About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) submitted by the United States Department of Justice, United States Marshals Service, Asset Forfeiture Division.
The USMS seeks to increase the funding ceiling for existing contract 15M50026DA4400018 with RBEX Inc. by $490,000.00, raising the total contract value from $499,999.99 to $989,999.99. The requirement is for towing, storage, maintenance, and disposal of seized and forfeited vehicles in the Districts of North Carolina, South Carolina, and Georgia for a six-month period from August 17, 2026, through January 16, 2027. The vehicles include production-sized cars, trucks, vans, motorcycles, and similar assets. The justification is submitted under RFO Part 6.103-1, citing "only one responsible source and no other supplies or services will satisfy agency requirement" as the statutory authority under 41 USC 3304(a)(1).
The Government determined that RBEX Inc. is the sole source capable of providing these services without unacceptable delay and interruption to mission-critical functions. The contractor possesses existing infrastructure, organizational capability to mobilize at seizure sites with law enforcement, industry knowledge, and immediate service availability. The USMS developed an Independent Government Cost Estimate (IGCE) and determined pricing to be fair and reasonable based on the current contract schedule. A re-competition effort is underway with a new competitive solicitation planned for release by the second quarter of 2027. Notice of the single-source solicitation will be posted to System for Award Management (SAM) per FAR Subpart 5.2. The justification was approved by Supervisory Contracting Officer Eliana York and Contracting Officer Christopher F. Ottie on July 31, 2026.

Nature or Description of Action
The United States Marshals Service (USMS) is seeking to increase the funding ceiling availability to existing contract 15M50026DA4400018 in accordance with Revolutionary Federal Acquisition Regulation Overhaul (RFO) 6.103-1.
Description of Supply or Service
The United States Marshals Service (USMS) has a requirement for towing, storage, maintenance, and disposal of seized/forfeited vehicles in the Districts of North Carolina, South Carolina, and Georgia for a six (6) month period beginning on August 17, 2026, and ending January 16, 2027. The vehicles will include production-sized cars, trucks, vans, motorcycles, etc.
Estimated Total Value
Contract # 15M50026DA4400018 currently has a ceiling of $499,999.99. The total estimate value of the proposed modification to increase the contract ceiling is $490,000.00 which brings the total estimated value of the contract to $989,999.99.
Vendor’s Name RBEX Inc.
Indicate Statutory Authority for Contracting without Full and Open
Competition
6.103-1 Only one responsible source and no other supplies or services will satisfy agency requirement (41 USC 3304(a)(1))
Contractor’s unique qualifications
The current contractor RBEX Inc. successfully provides the ongoing services and has an existing infrastructure and organizational plan established to process this asset type. The incumbent has the capability to be at relocation sites with law enforcement agencies at time of seizure or post investigative custody to move the required motor vehicle to its existing storage facility. The incumbent has the industry knowledge to provide these services to the USMS, along with superior service. In addition, the vendor can provide all services and supplies immediately as it has an existing footprint and can mobilize immediately, as needed. This ability is invaluable from a law enforcement, governmental, and logistical perspective. This ability allows the USMS to act nimbly in any given situation and provide seamless services to the United States Government.
As previously stated, the incumbent is the only source that can provide the required services on an ongoing basis without unacceptable delay and interruption, which would otherwise result in significant adverse impact to the agency’s mission. Therefore, the Government minimum needs can only be satisfied by RBEX Inc. until the re-competition effort gets underway for the new award to be released by 2nd QTR 2027.
Efforts made to Promote Competition
Due to the time constraints, necessity for continuity of services, and the existing successful operable contract with RBEX Inc., Inc., requirements to foster competition at this time are not reasonable nor in the best interest of the Government. At this time, a funded increase in the current ceiling is needed for the continued custody maintenance, and disposal of the seized assets in the USMS' inventory. Actions to foster competition are being duly pursued under the re-competition effort, which is currently underway.
In addition, the notice to solicit and negotiate with only one source will be posted to the GPE/System for Award Management (SAM) https://www.sam.gov/ as per FAR Subpart 5.2.
Method for Determining Fair and
Reasonable Pricing
The Government developed an Independent Government Cost Estimate (IGCE) in preparation of the request for ceiling increase and confirmed and identified prices expected to be paid for the required services are as per current schedule. Based on the above, the Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable, because there is substantial and accurate information available to conduct price analysis per RFO 15.404-1(b)(v), assuming the expected value of this procurement falls within the estimated threshold of the IGCE.
Results of Market research
Market research (RFO Part 10) is underway and is being conducted to identify potential sources. The USMS does not intend to change its competitive procurement strategy on the re-compete effort for these services.
Based on the above, this action to increase the current ceiling for the contract to the incumbent, RBEX Inc., is the most advantageous method to meet the AFD’s current mission. This course of action is the most cost-effective acquisition strategy, and it will prevent unacceptable delays and service interruption to the critical support and services for the assets in custody and currently identified under this contract.
Any Other Facts Supporting the use of Other Than Full and Open
Competition
Without approval for this Justification, the AFD will be unable to continue custody and manage the sizable inventory. Failure to continue with the required services will also reduce operational effectiveness during future seizure and forfeiture operations, limit collection and liquidation capabilities, delay operational deployment timelines, and increase overall mission risk.
The ceiling increase under the remaining period of performance time frame under the current contract is essential to provide the stability needed to execute mission critical functions while the USMS can duly prepare and execute a new competitive acquisition. It will also allow the requirement be further refined and completely vetted against the existing regulatory framework and all applicable emerging guidelines.
Interested Sources
The notice to solicit and negotiate with only one source will be posted to the GPE/System for Award Management (SAM) https://www.sam.gov/ as per RFO Subpart 5.2. All responses will be duly recorded as part of the contract action.
