About this file

This document is a Request Form to the Division of Purchasing (DOP) submitted by the Lava Hot Springs Foundation, seeking an exemption from competitive procurement for the purchase of Tree Removal Services. The Foundation previously conducted two Requests for Quotes (RFQs) for these services but received no bids, and is now requesting the ability to directly procure a vendor to complete the needed tree removal work. The Foundation cites the impracticality of competitive bidding as the justification for the exemption, noting the lack of responses to the prior RFQs. The DOP is offering suppliers the opportunity to review this requested exemption and provide relevant information, though the decision remains at the discretion of the DOP Administrator.

The anticipated total cost for the tree removal services is $40,000. The Foundation is willing to obtain informal quotes to expedite the process and complete the work before winter. The decision on the exemption request will be posted publicly for transparency, but suppliers have no right to appeal the Administrator's final determination.

IDAPA 38.05.01.042.10 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Describe the circumstances

The Lava Hot Springs Foundation did 2 different RFQ for the services of tree removal. We received no bids. The former directory was given the okay to see if we could find a vendor to complete task. Due to the length of time since then I am asking is we still have the ability to seek a vendor to complete the task. Thayne Pearson could provide some insight to the pervious RFQ's.

Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?

To get this much needed task complete.

Describe the extent to which competition is possible

Competition is possible. I would even be willing to get informal quotes to complete the task just trying to speed this need process up and have it completed before winter.

Thanks
