This is a Justification Review Document for a FAR Part 12 Sole Source Justification and Approval for a four-month bridge contract.

The U.S. Army Garrison-Fort Leavenworth (USAG-FL) seeks to award a $393,000 firm-fixed-price (FFP) noncompetitive contract to the City of Leavenworth, Kansas (CAGE: 0CKX7) for wastewater services from July 1, 2026 through October 31, 2026. The contracting activity is the U.S. Army Mission and Installation Contracting Command (MICC) at Fort Sam Houston, Texas. The service requirement involves furnishing and maintaining a wastewater connection and treatment facility to receive, transport, treat, and dispose of wastewater originating at Fort Leavenworth with an estimated annual volume of 240,000,000 gallons. The City of Leavenworth operates the only treatment plant with a direct connection to the installation's wastewater infrastructure; there are no alternative treatment facilities in the geographical vicinity and no other competitive sources available.

The justification cites an unusual and compelling urgency as the authority for sole source procurement under FAR 12.201-1. The delay stems from a pending rate increase that the City of Leavenworth cannot legally apply until its municipal ordinance is enacted in August 2026. Both parties agreed to a four-month bridge contract at the current undisputed rate to ensure continuity of service while rate certification proceeds. Without continued wastewater service, the installation faces significant health and environmental hazards from accumulated raw sewage and would violate EPA discharge requirements. The document notes over 10 years of successful performance by the incumbent contractor with no issues. Two prior sole source contracts with this vendor are documented (W9124J-16-C-0020 for $7,432,750 from 2016–2026 and W91QF4-06-C-0003 for $5,981,846 from 2006–2016).
