About this file
This is a Justification for Restricting Competition Under the Simplified Acquisition Threshold (SAT) filed by the U.S. Army Contracting Command, Office of Aberdeen Proving Ground, Natick Division.
The Government seeks to award a fixed-price purchase order to Malvern Panalytical, Inc. (2400 Computer Drive, Suite 201, Westborough, MA 01581-1887) for on-site preventative maintenance and repair services for a Microactive 3Flex 3500 Surface and Catalyst Characterization Analyzer and Smart VacPrep 067 preparation station located at U.S. Army Natick Soldier Systems Center, Building 4, Room D-300. The requirement includes one scheduled preventative maintenance visit per 12 months, on-demand on-site service visits with a maximum 72-hour response time, priority technical support status, factory-certified replacement parts as needed, and software updates and notifications. This is a follow-on requirement funded through Research, Development, Test & Evaluation (RDT&E) for Fiscal Year 2025. The proposed contract period runs from September 8, 2026, through March 7, 2030, consisting of a one-year base period (September 8, 2026 to September 7, 2027), two optional 12-month periods, and potential FAR Clause 52.217-8 extensions for an additional cumulative six months.
The Government justifies sole-source award based on the equipment's unique nature, with specific parts and components sourced exclusively from the Original Equipment Manufacturer (OEM), whose successor is Malvern Panalytical, Inc. Maintenance must be performed by OEM-trained technicians, and no alternative vendors capable of providing these services were identified. Market research confirmed the service qualifies as a commercial item. The Government intends to publicize a special notice on SAM.gov to invite interested vendors to express capability. The Contracting Officer, Stephen M. Reffel, has approved this justification to limit competition subject to fund availability.
