About this file
This document is a Memorandum for Procurement File documenting a restricted competition procurement decision for emergency services.
The Federal Bureau of Prisons' Field Acquisition Office, on behalf of Federal Correctional Institution (FCI) Ray Brook located in Ray Brook, New York, procured an emergency medical helicopter flight to transfer an inmate from Adirondack Health emergency department to Albany Medical for critical medical treatment that could not be provided at the referring facility. The acquisition was valued at $64,111.45 and was awarded to Rocky Mountain Holdings without competition based on unusual and compelling urgency under Federal Acquisition Regulation (FAR) Part 12.102(a), which permits restricted competition for acquisitions at or below the simplified acquisition threshold (SAT) when only one source is available. The contracting officer determined that the medical emergency situation did not allow time for regular competitive procurement methods when life and safety were at risk, and that the helicopter transfer needed to occur immediately. The price was determined to be fair and reasonable based on industry standards. The memorandum was certified on August 6, 2026, by Laurel Karnes, Contracting Officer with the Federal Bureau of Prisons Field Acquisition Office, Oversight, Assistance, and Training Section (OATS)-East-NER.

SUBJECT:

MEMORANDUM FOR PROCUREMENT FILE
FCI Ray Brook Emergency Airflight Restricted Competition-Unusual and compelling urgency IAW RFO 12.102(a)
REQUIRING AGENCY: DOJ/Bureau of Prisons, FCI Ray Brook, NY
RFO 12.102(a) For acquisitions valued at or below the simplified acquisition threshold (SAT), document the decision that only one source is available and the basis for the decision.
Federal Correctional Institution (FCI) Ray Brook, located in Ray Brook, NY, requires an emergency medical flight to transfer an inmate. The inmate was transported to the emergency department at Adirondack Health for a medical emergency, where they determined further medical treatment was needed that could not be conducted at Adirondack Health. The inmate required a helicopter transfer to Albany Medical. Due to the medical emergency, it was not reasonable to compete this requirement.
Instances of medical emergencies do not allow time for regular procurement methods when life and safety are at risk. It was inherent that the helicopter transfer immediately occur for the inmate. Competition requirements could not be met due to the unusual and compelling urgency.
The value of this acquisition is estimated to be $64,111.45. The price is determined to be fair and reasonable based on industry standards.
Restricting competition and awarding to Rocky Mountain Holdings is in the best interest of the Government and is consistent with the streamlined acquisition procedures of the Revolutionary Federal Acquisition Regulation Overhaul found at Part 12-Acquisition of Commercial Products and Commercial Services, 12.102(a) Restricting Competition.
