About this file
This document is a Request for Information (RFI) issued by the National Oceanic and Atmospheric Administration (NOAA) Fisheries, Office of Management and Budget's Facilities, Safety and Logistics Division. The purpose is to obtain information from industry on potential sources capable of performing services for identifying controlled technology and developing related controls and training.
The key requirements include: 1) Conducting technology assessments at NOAA Fisheries locations to develop a baseline-controlled technology inventory, 2) Reviewing and providing recommendations to improve existing Facility/Vessel Controlled Technology Plans, and 3) Developing and conducting training to enable Fisheries Controlled Technology Points of Contact to maintain the inventory, develop additional controls, and determine when export licenses are required. The Government estimates the rough order of magnitude (ROM) for this requirement to be between $2.5M and $5M. Responses are due by 5:00 PM Mountain Time on June 28, 2024.

REQUEST FOR INFORMATION (RFI)
This Request for Information (RFI) is to obtain information from industry for potential sources capable of performing services for identifying controlled technology services. Potential sources must have experienced personnel who possess an understanding of Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), and Office of Foreign Asset Control (OFAC) regulations. The contractor will be tasked with assisting Fisheries in developing a baseline-controlled technology inventory and providing recommendations on controls that could be used to prevent the unauthorized release of technology across all its 163 locations to include any Fisheries owned research vessels. Additionally, the contractor will develop training to enable Fisheries Controlled Technology Points of Contact to maintain and update the baseline inventory, develop additional controls if needed, and how to determine if an export license is required and the process for obtaining the license if needed.
This RFI is for planning purposes only and is not a Request for Quotes (RFQ), Request for Proposals (RFP), Invitation for Bids (IFB) or an obligation on the part of the Government to acquire any services. Responses to this RFI are not offers and can/will not be accepted by the Government to form a binding contract. The Government reserves the right to determine how it should proceed as a result of this notice. This is Market Research Only in accordance with FAR Part 10. All costs associated with responding to this RFI are solely at the responding parties' expense. Respondents are solely responsible for properly marking and clearly identifying any proprietary information or trade secrets contained within their response. The Government will not be liable for or suffer any consequential damages for any proprietary information not properly marked and clearly identified. Proprietary information received in response to this notice will be safeguarded and handled in accordance with the Trade Secrets Act (18 U.S.C. 1905). No determination as to the viability of this potential requirement has been made at this point and there is currently no solicitation for this effort. By responding to this market research you provide the Government permission to share your submitted capabilities and contract information with other Government organizations in relationship to similar requirements for market research purposes.
The Government will not pay for any materials provided in response to this notice and submittals will not be returned to the sender. This notice does not obligate the Government to award a contract, issue a solicitation, reimburse respondents for any proposal preparation and/or submittal costs, nor does its issuance in any way restrict the Government as to its ultimate acquisition approach.
NOAA’s NMFS, Office of Management and Budget’s Facilities, Safety and Logistics Division, is seeking potential sources that can provide the following requirements:
1. Conduct a technology assessment at NOAA Fisheries locations throughout the U.S. and its territories, including any Fisheries owned research vessels to develop a baseline-controlled technology inventory specific to that location. An example of a controlled technology inventory spreadsheet is as follow: Equipment/Technology Name, Description, Property ID (if applicable), City, Sate, Building Name, Responsible NOAA Manager
2. Review existing Facility/Vessel Controlled Technology Plan for each NOAA Fisheries location and provide recommendations for improving controls listed to prevent the unauthorized release of technology at that specific location or research vessel. An example of a Controlled Technology Plan is as follows: Purpose, General Rule for Reporting Foreign Persons, References, Export Controlled Technology in the Facility, Location of Classified Materials/Information, Controlled Unclassified Information in the Facility, Physical Steps to Prevent Technology Transfer, Logical Assess, Physical Security measures, Safety Concerns with Foreign Nationals, Awareness and Training, and Reporting of Suspicious Behavior.
3. Develop and conduct training to enable Fisheries Controlled Technology Points of Contact to maintain and update their baseline inventory, develop additional controls if needed, and how to determine if/when an export license is required and the process for obtaining the license if needed. This training can be specific to each location or can be more general to cover all of Fisheries. The contractor will need to determine what level of training is needed.
In response to this RFI, you are requested to provide the following information:
1. Company Name, Existing Contract Vehicles and Contract # (if applicable), Socio-Economic Status and SAM Unique Entity ID.
2. A brief capability statement of how your company can meet the general performance and security requirements necessary to meet the requirements listed above.
3. At least one example of your company’s experience performing export controls assessments on a large organization within the last five years. Contractor must include in its response the applicable contract #, awarding agency or business, period of performance, award amount and details of the work performed.
4. The Government is interested in obtaining Industry’s perspective of potential specialization that may be needed to perform the work requirements necessary to conduct the Assessment, make recommendations for the Controlled Technology Plan and deliver Training.
5. The Government estimates the ROM for this requirement to between $2.5M and $5M. The Government requests any Industry comments on the feasibility of this ROM and what key cost drivers should be considered.
Please email your questions or comments regarding the RFI to Hannah Montoya (Contracting Officer) at hannah.montoya@noaa.gov. Respondents are advised that questions, comments and Government responses may be posted publicly on SAM.gov, although the identity of the requesting organization will be withheld.
Responses are due no later than 5:00 PM Mountain Time on June 28, 2024. Late submissions may not be accepted or reviewed. In order to ensure timely response and consideration of your feedback, we ask each company to limit itself to one (1) response. Please submit all responses to hannah.montoya@noaa.gov.
