About this file

The document is a Request Form to the Division of Purchasing (DOP) for an exemption from competition for the purchase of a Grasshopper Mower with Attachments by the Idaho Military Division (IMD). The IMD supports the Idaho Air National Guard (IDANG) Civil Engineering (CE) Squadron with facility and grounds maintenance. The IDANG CE recently received additional funds from the National Guard Bureau that must be used to purchase a Grasshopper 700 series mower by the end of the current Federal Fiscal Year on September 30th. Due to the short timeframe, the agency claims that going through a competitive bidding process would be impractical, unreasonable, and disadvantageous, as the funds would have to be returned if not executed in time.

The anticipated total cost for the Grasshopper Mower with Attachments is $24,892.25. There are 5 authorized regional dealers, but only 2 vendors available in the Treasure Valley. The agency is requesting a direct procurement from one of these 2 vendors, RMT Equipment, to meet the urgent timeline and avoid losing the dedicated federal funding.

IDAPA 38.05.01.042.10 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Describe the circumstances

IMD supports the Idaho Air National Guard (IDANG) Civil Engineering (CE) Squadron with the maintenance of all IDANG facilities and grounds maintenance. IDANG CE received additional funds they were not originally aware of being available from National Guard Bureau (NGB) to secure additional lawn equipment by the end of the current Federal Fiscal Year. These funds were strictly dedicated to be used for the purchase of a Grasshopper 700 series mower. CE did not receive this notification from NGB until 17 August. If these funds are not executed by 30 September, the funds will be returned to NGB and lost.

Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?

Due to the short timeframe of notification from NGB to CE and the timeframe that the designated funds need to be executed it would be impractical, unreasonable and disadvantageous to go out to bid as the funds will have to be returned based off current DOP matrix and executability.

Describe the extent to which competition is possible

There are 5 authorized dealers regionally who could support this request but there are only two vendors available in the Treasure Valley.

The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State:
