Project design and engineering are furnished by the City. The Contractor has no project design obligations and remains responsible for construction means, methods, and safety.

All Local, County, State, and Federal codes and regulations must be followed.

Once a contract is executed between the City of Douglasville and the successful Bidder, the successful

Bidder will be required to perform the work with the project team identified in its bid. The City of

Douglasville must approve in writing any change in, or substitution of, key project team members, contractors, or subcontractors.

B. Time for Performance

TIME FOR PERFORMANCE: The maximum time allowed for completion of all work shall be twenty-six (26) weeks, equivalent to one hundred eighty-two (182) calendar days, after the date specified in the written

Notice to Proceed. Each bidder shall state a committed completion period that does not exceed this maximum and provide a proposed schedule accounting for equipment procurement and delivery, installation, testing, and final completion. The successful bidder’s stated completion period shall be incorporated into the Agreement.

Brightstar Rd at Brightstar Connector Intersection Improvements and be submitted via Bidnet Direct at https://www.Bidnetdirect.com no later than the deadline stated in the RFB Estimated Timeline.

Questions and answers will be issued by written addendum and posted on Bidnet Direct.

Only written addenda issued by the City modifies the solicitation. Oral statements do not modify the solicitation. Bidders shall identify in their bids every addendum received by number and date.

Please contact Alyssa Gordon, Procurement Manager at gordona@douglasvillega.gov if further assistance is needed. All firms are responsible for checking Bidnet Direct at https://www.Bidnetdirect.com on a regular basis for updates, clarifications, and announcements.

The City of Douglasville reserves the right to communicate by electronic mail with the primary contact listed in the bidder’s response to the RFB.

From the issue date of this RFB until a final award is made, bidders are prohibited from communicating about this solicitation or Project with City of Douglasville staff or elected officials except as expressly permitted in the RFB. Questions must be submitted as instructed in this solicitation. Unauthorized contact may result in rejection of the offending bidder’s bid.

E. Submission of Bids

Sealed bids shall be completed and submitted electronically in PDF format through Bidnet Direct at http://www.Bidnetdirect.com by October 26, 2026 at 4 PM EDT. The entire submittal should be submitted as one (1) PDF file. Please do not submit individual documents or sections separately.

Electronic submittals must reference RFB 2026-008 – Brightstar Rd at Brightstar Connector Intersection

Improvements. Late bids will not be accepted.

BID PRICING REQUIREMENTS: Bidders shall fully complete the Bid Schedule in Exhibit A, provide an actual, firm price for each item requiring bidder pricing, and submit an actual total lump sum bid for completing the work required by the Contract Documents. The total bid amount entered in BidNet Direct shall match the total bid amount shown in Exhibit A.

Nominal amounts, including one dollar ($1.00), shall not be used as placeholders in place of actual bid pricing. A low or zero price that represents the bidder’s actual, binding offer is not, by itself, a placeholder.

All required bid pricing must be submitted by the bid submission deadline. Bidders will not be permitted to supply missing prices, replace placeholder amounts with new prices, or otherwise materially revise their bid pricing after the deadline.

A bid containing omitted, placeholder, or inconsistent pricing that constitutes a material deviation from the solicitation requirements will be deemed nonresponsive and rejected. Material pricing defects include those that prevent determination of the bidder’s binding price or commitment to perform the required work or prevent comparison of bids on the advertised basis.

https://www.bidnetdirect.com/ mailto:gordona@douglasvillega.gov https://www.bidnetdirect.com/ http://www.bidnetdirect.com/

It is the sole responsibility of the bidder to ensure timely electronic delivery. No submittals will be accepted after the stated bid deadline.

All expenses for preparing and submitting bids are the sole cost of the bidder. The City is not obligated to reimburse such expenses. All submittals become the property of the City of Douglasville upon receipt.

Labeling information “proprietary,” “confidential,” or otherwise restricted does not exempt it from disclosure under the Georgia Open Records Act.

Bid records will be handled in accordance with applicable Georgia law and City procedures.

Any questions regarding this RFB should be submitted as directed in the Requests for Information section.

If further assistance is needed, contact Alyssa Gordon, Procurement Manager, gordona@douglasvillega.gov.

Every bid shall include pricing for all labor and materials, including the cost of payment and performance bonds and unclassified site work, as applicable. Each bid shall be accompanied by a bid bond in the amount of five percent (5%) of the bid. A performance bond and payment bond, each in the amount of one hundred percent (100%) of the contract sum and for the term of the contract, will be required from the successful bidder.

All bids must be accompanied by a Certificate of Insurance to include General Liability Insurance with limits of no less than $1 million per occurrence and $2 million aggregate, and a general liability umbrella policy with a limit of no less than $1 million aggregate; Worker’s Compensation coverage as provided by

Georgia law; Temporary Facilities and Equipment; and Builder’s Risk Insurance. All bonds and insurance policies shall be written by surety companies with an overall A.M. Best rating of A- (Excellent) or better, listed in U.S. Treasury Circular 570, and licensed to do business in the State of Georgia. Such policies shall provide for jurisdiction and venue in Douglas County, Georgia, for resolution of disputes.

A bidder may withdraw its bid through Bidnet Direct, or by written request, before the bid submission deadline. After the bid deadline, a bid may be withdrawn only as permitted by applicable law and subject to any consequences applicable to the bid security. Prior to Notice to Proceed, the Contractor shall present a Liability Insurance Certificate naming the City of Douglasville as an Additional Insured. The

Contractor shall be responsible for injuries or damages resulting from the work to persons or property.

The City reserves the right to reject any or all bids, cancel or readvertise the solicitation, and waive minor informalities or irregularities where permitted. In determining whether a bidder is reliable and capable of performing the work, the City may consider documented past performance and other mandatory responsibility requirements stated in this RFB. Without limiting the foregoing, the City may reject the bid of a bidder that has, within the last five (5) years:

a. Failed to complete on time a similar contract due to delays caused by the bidder or non-conforming work performed by the bidder; or

b. Incurred criminal sanctions against the company or any current bidder officer; or

c. Had its bonding company pay a claim against the bidder’s payment or performance bond due to the bidder’s failure to perform.

H. Bid Evaluation, Reliability, and Award

This procurement is being conducted through competitive sealed bidding. Bids will not be ranked using weighted evaluation points. The City will first review each bid for responsiveness to the solicitation requirements and required submittals.

1. Bidder Reliability – The City will review the bidder’s experience and past performance on projects of similar nature and complexity; references; ability to furnish required bonds and insurance; and compliance with all mandatory bid requirements. These factors will be used to determine whether the bidder is reliable and capable of performing the work, not to create a comparative point score.

2. Capacity and Project Understanding – The City may review staffing, equipment, organizational capacity, availability, project schedule, and the bidder’s demonstrated understanding of the work to determine whether the bidder can timely and satisfactorily complete the Project.

3. Bid Price – Bids will be compared based on the completed Bid Schedule / Schedule of Unit Prices and the resulting total bid amount, subject to verification of calculations and the requirements of the solicitation.

4. Award – If an award is made, the City intends to award the contract to the lowest reliable bidder whose bid is responsive to the requirements of this RFB and who demonstrates the ability to satisfactorily perform the work. The City reserves the right to reject any or all bids. No weighted scoring or best-value selection will be used to select a higher-priced bidder over the lowest reliable bidder.

5. Clarifications – The City may request clarification of information submitted to verify responsiveness or bidder reliability, but a bidder will not be permitted to materially revise its bid after the bid deadline except as otherwise authorized by applicable law.

I. General Conditions

Allowance and contingency funds are payable only for authorized work and are not automatically earned. The same work or cost shall not be paid both through a scheduled item and through the allowance or contingency. Unused allowance and contingency balances shall be deducted at final reconciliation. Any additional payment or time extension remains subject to the Agreement; the availability of contingency funds does not itself establish entitlement.

Upon submission of a bid, the bidder hereby certifies on behalf of his or her company or organization that:

1. This bid is genuine and not made in the interest of, or on behalf of, an undisclosed person, firm, or corporation.

2. This bid is not submitted in conformity with any agreement or rules of any group, association, organization, or corporation.
