SECTION 1: OWNER DESCRIPTION
1.1 General
The West Virginia Department of Environmental Protection (WVDEP) enforces state and federal environmental laws in West Virginia to help protect the air, water, and land. The WVDEP’s mission is to promote a healthy environment using over 800 employees in nine different locations. More specifically, the WVDEP’s Division of Land Restoration (DLR), whose mission is to reclaim and remediate contaminated and disturbed land to a condition protective of public health and safety and suitable for productive reuse and economic development. With respect to lands impacted by coal mining operations, the WVDEP is responsible for delivering projects associated with restoration and reclamation of these lands.
In response to the passing of WV Senate Bill 439, WVDEP has established a Design-Build Pilot Program aimed at delivering projects using design-build project delivery. From abandoned mine land reclamation, stream restoration to subsidence and more, the pilot program seeks to utilize Design-Build Institute of America (DBIA) best practices in alignment with WVDEP policies and preferences.
The Ethel Hollow Stream Restoration project will be delivered under the Abandoned Mine Lands (AML) program which oversees and facilitates the resolving of public safety issues such as mine fires & subsidence, hazardous highwalls, mining-impacted water supplies, open shafts and portals, and other dangers resulting from mining before 1977.
1.2 Funding/Authority
This project will be funded with monies from the Bipartisan Infrastructure Law, which is federal funding. This will require conformance to federal funding requirements including the Davis-Bacon Act and Build America, Buy America Act at a minimum.
1.3 Procurement Website
Procurement information can be found at https://www.wvoasis.gov/. Registration guidance is provided on the website.
SECTION 2: OVERVIEW OF PROJECT
2.1 General
2.1.1 Purpose
The West Virginia Department of Environmental Protection (WVDEP) is soliciting Statements of Qualifications (SOQs) from qualified Design-Build Entities to provide Progressive Design-Build (PDB) services for the Ethel Hollow Stream Restoration project.
The Owner intends to collaborate closely with the selected Design-Builder to refine the project scope, schedule, and budget in Phase 1 (Preconstruction & Design Development) before proceeding with Phase 2 (Final Design & Construction).
2.1.2 Project Overview
The Ethel Hollow project is located near Ethel, West Virginia in the Guyandotte River Watershed in Logan County. The project area has been impacted by pre-law deep mining activities. West Virginia DEP’s AML Program has completed previous reclamation projects at this site, including sealing off open portals and mine entries and stabilization of coal https://www.wvoasis.gov/ refuse piles. This project is focused on efforts to improve the impacted streams on the site.
DEP’s Planning team has identified 4.46 miles of stream with altered stream flow, reduced overall capacity, and areas where new channels have formed. This has caused the stream to have no appropriate substrate to support aquatic life and a lack of a floodplain, as well as flooding during storm events. The goal of this project is to perform reclamation and restoration work within the project area, potentially including the mainstream stems of Ethel Hollow, Little Dark Hollow, Big Dark Hollow and associated tributaries. More specifically, DEP is seeking to perform work, informed by the selected Design-Build team, that optimizes improvements within the project budget and limits the likelihood that other site features may negate improvements made as part of this project. The project scope is likely to include design and construction of elements to stabilize the side slopes and stream banks and establish stream habitat structures to support aquatic life and dissipate stream energy. The project requires zero net impact on property owner-held carbon credits; DEP cannot compensate any parties for carbon credit impacts, including payments to mitigation banks.
2.2 Project Objectives
Establish a collaborative relationship between the WVDEP and the Design-Build Team in working together to meet the project objectives.
Evaluate potential innovative approaches to enhance the value and/or reduce the risk of the work to WVDEP and Design-Build Team.
Design and construct a project that optimizes improvements within the project budget and limits the likelihood that rework may be required in the future.
Maintain a safe, injury free work site.
Minimize impacts to project stakeholders through close coordination with WVDEP.
Demonstrate the advantages and disadvantages of design-build delivery.
Regular reporting of project progress for feedback to WVDEP.
Design-Builder activities to have zero net impact on property owner held carbon credits within the project boundary throughout the project lifecycle.

Description of Work:
Provide Design-Build services to complete the work below and in Attachment A-1
Phase 1 – The Design-Build Team (DBT) will provide design and professional services to complete abandoned mine reclamation activities at a site that has been adversely impacted by pre-law coal mining. Multiple projects have been completed under the same AML Problem Area (Ethel Hollow Refuse and Portals, WV-2129) previously. Work associated with the stream channel was previously determined to be premature prior to the completion of other reclamation work;
this project is now ready to be executed. The design should include but not be limited to the following: site access and preparation; erosion and sediment control measures; stream restoration, relocation, establishment, and enhancement;
wetland delineation; construction, enhancement, removal and mitigation measures; and other work necessary to meet the project objectives.
The design shall incorporate the state and federal requirements necessary to gain an Authorization to Proceed (ATP) for construction from the US Department of the Interior, Office of Surface Mining (OSM);
1. The federal requirements include but may not be limited to Title IV of the Surface Mine Coal Reclamation Act (SMCRA) of 1977, as amended, the National Environmental Policy Act of 1969, as amended, and the Clean
Water Act, as amended.
2. The state requirements include but may not be limited to the West Virginia Water Pollution Control Act of
1994, as amended.
Phase 1 shall also meet requirements for any existing infrastructure owners, including but not limited to electrical, public water, public or private sewer, natural gas and WVDOH.
The primary deliverable is an open-book Phase 2 Price Proposal that will include a final scope, including the required drawings and specifications, and the corresponding price for any remaining professional services and all the construction required to implement the project.
Phase 2 - In accordance with the mutually agreed upon Phase 2 Price Proposal developed in Phase 1 and after gaining the ATP from OSM, the DBT will perform the agreed upon abandoned mine land reclamation activities at the site.
Construction activities may include but are not limited to the following: site access and preparation; erosion and sediment control measures; stream restoration, relocation, establishment, and enhancement; wetland delineation; construction, enhancement, removal and mitigation measures; and other work necessary to meet the project objectives.

10. Turn left at the traffic light onto Rte. 10 and travel for approximately 3 miles to the town of Stollings. Turn left onto Rte. 17 and follow for approximately 5 miles to Ethel. Turn left into Ethel Hollow. Project follows Ethel Hollow from its mouth (@ Dingess Run) to its headwaters.
CS-1; Ethel Hollow Main Stem; Total length of main stem stream channel is ~2.14 miles (11,325’). Coal refuse and sediment are restricting water flow throughout the channel length. The original channel, in several areas, is no longer transporting water due to pre-law mining activities. Water flow runs across the access road and/or through roadside ditches with little to no substrate.
Starts at Mouth with Dingess Run 37° 51’ 57.80” N, 81° 54.’ 47.6” W, heading upstream to 37° 53’ 30.8” N, 81° 54’ 8.9” W
CS-2; Little Dark Hollow of Ethel Hollow; Total length of impacted stream channel is ~1.21 miles (6,400’). Coal refuse, and sediment are restricting water flow throughout the channel length. Water flow runs through roadside ditches and/or across the access road providing little to no proper substrate. In many areas, the original stream channel location is not known as the landscape has been heavily altered due to pre-law mining activities, as a result complete stream construction will be needed throughout much of the stream reach.
Starts at 37° 53’ 30.8” N, 81° 54’ 8.9” W, heading upstream to 37° 54’ 13.4” N, 81° 54’ 33” W
CS-3; Big Dark Hollow of Ethel Hollow; Total length of impacted stream channel within this side tributary is ~ 0.15 miles (~800’). Coal refuse, and sediment are restricting water flow throughout the channel length.
Starts at 37° 53’ 30.40” N, 81° 54’ 9.24” W, heading upstream to 37° 53’ 31.9” N, 81° 54’ 12.5” W
SITE DESCRIPTION OSM-51 (continued)
CS-4; Unnamed Tributary to Little Dark Hollow; Total length of impacted stream channel is ~0.25 miles (1,340).
This area falls within the newly re-graded coal refuse pile. Although, heavily clogged by coal and coal refuse before the project activities, the completed work has greatly reduced the size and flow of the channel. Complete stream restoration will be needed for this entire stream reach.
Starts at 37° 53’ 47.10” N, 81° 53’ 59.4” W, heading upstream to 37° 53’ 47.05” N, 81° 54’ 44.3” W
CS-5; Pine Fork of Ethel Hollow; Total length of impacted stream channel within this side tributary is ~0.28 miles
(1,450). Coal refuse and sediment have all but choked this channel completely dry. In Summer of 2025, this channel was found to have no surface flow, even after heavy rain events due to heavy deposits of rock, and sediment.
Starts at 37° 52’ 40.9” N, 81° 54’ 1.8” W, heading upstream to 37° 52’ 39.1” N, 81° 53’ 29.1” W
CS-6; Unnamed Tributary of Ethel Hollow; Total length of impacted stream channel is ~0.11 miles (600’). The lower stream reach within this area was channelized, as a result of pre-law mining activities, which have in turned left the channel with little to no substrate.
Starts at 37° 52’ 14.30” N, 81° 54’ 32.90” W, heading upstream to 37° 52’ 21.90” N, 81° 54’ 34.90 W”
CS-7; Unnamed Tributary of Little Dark Hollow. Total length of the impacted stream channel is ~0.14 miles (750’). The channel runs through side slope has been heavily altered from pre-law mining. Majority of the impacted channel cuts through remnants of a red dog pile, and as such, complete stream restoration will be needed for this reach. Bank stabilization is needed as well.
Starts at 37° 53’ 58.2” N, 81° 54’ 58.20” W, heading upstream to 37° 53’ 58.2” N, 81° 54’ 12” W
CS-8; Unnamed Tributary of Ethel Hollow. Total length of impacted stream channel is ~0.05 miles (~300’). This channel section runs through an area that was abated as a result of a refuse fire. The channel cuts through coal refuse and is choked with coal, sediment and red dog. Rip rap ditching type work is needed to stabilize the flow and side slopes.
Starts at 37° 52’ 51.23” N, 81° 54’ 4.68” W, heading upstream to 37° 52’ 52.66” N, 81° 54’ 1.90” W
CS-9; Unnamed Tributary of Little Dark Hollow. Total length of the impacted stream channel is ~0.04 miles (600’). Channel flow runs through mine spoil and is eroding sediment and rock into channel choking off flow.
Complete stream restoration will be needed for this reach.
Starts at 37° 53’ 45” N, 81° 54’ 1.0” W, heading upstream to 37° 53’ 46.0” N, 81° 54’ 3.5” W
ABANDONED MINE LANDS LOCAL CONCERN REPORT OSM-51 (continued)
NAME OF SITE: Ethel Hollow Stream Restoration; WV-2129
INFORMATION SOURCE: Jeffrey Davis, Southern Planning Supervisor, WVDEP-AML
ADDRESS: 601 57th St., SE
CITY: Charleston
TELEPHONE NUMBER: 304-926-0499
DATE: July 2025
RESPONSE TO QUESTIONS BY INTERVIEWER:
The Ethel Hollow watershed has been severely impacted by pre-law deep mining activities. WVDEP-AML has completed two (2) reclamation projects over the past five years to seal off dozens of open portals and un-controlled mine drainage from numerous completely collapsed and draining entries within the hollow. Phase I (sealing of mine entries) was completed in 2022. Phase II (Refuse Pile) was completed in 2025. In addition, a coal refuse pile was re-processed through AML which was completed in 2024. In addition, several emergency projects have been completed over the years to extinguish burning refuse within the hollow. During the numerous project activities completed within the hollow, the stream channel has also been assessed and determined to have been impacted by the mining activities, and reclamation work, but up to this point has been ignored. However, it was also determined that due to the on-going reclamation activities, the stream channel would not be dealt with until all reclamation work had been completed.
This Ethel Hollow Stream Restoration project is inventoried under the same Problem Area (Ethel Hollow Refuse and Portals, WV-2129) as the previous two projects described above.
ADDITIONAL PERCEPTIONS of the PROBLEM:
In 2025, the final reclamation project within Ethel Hollow was completed. Field assessment within Ethel Hollow shows that in numerous areas, prelaw mining and WVDEP-AML reclamation work has altered the stream flow, reduced the overall stream carry capacity, and in some areas allowed the stream flow to create new channels. As a result, the stream has little to no appropriate substrate to support aquatic life, and in some instances no floodplain.
In other areas, the channel is very narrow, which allows the water to pick up velocity causing scouring and erosion of sediment which then allows sediment to enter the stream channel and fill in substrate. Overall, the channel contains heavy loads of sediment, coal, refuse and coal fines which have caused the channel to become filled in and narrowed allowing for flood episodes to occur more often.
A total of approximately 23,565 linear feet (4.46 miles) of stream channel is directly affected by pre-law mining activities.
