About this file

This document is a Requirements Document for a Rapid Freeze Quench System for Electron Paramagnetic Resonance (EPR) Spectroscopy, issued by the Physical Measurement Laboratory at the National Institute of Standards and Technology (NIST).

The purpose of this acquisition is to obtain a rapid freeze quench system to trap transient states of bionanomaterials for subsequent EPR spectroscopy measurements. NIST is seeking one (1) new Rapid Freeze Quench System that meets detailed technical specifications, including a minimum 3 ms reaction time, total "dead" volume of no more than 200 uL, and minimum sample volume per shot of no more than 25 uL. The system must be delivered FOB Destination within 120 days after receipt of the offer, with warranty coverage. NIST will perform acceptance testing and has the right to reject nonconforming equipment. Payment will be made in full upon successful installation, testing, and demonstration that the system meets the stated requirements.

REQUIREMENTS DOCUMENT

Title: Rapid Freeze Quench System for EPR Spectroscopy

Requesting Lab: Physical Measurement Laboratory, Microsystems & Nanotechnology Division (681)

I. BACKGROUND INFORMATION

The Biophysical and Biomedical Measurement Group in the Physical Measurement Laboratory of the National Institute of Standards and Technology (NIST) is a group pursuing measurements of the dynamics of bionanomaterials. This acquisition for a rapid freeze quench system for electron paramagnetic resonance (EPR) spectroscopy will allow characterization of a wide array of bionanomaterials important to the bioeconomy (biologic drugs, DNA nanomaterials, mRNA vaccines) and guide development and innovation of emerging bionanomaterial-based technologies.

Purpose/Objective: The purpose of this acquisition is to trap transient states of bionanomaterials for subsequent electron paramagnetic resonance (EPR) spectroscopy measurements.

II. SCOPE

The Contractor shall deliver a quantity of (1) Rapid freeze-quench system for EPR spectroscopy, inclusive of FOB Destination delivery and warranty.

III. MINIMUM REQUIREMENTS

The Contractor shall provide one (1) Rapid Freeze Quench System for EPR spectroscopy that meets or exceeds the minimum requirements identified below: All items must be new. Used or remanufactured equipment will not be considered for award. Experimental, prototype, or custom items will not be considered. The use of “gray market” components are not authorized for sale in the U.S. by the Contractor is not acceptable. All line items shall be shipped in the original manufacturer’s packaging and include all original documentation and software, when applicable.

Line Item 0001: Rapid Freeze-Quench System for EPR spectroscopy Quantity: 1 A. Technical Specifications

1. Must have at least 2 syringes for reagent mixing

2. Must accommodate syringes with volumes ranging from 1.5 mL to 10 mL

3. Must operate from standard 120VAC, 60 Hz U.S. power, power cord to be included.

4. Must have a total “dead” volume of no more than 200 uL. For purposes of this acquisition, “dead” volume is the total volume of reagents contained in the system that is not used to generate a sample for subsequent measurement.

5. Must have a minimum reaction time of 3 ms with total aging time (reaction time + dead time + freezing time) of less than 10 ms using isopentane as the freezing solvent.

6. Must have minimum sample volume per shot of no more than 25 uL.

7. Must include instrument control panel to set experimental parameters including reaction volume, flow rate, reaction time, number of shots.

8. Must include hardware and connections to inject sample directly into cryogenic solvent. Cryogenic solvent shall not be included with the system.

9. Must include hardware and tools to pack frozen sample into EPR sample tubes for measurement.

V. DELIVERY TERMS

Delivery shall be FOB Destination (or equivalent terms, such as INCOTERMS Delivered Duties Paid) are required and shall occur in accordance with the delivery due dates provided in the above table.

FOB Destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery.

The DDP Incoterm, or “Delivery Duty Paid” Incoterm, states that the seller must make the goods available to the buyer at a prearranged location (NIST) and cover all associated expenses including unloading the goods from the carrier and any customs procedure costs and tariffs that may apply.

The contractor shall deliver all Line Items to:

National Institute of Standards and Technology Shipping and Receiving 100 Bureau Drive, Building 301 Gaithersburg, MD 20899

VI. INSPECTION & ACCEPTANCE

In addition to the inspection and acceptance terms articulated in 52.212-4, the Government reserves the right to perform such performance tests and evaluations as defined below to verify specified system performance. Such tests and evaluations, if performed, shall be conducted within the environment that the system is to be operated. The Contractor has the right to examine the data derived from the acceptance tests.

Inspection and acceptance shall occur within 14 business days after receipt of the system at NIST.

Equipment will be accepted when NIST has determined that the equipment performs according to specifications using a test reaction.

A visual inspection of the system will be performed by the NIST TPOC to identify surface defects or any form of indication that the instrument was damaged during transport to NIST. The Government shall have sole discretion to require repair or replacement of damaged and/or nonconforming supplies at no cost to the Government. The Government at any time prior to acceptance shall reject the device due to defects and/or nonconformance.

The place of acceptance shall be:

National Institute of Standards and Technology 100 Bureau Drive Building 216, Room D117 Gaithersburg, MD 20899

VII. WARRANTY

The Contractor shall warrant the entire system/parts in accordance with the Contractor’s standard commercial timeframe. Warranty shall commence after receipt and acceptance of the equipment and shall be in accordance with terms in FAR 52.212-4

VIII. PAYMENT SCHEDULE

Advance payment is not authorized. The Contractor must invoice in arrears according to the payment schedule. The Contractor shall be paid, in accordance with Net 30-day payment terms, upon receipt and acceptance of a proper invoice, in accordance with the following schedule:

1. 100% after installation and acceptance by the TPOC of fully installed system, AND

1. After the successful completion of the testing requirements set forth in this document under section set forth in this document, AND

1. After successful demonstration by the instrumentation that it performs in accordance with the technical requirements set forth in this document AND

1. After receiving an invoice submitted properly, in accordance with the purchase order terms and conditions.

NOTE: Partial shipments and partial invoices will not be accepted, unless otherwise requested and accepted by the Contracting Officer prior to award offer. Proposed payment schedules shall be submitted with vendor’s response to the RFQ for consideration.
