1.0. GENERAL INFORMATION
This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the format in Federal Acquisition Regulation (FAR) Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
This requirement is issued as a RFQ (Reference Number: FA542223Q1003. The solicitation document and incorporated provisions and clauses are those in effect in the Federal Acquisition Circular (FAC) 2023-04 effective 06-02-2023.
2.0. IMPORTANT NOTES
a) The Government is soliciting for “open market” quotes only. General Services Administration (GSA) quotes, or other Government-Wide Acquisition Contracts (GWAC) quotes, will not be considered.
b) There is no set aside for this acquisition. All responsible sources are permitted to submit an offer.
c) Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.
3.0. NATURE OF ACQUISITION
The 724th EABS/Civil Engineer Flight at Air Base 201 Agadez, Niger has a requirement to procure one
(1) Diesel Melter Sealant Machine and 6,750 pounds (lbs.) of Parking lot sealant Type two (2) to repair and avert airfield cracks, preventing water intrusion and erosion in the sub-grade.
4.0. SCHEDULE OF SUPPLIES/SERVICES:
This acquisition is for the purchase of the following items:

5.0. DELIVERY INFORMATION:

Or to the consolidation point at Dover AFB, for which the contracting officer will supply shipping labels. Each packaged container shall be identified by its unit price, type of container, and dimensions (including height, length, width and weight).
6.0. INSTRUCTIONS TO OFFERORS:
a) The provision 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services, applies to this acquisition.
b) This will be a firm fixed priced purchase order via the open market. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. This solicitation is being issued on a competitive basis. To assure a timely and equitable evaluation of quote, offerors must follow the instructions contained herein. Offers that fail to furnish required representations or information or reject the terms and conditions of the solicitation may be excluded from consideration.
c) Offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers. Request for quotes or modification of quotes received at the address specified for the receipt of offers after the exact time specified for receipt of offers will be considered late and handled in accordance with FAR 52.212-1(f).
Multiple offers will not be accepted under this Request for quote, nor will multiple awards be considered.
7.0. THE OFFERORS QUOTATION SHALL INCLUDE THE FOLLOWING:
a) General: The offerors quote shall include the solicitation number and date of preparation.
b) Company Information: The offerors quote shall include the preparers name and the company’s name, physical address, email address, and telephone number.
c) Pricing: The offerors quote shall include unit prices and extended prices in response to this solicitation and SOR.
d) Manufacturer Specifications: The offerors quote shall provide manufacturer specifications that clearly demonstrates their capability of meeting all the requirements for
CLINs 0001 and 0002 outlined in the attached SOR, lines 2.1-2.2. This shall include a complete list of proposed equipment items, to include specifications, manufacturer, and part number. It may include product literature, or other documents, if necessary.
e) Delivery Date: The offerors quote shall include a realistic date (based on days after date of contract) for the requirements identified in this solicitation. The delivery date shall take into consideration availability, ordering, shipping, and any other factors that could affect the delivery of the item (s) being proposed under this solicitation.
Note: The delivery date will be incorporated into the final contract.
f) Representations and Certifications:
i. Section 889: The offerors quote shall include the completed provisions:
52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment and 52.204-26, Covered Telecommunications Equipment or Services- Representation.
ii. Additional Provisions: The offerors quote shall include the completed provisions: 52.223-22 Public Disclosure of Greenhouse Gas Emissions and Reduction Goals-Representation and 252.225-7059 Prohibition on Certain Procurements from the Xinjiang Uyghur Autonomous Region–Representation.
iii. Systems for Award Management (SAM) and Joint Contingency Contracting System (JCCS): To be eligible to receive an award resulting from this RFQ, contractors MUST BE REGISTERED and ACTIVE in the DoD SAM database at time of quotation submission, no exceptions. Foreign contractors (outside the United States MUST ALSO BE REGISTERED AND ACTIVE in the DoD JCCS database at time of quotation submission, no exceptions. Contractors not registered in SAM and foreign contractors not registered in JCCS; quote’s will not be evaluated. To register in SAM please visit http://www.sam.gov or call 1-866-606-8220. To register in JCSS please visit https://www.jccs.gov/jccscoe/.
g) Additional information: The offerors quote shall include discount terms (if applicable) and their company’s tax identification number, cage code, and Unique Entity ID (UEI)/ Data Universal Numbering System (DUNS).
h) Responses: All questions regarding this RFQ shall be received by Monday, Sep 11, 2023, at 1600 West Africa Time (WAT). Questions shall be provided in writing via email to the Contract Officer SSgt Khadijah Jones to Khadijah.Jones.1@us.af.mil and to the 724 EABS CONS ORG BOX at 724eabs.cons@agdz.deployed.af.mil. All offers shall be received NLT Wednesday, Sep 14, 2023, at 1600 West Africa Time (WAT). Email is the preferred method.
Upon receipt of your quote, the Government will confirm receipt within 24 hours. If a confirmation has not been received within 24 hours, please contact the POCs identified in this notice.
8.0. BASIS FOR AWARD
1. This procurement will be awarded under FAR Part 13 Simplified Acquisition Procedures. Award will be based on technical acceptability and price. For quotes determined technically acceptable, a best value selection will be based on price.

a) Technical Acceptability: Initially, the Government shall evaluate each offerors quote, as it pertains to the following criteria, on a pass/fail basis, by assigning ratings of Acceptable (clearly meets minimum requirements) or Unacceptable (does not clearly meet minimum requirements):
i. Manufacturer Specifications: Offerors manufacturer specifications shall be evaluated to ensure that it clearly outlines the approach to and demonstrates a capability of meeting all requirements identified in the attached SOR, lines 2.0-
2.2.43. The manufacturer specifications shall also be evaluated to ensure a complete list of proposed equipment items, to include description, manufacturer and part number is included.
b) Price: The Government may use any of the following price analysis techniques IAW FAR 13.106-3(a) to determine price reasonableness: competitive quotes, comparison of the proposed price with prices found reasonable on previous purchases, a comparison with similar items in a related industry, comparison to an independent Government estimate, or any other reasonable basis.
2. The Government intends to award a single firm-fixed priced delivery order without discussions. The Government, however, reserves the right to conduct discussions, if deemed in its best interest.
5352.201-9101 USAFE Ombudsman Oct 2019
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
