Proposer References, for this purpose.
K. If Proposer is a corporation, Proposer must provide evidence of being registered and in good standing with the California Secretary of State.
L. If Proposer is a psychiatrist, provide a copy of a valid physician’s license issued by the Medical Board of California.
M. If Proposer is a medical corporation, provide a copy of the Fictitious Name Permit on file with the California Department of Consumer Affairs under the name of the medical corporation used.
N. If awarded a contract, the Proposer shall sign and return four (4), Std. 213, Standard Agreement cover pages to be received by CALHR no later than seven (7) calendar days from the date CALHR e-mails the contract to the address provided by the Proposer in Attachment 7, Minimum Qualifications Response Form.
9. DETERMINATION OF ACCEPTABLE QUALIFICATIONS AND
PERFORMANCE
In operating the State's psychological screening program, CalHR is responsible for ensuring high levels of professional service to the State as well as compliance with all applicable regulations and procedures. Therefore, CalHR reserves the right to determine and apply standards of acceptable professional qualifications and performance. CalHR reserves the right to assess minimum professional qualifications submitted by Contractors under this RFP, including qualifications submitted as equivalent.
10. DISTRIBUTION OF WORKLOADS AMONG CONTRACTORS
(WITHIN EACH REGION)
Although implying no condition of this RFP, based on proposals submitted for these psychological services in prior years, CalHR anticipates awarding multiple contracts within one or more of the geographic regions in order to guarantee adequate coverage.
Contract awards shall be contingent upon the contractor’s ability to certify that they possess all of the communication devices, technological equipment, and security systems described in Attachment 14, Sample Standard Contract.
11. PROPOSAL REQUIREMENTS AND INFORMATION

8) Proposals must be submitted for the performance of all the services described herein. Any deviation from the work specifications shall not be considered and shall cause a proposal to be rejected.
9) A proposal may be rejected if it is conditional or incomplete, or if it contains any alterations of form or other irregularities of any kind. The State may reject any or all proposals and may waive an immaterial deviation in a proposal. The State’s waiver of an immaterial deviation shall in no way modify the RFP document or excuse the proposer from full compliance with all requirements if awarded the contract.

12) A proposer may modify a proposal after its submission by withdrawing the original proposal and resubmitting a new proposal prior to the proposal submission deadline.
Proposal modifications offered in any other manner, oral or written, shall not be considered.
13) A proposer may withdraw the proposal by submitting a written withdrawal request to the State, signed by the proposer. A proposer may, thereafter, submit a new proposal prior to the submission deadline. Proposals may not be withdrawn without cause after the proposal submission deadline.
14) CalHR may modify the RFP prior to the date fixed for submission of proposals by the issuance of an addendum to all parties who received a proposal package.
15) CalHR reserves the right to reject all proposals. CalHR is not required to award any contracts.
16) Before submitting a response to this solicitation, proposers should review their proposal for any errors and confirm compliance with the RFP requirements.
17) The State does not accept alternate contract language from a prospective contractor.
A proposal with such language shall be considered a counter proposal and shall be rejected. The State’s General Terms and Conditions (GTC) are not negotiable.
18) No oral understanding or contract shall be binding on either party.
B. FORMAT
The Proposer shall provide a section in their proposal entitled “Technical Proposal” that addresses each section under the following headings in the order shown below:
1) Sample Prepopulated Report
Review one prepopulated evaluation provided by PSP (see Appendix B)
2) Structured Interview Strategy
Submit one Structured Interview Strategy (SIS) evaluation based upon the pre-populated information provided by PSP. The SIS questionnaire is provided for this purpose. (see Appendix B) Specific forms and Instructions for completing and submitting a proposal shall be found in Attachments 1-14. You may make and use additional copies of these forms as needed.
C. EVALUATION PROCESS
1) CalHR shall evaluate submitted proposals based on two (2) competitive selection factors. Proposals shall be submitted in the format specified, with all applicable information and submission material completed as directed.
2) The proposals shall be evaluated by PSP’s professional staff. The scoring system shall be applied according to two (2) Selection Factors: Cost and Professional Skill.
Each Selection Factor shall be equally weighted with an overall possible score of 200.
3) Proposals shall be ranked by region according to lowest cost, with the lowest cost receiving the highest score, the next lowest receiving the next highest score, and so on.
4) Subsequently, each proposer’s work sample shall be reviewed and individually scored by each PSP psychologist. (The criteria upon which these work samples shall be scored are presented below.)
5) These reviews shall be “blind” as the work samples shall be identified by number only. Subsequently, the PSP psychologists shall collectively discuss the quality of each proposer’s work sample and produce a consensus score.
6) The final score for Professional Skill shall be added to the scores assigned for Cost, and those proposers with the highest scores for any region shall be offered an award.
7) This is a highly competitive bid process and awards shall be limited to the needs of each region.
D. SELECTION FACTORS
All proposals shall be scored on two (2) Selection Factors, defined and weighted as follows:
1) Professional Skill (100) points maximum)
a) Professional Skill will be demonstrated by each proposing psychologist and their subcontractors who will produce a sample work product based upon data provided by PSP.
b) The contractor and all subcontractors must individually review a pre-populated evaluation report based upon the prior treatment history, psychological testing and background investigation data provided. In addition, a proposed structured interview strategy utilizing the data provided by PSP shall be submitted.
c) Proposing psychologists and proposed subcontractors must demonstrate an understanding of adaptive and maladaptive personality traits and conditions that are meaningful to the evaluation of law enforcement candidates.
d) The submission must be well organized, grammatically correct, accurate, and coherent.
e) Typographical errors will result in lower scores.
f) The structured interview strategy must identify areas that require inquiry along with possible follow-up questions.
2) Cost (100 points maximum)
1) Proposers must submit a flat per-case fee for each evaluation to be conducted within a region (Northern/Upper Northern, Central, and Southern California) with no distinction between fees for services provided at outside interview locations or the Contractor’s private office.
2) Contractors may specify different fees for services provided in different regions where travel would be involved. Note: Each region shall be separately competitive and a proposing psychologist who chooses to bid for more than one region shall be ranked separately for each region. Thus, a proposer may be awarded a contract for only that region in which he/she is competitive.
3) In order to assist the proposer in submitting a flat per-case fee bid the following are provided in Appendix B:
a) Template for PSP Report Format with Guidelines
b) PSP Sample Report
c) A Pre-populated evaluation report and
d) Structured Interview Strategy (SIS) Questionnaire
E. PROJECT PERSONNEL
As instructed on Attachment 3, Professional Qualifications, please identify each doctor being included in this proposal who will provide interview services for any of the three (3) regions. Each doctor must meet minimum professional qualifications (see Section G above).
F. EVALUATION PROCESS
1) At the time of the proposal opening, each proposal shall be checked for the presence or absence of required information in conformance with the submission requirements of this RFP. The State shall evaluate each proposal to determine its responsiveness to the published requirements.
2) Proposals that contain false or misleading statements, or references that do not support an attribute or condition claimed by the proposer, may be rejected.
3) Within each region, awards (if made) shall be to the highest scored proposer, in rank order, until sufficient coverage to serve CalHR’s needs is met.
G. Proposals shall first be evaluated for Minimum Qualifications for Proposers of proposers/providers (see Section 8 above). Proposals that meet these minimum qualifications shall then be evaluated and scored on the Selection Factors in accordance with the criteria described in Section 11.D above.
H. The final selection will be made to the responsive, responsible Proposer(s) achieving the most competitive score, including technical scores and with the lowest cost after the application of preferences.
I. In the event of a tie, the award shall be determined by a coin toss.
12. AWARD AND PROTEST
A. Notice of the proposed award of contract(s) in all regions shall be posted in the public entry lobby for CalHR, 1810 16th Street, North Building, Lobby, Sacramento, CA 95811;
and under Public Notices at the CalHR website http://www.calhr.ca.gov/, for five (5) working days prior to awarding any contracts.
B. If prior to the award of the contracts, a proposer files a written protest on the grounds that the (protesting) proposer would have been awarded the contract(s) had CalHR correctly applied the evaluation standards in the RFP or had CalHR followed the evaluation and scoring methods pertaining to the specific geographic region under protest, the contract(s) shall not be awarded until either the protest has been withdrawn or the Department of General Service (DGS) has decided the matter. Protests shall be submitted to the address below as well as CalHR. It is recommended that you submit any protest by certified or registered mail.
Department of General Services Office Legal Services
707 Third Street, 7th Floor, Suite 7-330 West Sacramento, CA 95605
C. Within five (5) days after filing the initial protest, the protesting proposer shall file with the DGS, Office of Legal Services, and CalHR a detailed statement specifying the grounds for the protest.
D. Upon resolution of the protest and award of the contract(s), Contractor must complete and submit to CalHR the Payee Data Record (STD 204), to determine if the Contractor is subject to state income tax withholding pursuant to California Revenue and Taxation Code sections 18662 and 26131. This form can be found on the Internet at www.osp.dgs.ca.gov under Forms, Forms Management Center (FMC) & STD Forms.
No payment for services rendered shall be made unless a completed STD 204 has been returned to CalHR.
13. DISPOSITION OF PROPOSALS
A. Upon commencement of the proposal opening, all documents submitted in response to this RFP shall become the property of the State of California, and shall be regarded as public records under the California Public Records Act (Government Code section 6250 et seq.) and subject to review by the public.
B. Proposal packages may be returned only at the proposer’s expense, unless such expense is waived by the awarding agency.
14. CONTRACT EXECUTION AND PERFORMANCE
1. Performance shall not start until all approvals have been obtained and the contract is fully executed.
2. Should the Contractor fail to commence work at the agreed upon time, CalHR upon five
(5) days written notice to the Contractor, reserves the right to terminate the contract. In addition, the Contractor shall be liable to the State for the difference between the Contractor’s proposal price and the actual cost of performing work by another Contractor.
3. All performance under the contract shall be completed on or before the termination date of the contract.
15. PREFERENCE AND INCENTIVE PROGRAMS
A. SMALL BUSINESS PREFERENCE
www.pd.dgs.ca.gov/smbus/default.htm
In accordance with Government Code Section 14838.5, et seq. and California Code of Regulations, Title 2, Section 1896, et seq., a five percent (5%) preference will be granted to bidders properly certified as a California Small Business, Microbusiness, or Non-Small Business with a Small Business subcontracting for a minimum of 25% of the bid amount.
A five percent (5%) preference will be granted to bidders certified as a Non-Profit Veteran Service Agency in accordance with the Military and Veterans Code Section
999.50. Applications must be on file at the office of Small Business and Disabled Veteran Business Enterprise Certification by 5:00 p.m. on bid opening day.
EXAMPLE 1
Bidder Amount bid SB status
Bidder A $50,000 No
Bidder B $51,000 Yes
COMPUTATION
Preference Formula: low bid x 5% = equals the amount of the preference
$50,000 x .05 = $2,500 Bidder B bid: $ 51,000 Minus preference - 2,500 Adjusted amount (for evaluation only) $ 48,500
After the application of the Small Business Preference the Bidder B is the apparent low bidder.
B. OTHER PREFERENCE PROGRAMS
Target Area Contract Preference Act (TACPA), For information regarding this program, please see the following web address:
http://www.dgs.ca.gov/pd/Programs/DisputeResolution.aspx
C. DISABLED VETERAN BUSINESS ENTERPRISE INCENTIVE
The State hereby waives the mandatory Disabled Veteran Business Enterprise (DVBE) participation requirement for this IFB; however, an incentive for bidders who include DVBE participation is available and encouraged. For evaluation purposes only, the State shall apply an incentive to bids that include California certified DVBE participation and confirmed by the State. The incentive amount will vary in conjunction with the percentage of DVBE participation in accordance with the following formula:
DVBE Incentive Participation of: DVBE Incentive:
5% or Over 5%
4% to 4.99% Inclusive 4% 3% to 3.99% Inclusive 3% 2% to 2.99% Inclusive 2% 1% to 1.99% Inclusive 1%
The net bid price of responsive bids with DVBE participation will be reduced (for evaluation purposes only) by the amount of DVBE incentive as applied to the lowest responsive net bid price. If the #1 ranked, responsive, responsible bid is a California certified small business, the only bidders eligible for the incentive will be other California certified small businesses. The incentive adjustment for awards based on low price cannot exceed 5% or $100,000.00, whichever is less, of the #1 ranked net proposal prices. When used in combination with a Small Business preference adjustment, the cumulative adjustment amount cannot exceed $100,000.00. Please note that a non-small business bidder with a DVBE Incentive preference may not displace a small business bidder [CA Code of Regulations, Title 2, 1896.99.100(c)].
Information submitted by the bidder to claim the DVBE incentive will be verified by the State. Only the DVBEs who shall perform a commercially useful function relevant to the Scope of Work included in this IFB may be used to qualify the bidder for a DVBE incentive.
For more information regarding the DVBE incentive, Commercially Useful Function definition, and how to find DVBEs, please view the following website:

EXAMPLE 2
Bidder Amount Bid DVBE Status Bidder A $50,000 No Bidder B $51,000 No Bidder C $51,100 DVBE 3%
Incentive Formula: low bid x 3% = equals the amount of the Incentive
COMPUTATION
$50,000 (low bid x .03 (DVBE) = $1,500 (incentive)
Bidder C bid: $ 51,100 Minus Incentive __1,500 Adjusted amount $ 49,600
After the application of the DVBE Incentive, Bidder C is the apparent low bidder.
B. Combining Preferences and Incentive
For evaluation purposes only if a bidder is eligible for Preferences and Incentives, they are calculated separately and then subtracted from their actual bid.
EXAMPLE 3
Bidder Amount Bid SB Status DVBE Status
Bidder A $50,000 No No
Bidder B $51,000 No No
Bidder C $53,100 Yes DVBE 3%
Calculations for Bidder C:
Step 1 - SB Preference Formula:
low bid x 5% = equals the amount of the preference $50,000 x .05 - $2,500 deduction
Step 2 - Incentive Formula:
low bid x 3% = equals the amount of the Incentive $50,000 (low bid x .03 (DVBE) = $1,500 deduction
Step 3 - Combined SB Preference and DVBE Incentive
$ 2,500 SB deduction
+ $ 1,500 DVBE deduction
$ 4,000 Total Deduction
Step 4 - Subtract preference amount from original bid to determine bid evaluation amount
$ 53,100
- $ 4,000
$ 49,100
BASED ON THE CALCULATION BIDDER C IS THE LOW BIDDER
