About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) document for a federal contract negotiated procurement.
The United States Marshals Service (USMS) Asset Forfeiture Division seeks to award a sole-source contract to RBEX, Inc. for towing, storage, maintenance, and disposal services for seized and forfeited vehicles across the Districts of Virginia, Maryland, Washington D.C., Delaware, Eastern Pennsylvania, and Middle Pennsylvania. The requirement covers production-sized vehicles including cars, trucks, vans, and motorcycles, as well as specialty vehicles such as all-terrain vehicles, golf carts, and jet skis. The contract period is twelve months beginning June 20, 2026 and ending June 19, 2027, with an estimated total value of $499,999.00. The statutory authority for this non-competitive procurement is 41 U.S.C. Section 3304(a)(1), justified under the rationale that RBEX, Inc. is the only responsible source capable of satisfying agency requirements without unacceptable delay or mission interruption. The incumbent contractor possesses the existing infrastructure, organizational capability, and immediate mobilization capacity required to maintain continuity of services from the current task order ending June 19, 2026. Price reasonableness will be determined through price analysis using an Independent Government Cost Estimate (IGCE) compared against the vendor's informal quote. The USMS will post notice of the sole-source solicitation to the System for Award Management (SAM) on June 5, 2026, and plans to conduct a competitive recompete for subsequent awards by the second quarter of 2027. The Contracting Officer and Supervisory Contracting Officer approved this justification on June 5, 2026.

Contractor’s unique qualifications
The U.S. Marshal Service (USMS) has a requirement for towing/transporting, appraisal, storage, maintenance, and disposal services for motor vehicles, commercial and passenger. Additionally, these same services may be required for specialty vehicles such as but not limited to motorcycles, all-terrain vehicles, golf carts, jet skis, trailer able boats. The current task order for the execution of the above stated services ends on June 19, 2026, and due to competing requirements and limited resource allocation to ensure compliance and alignment with all applicable federal regulations, the Procurement Unit has been unable to conduct a follow-on acquisition in the available timeline. The current contractor RBEX Inc. successfully provides the ongoing services and has an existing infrastructure and organizational plan established to process this asset type. The incumbent has the capability to be at relocation sites with law enforcement agencies at time of seizure or post investigative custody to move the required motor vehicle to its existing storage facility.
The incumbent has the industry knowledge to provide these services to the USMS, along with superior service. In addition, the vendor can provide all services and supplies immediately as it has an existing footprint and can mobilize immediately, as needed. This ability is invaluable from a law enforcement, governmental, and logistical perspective. This ability allows the USMS to act nimbly in any given situation and provide seamless services to the United States Government.
As previously stated, the incumbent is the only source that can provide the required services on an ongoing basis without unacceptable delay and interruption, which would otherwise result in significant adverse impact on the agency’s mission.
Therefore, the Government minimum needs can only be satisfied by RBEX Inc. until the re-competition effort gets underway for the new award to be released by 2nd QTR 2027.
The Government determined that RBEX Inc. is the only known source capable of fulfilling this requirement without unacceptable risk to mission execution, operational readiness, and law enforcement effectiveness.
Efforts made to Promote Competition
Due to the time constraints, the need for continuity of services, and the existing successful operable contract with RBEX, Inc., requirements to foster competition at this time are neither reasonable nor in the best interest of the Government.
Accordingly, it was determined the only suitable acquisition strategy was to solicit a proposal from the current incumbent contractor. Actions to foster full and open competition are being pursued upon the subsequent recompete, which is underway.
The notice to solicit and negotiate with only one source will be posted to the GPE/System for Award Management (SAM) https://www.sam.gov/ as per RFO Subpart 5.2 on May 11, 2026. The Government will continue to assess the commercial marketplace during future acquisition planning to determine whether additional vendors develop equivalent integration
Revision dated 10 August 2025 capabilities for all services encompassed under this effort to support AFD’s requirements in full.
Future market research efforts may include broader industry engagement, Requests for Information (RFIs), and continued monitoring of emerging entities.
Method for Determining Fair and
Reasonable Pricing
The Contracting Officer (CO) will determine price fair and reasonable using price analysis techniques in accordance with RFO 15.404-1(b)(2).
The Government developed an Independent Government Cost Estimate (IGCE) based on market research, commercially available pricing information for comparable services, and historical procurement knowledge.
The vendor’s informal quote will be evaluated against the IGCE to assess price reasonableness for all the services provided under this procurement.
Based on the comparison of the vendor’s informal quote to the IGCE and the results of market research, the CO has sufficient price analysis documentation to support a fair and reasonable price determination.
Results of Market research
Market research (RFO Part 10) is underway and is being conducted to identify potential sources.
The USMS does not intend to change its competitive procurement strategy on the re-compete effort for these services, which has been delayed due to the reasons cited in this document.
Based on the above, this action to award a sole source to the incumbent, RBEX, Inc. is the most advantageous method to meet the AFD’s current mission. This course of action is the most cost-effective acquisition strategy, and it will prevent unacceptable delays and service interruption to the critical support and services for the assets in custody and currently identified under this contract.

Interested Sources
The notice to solicit and negotiate with only one source will be posted to the GPE/System for Award Management (SAM) https://www.sam.gov/ as per RFO Subpart 5.2 on June 5, 2026.
The USMS will collect capabilities statements, if available from interested sources, and will add them to the ongoing market research. At this moment, the USMS does not intend to change its competitive procurement strategy for these services, which has been delayed due to the reasons cited in this document.
