PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT
SEABEE UNIFORM EMBROIDERY PATCHES
Shepard Airforce Base, Texas
1.0 Background. The Naval Construction Training Center (NCTC), Gulfport is a Naval shore activity in an active operating status. An Echelon V Command, NCTC's Commanding Officer reports to the Center for Seabees and Facilities Engineering (CSFE); the Naval Education and Training Command (NETC); and ultimately, to the Chief of Naval Operations (CNO), respectively. NCTC Gulfport is subject to the regional area coordination authority of the Commanding Officer, Naval Construction Battalion Center (NCBC), Gulfport on which it is located.
NCTC Gulfport provides support to the CSFE Detachment Sheppard Air Force Base, Texas; and CSFE Detachment Fort Leonard Wood, Missouri as their responsible Training Systems Detachment (TSD).
This Performance Work Statement (PWS) outlines the outfitting of entry level students requiring a SeaBee patch to be sewn on their right breast pocket of their blouse uniform. Patches shall be supplied by NCTC Navy Military Training Instructor (NMTI) personnel.
2.0 Scope. This Performance Work Statement (PWS) describes contractor services requiring maintenance personnel to be experienced in uniform alterations and sewing for the Shepard Airforce Base, Wichita Falls, Texas. Contractor shall provide all labor, tools, supervision, and equipment required to perform the work prescribed herein. All work shall be performed in a neat and orderly manner.
Each uniform will be sewn with the Seabee Logo embroidery. The Contractor shall receive up to 400 uniforms per contract year. A range of 1 – 25 uniforms is estimated to be dropped off to the Contractor for each order placed.
If the awarded contractor is located within the immediate vicinity of the Navy installation , an approved NMTI service member will pick up the serviced uniforms.
If the awarded Contractor is located outside the local vicinity of the Navy installation, they are responsible for arranging timely delivery to meet the required lead time. Shipping costs must be included in the Contractor’s response.
Upon return of the uniforms, an inspection will be conducted by NCTC NMTI staff personnel. NCTC will not accept nor pay for any uniforms sewn on of low quality standards.
It is imperative to the Naval Construction Force that uniforms are returned with high quality embroidery and in a timely manner. Student graduations and the uniform presentations are extremely dependent on it.
3.0 Requirements. The maximum amount for each drop-off will be no greater than 60 uniforms and the minimum amount will be no less than one uniform. The vendor is required to complete the task for embroidering the Seabee logo on the pocket for each uniform by removing the pocket, embroidering the Seabee logo, and then reattaching the pocket to its original form onto each uniform. The Seabee Logo shall be centered on the right breast pocket facing inward towards the buttons of the blouse using a 1/8th inch black thread. The word “SEABEES” shall be stitched below the SEABEE Logo centered in a 5/8th inch tall black lettering. The lettering also shall be 1/8th in thick black thread.
Service completion will not exceed seven (7) calendar days from the date of each drop-off or delivery.
Uniforms shall be delivered to the Contractor for service no later than two weeks prior to each graduation.
Deliveries should occur between 9:00 a.m. to 5:00 p.m., unless alternative arrangements have been made with approved NMTI staff. Approved NMTI personnel will pick up and return uniforms at the Contractor's location no later than two days before graduation, during the hours of 8:00 a.m. to 3:00 p.m.
NCTC mandates that all students wear the appropriate uniform upon graduation. It is essential to ensure the prompt return of uniform items. Exceptions may be granted if circumstances are communicated in advance. The Designated Government Representative (DGR) will document and notify the contractor of any vendor performance issues, schedule changes, or delays in the return of uniform items.
4.0 Type of Contract The Government will award a Firm Fixed Price Contract.
5.0 Period of Performance. This contract is for one (1) Base Year and four (4) Option Years. The period of performance is as as follows:
Base Year: May 1, 2025 – April 30, 2026 Option Year 1: May 1, 2026 – April 30, 2027 Option Year 2: May 1, 2027 – April 30, 2028 Option Year 3: May 1, 2028 – April 30, 2029 Option Year 4: May 1, 2029 – April 30, 2030
6.0 Quality Control. The Contractor shall provide quality services and/or products IAW this contract. Quality Control is the responsibility of the Contractor. The Contractor is responsible for the delivery of quality supplies or services to the Government in accordance with (IAW) the terms and conditions contained in Federal Acquisition Regulation (FAR) Subpart 52.246-1 entitled, “Contractor Inspection Requirements” and applicable sub-clauses pertaining to quality control.
7.0 Inspection Requirement. Upon delivery of the uniforms, an inspection will be conducted by NCTC NMTI staff personnel. NCTC will not accept nor pay for any uniforms sewn on of low quality standards.
8.0 Designated Government Representative (DGR). This acquisition is not technically complex and, for that reason, it does not require a Contracting Officer Representative (COR). However, a DGR will report to the Contracting Officer that all products and/or services from the contractor have been delivered and accepted.
METHOD OF PAYMENT WILL BE VIA WIDE AREA WORKFLOW (WAWF)
9.0 Employment of Federal Employees. When two or more directives or instructions apply, the Contractor shall comply with the more stringent of the directives or instructions.
11.0 Inclement Weather. The Contractor shall perform deliveries as scheduled including during periods of inclement weather unless specific approval to delay is requested by the contractor and approved by DGR. Such approval will normally be granted only in cases of severe weather, such as hurricanes or tornadoes, etc. The Contractor shall not request additional cost for schedule changes due to inclement weather.
12.0 Contractor Access and Use of Premesis. The Contractor shall be responsible for securing the necessary permits and base access passes for Contractor personnel, vehicles, and equipment for the duration of the contract.

U.S. citizen personnel of a Foreign Owned, Controlled or Influenced (FOCI) entity shall be required to provide the Naval Aviation Schools Command security forces at the Pass and ID Office, located at their Main Gate, with vehicle registration, proof of insurance, driver’s license, and second form of picture ID. A Visit / Access Request on company letterhead is also required at least 48 hours (recommend at least five days) in advance of item(s) delivery.
U.S. Owned company personnel shall be required to provide the security forces with vehicle registration, proof of insurance, and driver’s license.
Infrequent Access (<30 days/year): Unless the Contractor/visitor is registered in the Defense Biometric Identification System (DBIDS), all infrequent visitors of less than 30 consecutive days will be required to stop at the Naval Aviation Schools Command Pass Decal office every day to obtain a one-day pass until work is completed.
13.1 Defense Biometric Identification System (DBIDS). The Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions. The system provides a continuous vetting anytime the DBIDS card is scanned at an installation entry point.
If you currently have Navy Commercial Access Control System (NCACS) card, the following is required to get a DBIDS credential:
Present your NCACS Card and a completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center representative. The VCC will pull up your informcation in the computer, ensuring all information is current and correct. Once your information is validated, a temporary DBIDS credential is provided. Your temporary credential will have an expiration date, prior to which you will need to obtain your permanent DBIDS credential (180 days).
For each additional U.S. Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the Visitor Control Center. The representative will enter base access authorization and then you may proceed to work.
If you do NOT have an NCACS Card, the following is required to obtain a DBIDS credential:
Present a letter or official document from my government sponsoring organization that provides the purpose for your access. Present valid identification, such as a passport or Real ID Act-compliant state driver's license. Present a completed copy of the SECNAV 5512/1 form to obtain your background check.
Upon completion of the background check, the Visitor Control Center representative will complete the DBIDS enrollment process, which includes your photo, fingerprints, base restrictions, and several other assessments; after all this is DoN, you will be provided with your new DBIDS credential. You may now proceed to work.
For additional questions about obtaining a DBIDS card, contact your local base visitor control center.

Basis of Evaluation - Basis of Evaluation-Commercial Products and Commercial Services per FAR Subpart 13.106
The Government intends to award a firm-fixed-price contract resulting from this solicitation to the responsible
Quoter whose quote conforming to the solicitation will be the most advantageous to the government, price and other factors considered. Initially the Government will evaluate all quotes for technical capability. All quotes rated technically unacceptable shall be ineligible for award and removed from any further consideration. The Government will then evaluate all technically acceptable quotes for past performance and price, and assign appropriate adjectival ratings. The Government will then conduct a trade-off between past performance and price where past performance is more important than price.
Each quote shall be in the form prescribed by, and shall contain a response to, each of the areas identified in the solicitation provision entitled “FAR provision 52.212-1 Addendum, Instructions to Offeror’s- Commercial Products and Commercial Services.”
The type of source selection utilized in this procurement is the Best Value Trade-Off IAW Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, and Part 13 Simplified Acquisition Procedures. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced quote. The Government reserves the right to make award solely on initial quote received.
Note: Price has the potential to become more significant during the evaluation process. The degree of importance of price will increase with the degree of equality of the quotes in relation to the other factors on which selection is to be based.
Price - The Government will evaluate price in accordance with FAR 13.106-3(a), Award and Documentation. The Government may evaluate any and all information submitted by the Quoter to support the reasonableness of the prices quoted. The method of evaluation used is solely within the discretion of the Contracting Officer.
Price will be evaluated by multiplying the estimated quantities by the quoted unit price for each line item and then adding the totals together thereby identifying the Quoter’s total estimated price for each line item.
Note: Quoters that do not quote all items for which a Quoter only partial CLIN pricing will be considered nonresponsive.
Technical Capability: The technical rating reflects the degree to which the quoted approach meets or does not meet the minimum performance or capability requirements. For a quote to be found technically acceptable, the quote must clearly meet the minimum requirements of the solicitation. Failure to provide the following will result in an unacceptable rating.
1. To be considered for award, quotes shall clearly identify each CLIN.
2. Vendor shall include Delivery Schedule in the quote.
3. Capability statement acknowledging review of RFQ and any supporting documents. statement acknowledging review of RFQ, supporting excel sheets and PDF detailing customer’s requirement.
If the Quoter is found to be “Unacceptable”, then the Quoter will be removed from further consideration of the award.
Acceptable (A) The quote meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is low.
Unacceptable (U) The quote does not meet requirements of the solicitation and/or risk of unsuccessful performance is unacceptable. Quote is unawardable.
Past Performance - The past performance evaluation results in an assessment of the Quoters probability of meeting the solicitation requirements. The past performance evaluation considers each Quoters demonstrated recent and relevant record of performance in supplying services that meet the contract’s requirements as described in the
Addendum to FAR 52.212-1. The recency and relevance of the information, source of the information, context of the data, and general trends in Contractor’s performance shall be considered. These are combined to establish one performance confidence assessment rating for each Quoter. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. Submitted Past Performance project relevancy will be rated as either “relevant” or “not relevant”. Submitted CPARS or PPQ information that is older than 3 years as of the closing date of this request for quote shall be rated not relevant.
Performance Confidence Assessment Rating Description Substantial Confidence Based on the Quoter’s recent/relevant performance record, the Government has a high expectation that the Quoter will successfully perform the required effort.
Satisfactory Confidence Based on the Quoter’s recent/relevant performance record, the Government has a reasonable expectation that the Quoter will successfully perform the required effort.
Neutral Confidence No recent/relevant performance record is available or the Quoter’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The Quoter may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the Quoter’s recent/relevant performance record, the Government has a low expectation that the Quoter will successfully perform the required effort.
No Confidence Based on the Quoter’s recent/relevant performance record, the Government has no expectation that the Quoter will be able to successfully perform the required effort.
In the case of Quoters for which there is no information on past contract performance or where past contract performance is not available, the Quoters may not be evaluated favorably or unfavorably on the factor of past contract performance. In this case, the Quoter’s past performance is unknown and assigned a confidence rating of “neutral.” Past performance ratings of “Substantial Confidence” and “Satisfactory Confidence” hold more value than a “Neutral Confidence” rating and will be considered more favorably in the evaluation of past performance.
Notice of Award. To be eligible for award of a contract hereunder, the Quoter must be determined by the Contracting Officer to be a responsible prospective Contractor in accordance with FAR 9.1.
A written notice of award or acceptance of a quote mailed or otherwise furnished to the successful Quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party.
Before the quote’s specified expiration time, the Government may accept a quote, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-4 CONTRACT TERMS AND CONDITIONS--COMMERCIAL PRODUCTS AND COMMERCIAL
SERVICES (NOV 2023)
(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights-
(1) Within a reasonable time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.
(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.
(d) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause at Federal Acquisition Regulation (FAR) 52.233-1, Disputes, which is incorporated herein by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.
(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.
(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
(g) Invoice.
(1) The Contractor shall submit an original invoice and three copies (or electronic invoice, if authorized) to the address designated in the contract to receive invoices. An invoice must include--
(i) Name and address of the Contractor;

(iii) Contract number, line item number and, if applicable, the order number;
(iv) Description, quantity, unit of measure, unit price and extended price of the items delivered;
(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on Government bill of lading;
(vi) Terms of any discount for prompt payment offered;
(vii) Name and address of official to whom payment is to be sent;

(ix) Taxpayer Identification Number (TIN). The Contractor shall include its TIN on the invoice only if required elsewhere in this contract.
(x) Electronic funds transfer (EFT) banking information.
(A) The Contractor shall include EFT banking information on the invoice only if required elsewhere in this contract.
(B) If EFT banking information is not required to be on the invoice, in order for the invoice to be a proper invoice, the Contractor shall have submitted correct EFT banking information in accordance with the applicable solicitation provision, contract clause (e.g., 52.232-33, Payment by Electronic Funds Transfer—System for Award Management, or 52.232-34, Payment by Electronic Funds Transfer--Other Than System for Award Management), or applicable agency procedures.
(C) EFT banking information is not required if the Government waived the requirement to pay by EFT.
(2) Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. 3903) and Office of Management and Budget (OMB) prompt payment regulations at 5 CFR part 1315.
(h) Patent indemnity. The Contractor shall indemnify the Government and its officers, employees and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.

(5) Overpayments. If the Contractor becomes aware of a duplicate contract financing or invoice payment or that the Government has otherwise overpaid on a contract financing or invoice payment, the Contractor shall--
(i) Remit the overpayment amount to the payment office cited in the contract along with a description of the overpayment including the--
(A) Circumstances of the overpayment (e.g., duplicate payment, erroneous payment, liquidation errors, date(s) of overpayment);
(B) Affected contract number and delivery order number, if applicable;
(C) Affected line item or subline item, if applicable; and
(D) Contractor point of contact.
(ii) Provide a copy of the remittance and supporting documentation to the Contracting Officer.
(6) Interest.
(i) All amounts that become payable by the Contractor to the Government under this contract shall bear simple interest from the date due until paid unless paid within 30 days of becoming due. The interest rate shall be the interest rate established by the Secretary of the Treasury as provided in 41 U.S.C. 7109, which is applicable to the period in which the amount becomes due, as provided in (i)(6)(v) of this clause, and then at the rate applicable for each six-month period as fixed by the Secretary until the amount is paid.
(ii) The Government may issue a demand for payment to the Contractor upon finding a debt is due under the contract.

(A) The Contracting Officer and the Contractor are unable to reach agreement on the existence or amount of a debt within 30 days;
(B) The Contractor fails to liquidate a debt previously demanded by the Contracting Officer within the timeline specified in the demand for payment unless the amounts were not repaid because the Contractor has requested an installment payment agreement; or
(C) The Contractor requests a deferment of collection on a debt previously demanded by the Contracting Officer (see 32.607-2).
(iv) If a demand for payment was previously issued for the debt, the demand for payment included in the final decision shall identify the same due date as the original demand for payment.
(v) Amounts shall be due at the earliest of the following dates:
(A) The date fixed under this contract.
(B) The date of the first written demand for payment, including any demand for payment resulting from a default termination.
(vi) The interest charge shall be computed for the actual number of calendar days involved beginning on the due date and ending on--

(B) The date of issuance of a Government check to the Contractor from which an amount otherwise payable has been withheld as a credit against the contract debt; or
(C) The date on which an amount withheld and applied to the contract debt would otherwise have become payable to the Contractor.
(vii) The interest charge made under this clause may be reduced under the procedures prescribed in FAR 32.608-2 in effect on the date of this contract.
(j) Risk of loss. Unless the contract specifically provides otherwise, risk of loss or damage to the supplies provided under this contract shall remain with the Contractor until, and shall pass to the Government upon:

In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges the Contractor can demonstrate to the satisfaction of the Government using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.
(m) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.
(n) Title. Unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.
(o) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
(p) Limitation of liability. Except as otherwise provided by an express warranty, the Contractor will not be liable to the Government for consequential damages resulting from any defect or deficiencies in accepted items.
