About this file

This is an insurance requirements checklist for the City of New Smyrna Beach, Florida, in conjunction with New Smyrna Beach Utility (NSBU), for the Construction of the Washington Street Roadway Improvements project (FPID NO. 447711-1-54-01). The document outlines comprehensive insurance requirements that contractors must maintain throughout the contract term, including any option years or extension periods granted by the City. Award of the contract is contingent upon receipt of required insurance documents within fifteen calendar days of City notification to comply. Contractors must submit certificates of insurance demonstrating coverage compliance, with the contract number and title appearing on each certificate. Insurance certificates must remain in force for the duration of the contractual period, and contractors must submit renewed certificates at minimum thirty calendar days before expiration to prevent contract suspension.

The required insurance coverage includes Commercial General Liability of $2 million per occurrence and $4 million aggregate with a $5 million umbrella policy; Automobile Liability of $1 million per person and $1 million per occurrence; Workers' Compensation of $1 million with Employers' Liability minimums; Builders Risk covering 100 percent of replacement value; Pollution Liability of $1 million per claim; Professional Liability of $1 million per occurrence; Cyber Liability of $1 million per claim; and Garage Keepers Liability of $1 million per claim as applicable. All insurance companies must be rated no less than "A-" for management and "Class VII" for financial strength according to A.M. Best's Insurance Guide and must be authorized to conduct business in Florida. Insurance carriers must provide thirty-day written advance notice of any coverage cancellations, and contractors are prohibited from modifying coverage without thirty-day written advance notice to the City. Failure to submit required insurance documents within twenty calendar days of notification results in default and potential contract award rescission.
