About this file

This is a Request for Information (RFI) issued by the Department of Homeland Security's Immigration and Customs Enforcement (ICE) agency for turn-key detention services. The RFI number is 70CDCR26RFI000020 and addresses the establishment of detention facilities in four geographic areas of responsibility: Seattle, Philadelphia, Miami, and Denver. The Government intends to award four single-award IDIQs (Indefinite Delivery/Indefinite Quantity contracts), with one facility per region.

The evaluation will employ a two-phase competitive process using a best value tradeoff approach. Phase 1 is a pass/fail readiness screening to determine if offerors can realistically be operational by the required start date, with illustrative criteria including legal control of the proposed facility, minimum bed capacity and configurations, compliance with building and fire safety requirements, zoning and licensing approvals, adequate staffing pipelines, identification of key facility leadership and security systems, and submission of environmental and site information for NEPA review. Phase 2 applies to offerors passing Phase 1 and evaluates three factors: Factor 1—Environmental/NEPA Information (completeness and quality of environmental documentation); Factor 2—Staffing and Management including past performance (robustness and realism of staffing and management approach for detention facility operations); and Factor 3—Price (reasonableness of proposed pricing for a hybrid FFP and Labor Hour/Time and Materials CLIN structure). Factor 2 is weighted as more important than Factor 1, and Factors 1 and 2 combined are significantly more important than Factor 3. The Source Selection Authority may award to other than the lowest-priced offeror if technical and management benefits justify the price premium. This RFI is issued for market research purposes only under FAR Part 10 and does not constitute a formal solicitation; responses are not offers, will not be accepted to form binding contracts, and will not obligate the Government to issue a solicitation.

Department of Homeland Security (DHS)

United States Immigration and Customs Enforcement (ICE)

THIS IS A REQUEST FOR INFORMATION (RFI) - 70CDCR26RFI000020

Turn-Key Detention Services

The evaluation strategy will use a best value tradeoff approach in accordance with Revolutionary FAR Overhaul (RFO) Subpart 15.2. Award will be made to the offeror whose proposal is most advantageous to the Government, considering price and non-price factors. Lowest Price Technically Acceptable (LPTA) will not be used.

The Government will use a two-phase competitive evaluation process for each of the four single award IDIQs (Seattle, Philadelphia, Miami, and Denver Areas of Responsibility):

• Phase 1: Pass/Fail Readiness Screening

• Phase 2: Best Value Tradeoff among offerors who pass Phase 1.

Phase 1 – Pass/Fail Readiness Screening

Phase 1 will be a limited, screening phase to ensure only offerors that can realistically be operational by the required date advance to full evaluation.

Evaluation will be pass/fail only; no tradeoffs or adjectival ratings.

Illustrative criteria (to be finalized in the solicitation) include whether the offeror:

– Has legal control of the proposed facility (ownership or long-term lease) and can make it available for ICE use by the required start date.

– Can provide at least the minimum required number of beds and required configurations for the facility.

– Can meet applicable building, fire, and life safety requirements and obtain necessary occupancy approvals by the required date.

– Has zoning, licensing, and other local approvals in place or a credible path to obtain them on time.

– Has an adequate staffing pipeline and training schedule to safely house the required number of detainees on the required start date.

– Has identified key facility leadership and core security/control systems that will be in place by the required start date.

– Provides the environmental and site information needed to support the Government’s NEPA review

(with the Government intending to pursue a categorical exclusion, if appropriate).

Offerors must pass all Phase 1 criteria for a given facility to advance to Phase 2 for that facility.

Phase 2 – Technical Evaluation/Price

Offerors who pass Phase 1 will be evaluated under a best value tradeoff in accordance with RFO 15.103-1. Phase 2 will use a streamlined set of factors:

• Factor 1 – Environmental / NEPA Information

– Evaluates the completeness and quality of environmental and site information needed to support DHS

NEPA requirements and the Government’s intent to pursue a CATEX where appropriate.

• Factor 2 – Staffing and Management (including relevant past performance)

– Evaluates the robustness and realism of the offeror’s ongoing staffing and management approach to operate the Contract Detention Facility, informed by relevant past performance operating similar detention or correctional facilities.

– Evaluates a complete and adequate proposed staffing plan.

• Factor 3 – Price

– Evaluates the reasonableness (and, as applicable, realism) of proposed pricing for the hybrid FFP and Labor Hour/Time and Materials CLIN structure.

Relative Importance Factor 2 (Staffing and Management) is more important than Factor 1 (Environmental / NEPA Information). Factors 1 and 2 combined are significantly more important than Factor 3 (Price). As technical and management differences among proposals narrow, price will become more important in the trade-off decision.

The Source Selection Authority will perform an integrated best value tradeoff for each facility and may award to other than the lowest priced offeror if the technical and management benefits are judged to justify the price premium.
