About this file

This document is a Response to Offeror Questions for RFP19881 issued by the State of South Dakota, Office of Procurement Management, through the Department of Social Services, Division of Child Protection Services. The RFP requests proposals for secure and non-secure transportation services for children involved in the state's child protection system. Services include transportation to and from treatment facilities, group homes, foster homes, CPS offices, and other approved destinations, with coverage extending to tribal lands and reservations. The anticipated service volume is approximately five trips per month (three in-state and two out-of-state). Proposals are due August 19, 2026, by 5:00 PM CDT, with questions due August 4, 2026, and responses provided by August 11, 2026. The anticipated award and contract negotiation date is September 15, 2026. The contract term is one year ending May 31, 2027, with an option for renewal for up to three additional one-year contracts at the State's discretion based on performance and continued funding availability.

Vendors must submit itemized rate schedules as part of their proposals, with no specific pricing structure mandated by the State. Invoices are due within thirty days of service delivery, with payment typically vouchered within two weeks of receipt, though the overall payment process may extend six to eight weeks. Vendors must comply with comprehensive insurance requirements including commercial general liability, professional liability, business automobile liability, and workers' compensation with limits of not less than $1 million each, though deviations may be approved by DSS Legal during contract negotiations. Background checks are required every three years for criminal records, child abuse/neglect registry, DMV records, and sex offender registry, with checks previously completed for Medicaid enrollment being acceptable. Vehicles must be no more than six years old or have fewer than 100,000 miles, though this requirement may be waived during contract negotiations for vehicles deemed safe by the agency. Drivers must complete training in first aid, trauma-informed care, and passenger behavior management through providers to be determined collaboratively upon contract award. No incumbent is identified, and no set-aside or preference programs are mentioned.

Questions and Responses

PROPOSALS ARE DUE NO LATER THAN August 19, 2026, BY 5:00 PM CDT

RFP19881 BUYER: State of South Dakota

POC: Kirsten Blachford Kirsten.Blachford@state.sd.us

Q1: I’m reaching out because it appears that the itinerary was not included with the RFP. To provide you with accurate pricing, could you please provide the following details?

Service Date(s) Service Hours Vehicle Type (if applicable) Number of Hours Pickup and Drop-off Location(s)

A1: This RFP serves as a request for contract for ongoing services. The recommendation is for interested vendors to provide rates for the array of secure and non-secure transportation services and commitment to meet requirements outlined in the RFP.

Q2: What specific background checks are required for drivers (criminal, child abuse/neglect registry, driving record)? How recent must they be, and will the State accept checks already completed for Medicaid enrollment?

A2: Criminal record, Child Abuse/Neglect registry, DMV records, and Sex Offender Registry, every three years with annual attestations by employees of self-reporting of allegations and convictions. Checks already completed through Medicaid or other entities are acceptable.

Q3: What training courses or certifications are accepted for trauma-informed care, first aid, and passenger behavior management?

Are there preferred or required providers?

A3: There are an array of providers and trainings available. Upon awarding of contract, DSS CPS is willing to collaborate and review provider recommendations for curricula.

Q4: Will rates be negotiated individually or is there a standard rate schedule? What is the typical payment timeframe after invoice submission?

A4: The vendor will propose a rate schedule based in the proposal submitted. Invoices are due to the state within thirty days of delivering services and is typically vouchered within two weeks of receipt. The payment process is somewhat unpredictable, but likely within six to eight weeks of receipt of invoice.

Q5: Does a current Vehicle for Hire license and commercial auto insurance with $1 million liability satisfy the RFP’s licensing and insurance requirements?

RFP19881 Page 2 of 2

A5: DSS Legal will be consulted on this piece at the time of contract negotiations, but likely, without seeing the certificate of insurance.

Q6: The projections show approximately 5 trips per month. Is this the expected volume, or could it increase once a contractor is selected?

A6: That is the projected volume of trips, but the actual amount will vary depending on youth needs.

Q7: In section 3.1.8 (vehicle requirements) it states that vehicles used must be no more than six years old or have fewer than 100k miles. Is there any exception to this rule, and do all vehicles have to meet this requirement at start or throughout the contract term? Some of our vehicles are older than six years, and do have more than 100k miles. That is the reason for the question.

A7: Through contract negotiations this requirement can be removed for vehicles deemed safe by the agency.

Q8: This contract is for secure transportation. Will all individuals being transported need to be in restraints, or will there be times when restraints will not be needed?

A8: Restraints are not required. The DSS worker will provide recommendations. Transporting employee may also decide if needed, based on policy of agency.

Q9: Are tribal lands/reservations included within the required service area?

A9: Yes.

Q10: In terms of insurance- the requirements are as follows below. Is there any exception to these insurance requirements? Perhaps if we only had a $500,000 auto policy?

A10: The final approval of deviation from the contract verbiage has to be approved by DSS Legal during contract negotiations.
