About this file
Orange County, New York, through its Department of General Services, has issued a Request for Bid (RFB-OC126-25) for rubbish and recycling removal services at various county facilities. The solicitation covers comprehensive waste and recycling collection services for 36 different locations throughout Orange County, including government centers, correctional facilities, parks, maintenance garages, and other county-owned properties. The initial contract term is two years, with potential renewal options for two additional one-year terms and a possible short-term extension of up to two or three months. Bids are due on October 2, 2025, at 3:00 P.M., with bid documents available starting September 17, 2025, through the county's website and BidNet.
The pricing structure is based on per-pickup charges for different container sizes ranging from 2 to 40 cubic yards, with varying collection frequencies including once per week, twice per week, and bi-weekly services. Some locations have seasonal pickup schedules, particularly for parks and outdoor facilities. The bid includes optional additional services such as lock bar devices for containers and charges for contaminated recyclables. Bidders must be licensed solid waste haulers, have a minimum of three years of experience, and provide detailed equipment information. The county encourages submissions from Minority- and Women-Owned Business Enterprises (MWBE) and Disadvantaged Business Enterprises (DBE). All rubbish and recycling must be transported to the Orange County Transfer Station No. 1 in New Hampton, New York, in compliance with applicable environmental regulations.

1. Licensed Solid Waste Hauler. Bidder must be a properly licensed solid waste hauler pursuant to Orange County
Local Law No. 2 of 1989, and the regulations promulgated thereunder as may be subsequently amended from time to time during the Contract Term. Bidder is solely responsible for the cost and expense of applying for, and maintaining, such licensing. Bidder must include a copy of its license in its bid package submitted in response to this RFB.

PO Box 218, 255-275 Main St.
Goshen, New York 10924
ARTICLE III
EQUIPMENT
1. Container Types and Labeling. Vendor will provide containers bearing labels identifying waste type for the collection of rubbish and single stream recyclables in the quantities and sizes specified on the Bid Form or as thereafter added during the Contract Term as contemplated in Section 3 of this Article III. Paper fiber and commingled recyclables can be commingled in one container for single stream recyclables at each location.
Containers must be leak-proof and in good operating condition. Unless otherwise specified by the County, Vendor will provide front loader dumpster type containers with lids and 40-cubic yard self-contained compactors that will be approved by the County prior to placement. All costs associated with the provision of containers and/or compactors must be included in the “per pick-up” price on the Bid Form (see also Section 2 of the Pricing portion of this RFB).
2. Containers Requiring Lock Bars. At the time of publication of this RFB, front loader containers at the Newburgh
Armory, O.C. Woolworth Building, and Orange County Airport Maintenance Garage, and as may be otherwise specified by the County, must be provided with lock bar devices to prevent unauthorized use of the containers.
3. Changes in Equipment; Coordination. All requests for a change in container quantity or size will be coordinated with the Director of Professional Services through the Orange County Department of Public Works Division of Buildings and Grounds. Vendor shall coordinate with the Facility Manager (and/or the Director of Professional Services) prior to delivering, replacing, and/or relocating equipment at any County location.
4. Preventative Maintenance; Response Time. Vendor is responsible for all preventative maintenance of, and repairs to, containers and compactors, at Vendor’s sole cost and expense including, but not limited to labor, travel costs, parts, and supplies. If any containers, compactors, or other equipment is repaired or any preventative maintenance is performed, Vendor is responsible for cleanup and removal of any resultant waste or products. If compactor is malfunctioning or inoperable, Vendor will respond to County’s request for diagnostics and repairs within four (4) hours of the County’s request for service. Scheduling, simply returning a phone call, or having untrained or unprepared staff arrive at the County location where the container and/or compactor is located does not constitute meeting the response time requirement.
5. Bidder’s Equipment. Bidder must furnish with its bid a list and description with photos and technical literature of all equipment owned and/or leased by Vendor that will be provided for the performance of the services described in these Specifications should bidder be awarded the Contract. 1. Collection and Schedule. Vendor shall ensure that all rubbish and recycling from containers and/or compactors is collected at each of the County locations identified on the Bid Form on the scheduled day of the week, and at the frequency as provided on the Bid Form in this RFB. All pickups must be performed in a timely manner to limit and minimize disruption to County operations. Vendor must strictly adhere to the specific pickup schedules (days of the week) and frequencies for each of the County locations as set forth on the Bid form unless a scheduled pickup day falls on a County holiday in which case Vendor may substitute either the preceding or
PO Box 218, 255-275 Main St.
Goshen, New York 10924 subsequent workday as the pickup day at no additional charge. If Vendor would like to propose an alternate pickup schedule (days of the week) for any County locations, bidder must include such proposed alternate pickup schedule (days of the week) in its bid package submitted in response to this RFB for the County’s review and approval. The County may, in its sole and absolute discretion accept or reject, in whole or in part, the proposed alternate pickup schedule(s).
2. Changes in Collection Locations. Vendor will provide rubbish and recycling removal at only those locations designated by the County. County reserves the right to discontinue services at a location identified on the Bid Form if the County no longer occupies the location or if the services are no longer required at that County location. County reserves the right to add any other County location(s) as may be occupied, purchased, leased, and/or rented by the County during the Contract Term should those locations require the services described in these Specifications. In the event the County adds one or more locations during the Contract Term, the pricing for any such added location(s) will be no more than that price set forth in Section 1 on the Bid Form for the location nearest the newly added location having the same size container and same pickup frequency.
3. Changes in Pickup Frequency; Coordination. All requests for a change in pickup frequency and on-call service will be coordinated with the Director of Professional Services through the Orange County Department of Public Works Division of Buildings and Grounds.
4. Hauling and Disposal. All rubbish and recycling collected by Vendor pursuant to these Specifications must be transported to, and properly disposed of at the Orange County Transfer Station No. 1 located at 21 Fire Training Center Lane in New Hampton, New York (“OC Transfer Station #1”) in accordance with all applicable laws, statutes, codes, rules, and regulations including, but not limited to those promulgated by the Federal Environmental Protection Agency (EPA), the New York State Department of Environmental Conservation (NYSDEC), and the County of Orange.
5. Tickets. The OC Transfer Station #1 issues a ticket to each hauler who disposes waste at the OC Transfer Station
#1. Vendor will submit each such ticket with Vendor’s invoice to the County for services performed under the Contract.
6. Hazardous Waste. In addition to the indemnification obligations set forth in the Contract, Vendor further agrees to defend, indemnify, and hold harmless the County, including its officials, employees, and agents against all claims, losses, damages, liabilities, costs, and expenses (including, without limitation, reasonable attorney fees and costs of litigation and/or settlement), for all acts of the Vendor, its employees, representative, subcontractors, assignees, or agents in transporting and disposing County waste under the Contract, including claims or actions for hazardous waste disposal anywhere other than OC Transfer Station #1.
TERM
1. Initial Term and Potential Renewal Terms. County anticipates that the initial term of the Contract will be for a period of two (2) years (“Initial Term”). County reserves the right, exercisable in its sole discretion, to renew the contract term for two (2) additional periods of one (1) year each (each, a “Renewal Term”) on the same conditions and obligations as set forth in the Contract. If County exercises its option to renew as stated in this section, Vendor must execute a change order or amendment to the Contract memorializing such renewal.
Vendor must return the executed change order or amendment to County by the date provided in the correspondence accompanying such change order or amendment.
PO Box 218, 255-275 Main St.
Goshen, New York 10924
2. Potential Extended Term. Upon expiration of the Initial Term or Renewal Term, if exercised by County as stated above, such term may be further extended unilaterally by County for an additional period of up to two (2) months under the same terms and conditions set forth in the Contract including, but not limited to, quantities (prorated for such extension), prices, and delivery requirements. With the concurrence of Vendor, such short-term extension may be for a period of up to three (3) months in lieu of the up to two (2)-month period. Any such short-term extension shall be referred to as an “Extended Term.” Vendor must execute a change order or amendment to the Contract memorializing such Extended Term. Vendor must return the executed change order or amendment to County by the date provided in the correspondence accompanying such change order or amendment.
PRICING
1. We do not accept any conditional bids (i.e.: minimum quantities, minimum dollar amount orders).
2. Submission of Pricing on Bid Form. Pricing must be submitted on the Bid Form provided in this RFB. All prices provided on the Bid Form must be all-inclusive, considering travel to and from the locations where the services are to be performed, all labor, tools, equipment (including containers and/or compactors), supplies, and materials (if any) required to perform all services specified in the Specifications portion of this RFB, together with the tipping fees and load fees, if any for disposal of the rubbish and recycling at OC Transfer Station #1. No separate travel time or other charges/fees (including rental fees for containers and/or compactors) will be paid by the County under the Contract. No freight and/or handling, fuel, inflation, or other surcharges will be accepted.
3. Extended Term Pricing. In the event of an Extended Term (as discussed in Section 2 of the Term portion of this
RFB), the rates from the immediately preceding Initial Term or Renewal Term, as applicable, will apply throughout the duration of such Extended Term with no adjustment permitted.
4. No Taxes. The prices submitted shall be exclusive of federal and state sales taxes (or other taxes inapplicable to government entities) and must not include any tax for which the bidder may claim exemption because of doing business with the County.
5. No Surcharges. Unless otherwise indicated in this RFB, prices shall be net, including transportation and delivery charges fully prepaid by the Vendor to the destination indicated in the purchase order. Prices are to be listed as FOB Delivered: ORANGE COUNTY, NY. No freight and/or handling or fuel surcharges will be accepted, unless otherwise agreed to in the purchase order. Delivery of all products will be made free of transportation charges;
the prices bid by Vendor being delivered prices.
6. No Change to Specification. At no time shall any change to price and product specification be permitted for the entire term of the award, except where an item has been replaced by another item due to obsolescence. In this instance, the County must approve a change of product in a written change order for it to be valid. In the event a product substitution is approved, no change in price will be permitted except when the price is equal to or lower than the originally awarded price.
7. No Guaranteed Volume or Quantities. The proposed Scope and Specifications are not a guarantee, were developed based on past or anticipated needs, and are as accurate as the County can ascertain at the time of issuance of this RFB. When an anticipated volume or other quantities or goods or services are listed, the County has listed these either based upon a history of usage over a previous period or anticipated need. The County
PO Box 218, 255-275 Main St.
Goshen, New York 10924 in no way guarantees that the actual quantities listed will be ordered. When volume or quantities are listed, the bidder should understand that the actual volume or quantities may be more or less, depending on the actual needs of the County. The bidder shall hold the County harmless against any damages because of estimated volume or quantities. In the event quantities exceed the estimate, the County shall receive the price as listed in the award or, if a better price is available at that time, that price shall be passed on to the County.
8. Payment of Prevailing Wage Requirements. Prevailing Wage rates apply to certain work under the contract awarded under this RFB and are specified in the Prevailing Wage Schedule PRC#2025901059 which is incorporated by reference. The Prevailing Wage Schedule and any supplements may be found by entering the PRC# at: https://apps.labor.ny.gov/wpp/showFindProject.do?method=showIt. Pursuant to New York State Labor Law, Vendor is required to pay the prevailing hourly wage rates and supplements, as may be updated by the New York State Department of Labor, throughout the Contract Term, including any renewals or extensions.
The New York State Department of Labor may revise Prevailing Wage Schedules throughout the year. Bid pricing should account for any such increase in Prevailing Wage rates as change orders due to increased Prevailing Wage rates shall not be permitted. Offerors are strongly encouraged to review archived Prevailing Wage Schedules at: https://dol.ny.gov/public-work-archived-wage-schedules prior to bid submission, to ensure that their pricing will be competitive. Vendor shall be responsible for all Prevailing Wage and Supplement increases regardless of when or how often they are implemented while maintaining the prices submitted in their bid.

The pricing provided in Section 2 of the Bid Form will not be considered when determining the lowest responsive and responsible bidder.
