About this file

The document is a Request Form to the Division of Purchasing (DOP) submitted by the Idaho Transportation Department (ITD) requesting an exemption from competitive procurement for the purchase of a Planetary Gear Box. ITD owns a 2002 Stewart Stevenson rotary snow plow blower that requires a specialized planetary gear box, which is extremely rare and difficult to source. ITD has located a rebuilt planetary gear box with a matching tag number from Eagle & Myslik in Englewood, Colorado, and is requesting a one-time purchase totaling $21,120.24. The agency has provided justification that a competitive bid would likely result in no quotes, as the gear box is unique and specialized for their machine.

The agency has certified that the information provided supports the need for a direct procurement of the gear box, as competition would be impractical, unreasonable, or disadvantageous under the circumstances. DOP is offering transparency by allowing suppliers to review the requested exemption and provide relevant information, though the final decision remains at the discretion of the DOP Administrator. Suppliers are invited to submit any information that may support or contradict the agency's claim prior to the closing date.

IDAPA 38.05.01.042.10 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Describe the circumstances

ITD owns a 2002 Stewart Stevenson rotary snow plow blower that is used to clear high country highways. New parts and used parts are difficult to locate for this aged machine as it was custom built for ITD. Parts books and manuals are not available for this machine.

Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?

ITD has completed an exhaustive search for a matching planetary gear box for this machine and was able to locate a rebuilt planetary gear box with a matching tag number from Eagle & Myslik in Englewood Co. The tag number indicates the gear ratio which is extremely difficult to match.

Describe the extent to which competition is possible

The planetary gear box is extremely rare and a competitive bid would likely result in a no quote. Please note that the attached quote does not indicate freight charges.

The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State:
